Moe PO Box 30013 Raleigh, NC 27622-0013 Dear Sirs: You have our approval, in accordance with the attached conditions, to fill 0.10 acres of wetlands in Wilson County for the purpose of upgrading an existing vehicular crossing as you described in your application received by the Division of Water Quality on September 18, 2000. After reviewing your application, we have determined that this action is covered by General Water Quality Certification Number 3106. This Certification allows you to use Nationwide Permit Number 18 when issued by the U.S. Army Corps of Engineers. This approval is also valid for the Neuse Buffer Rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control; Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. V Cr,7 $ 2000 04011SSUEr 0 0 Zola Attached please find seven (7) copies of a completed permit application requesting coverage under Nationwide Permit (NWP) 18 (General Water Quality Certification No. 3106) for proposed fill activities at Martin Marietta's Wilson Quarry Site. Specifically, this Water Quality Certification is being requested to allow for the placement of 0.099 acres of fill material in a wetland area to allow for the upgrade of an existing crossing at the site. The existing crossing has a current top width of approximately fourteen feet (14') and a bottom width of approximately twenty-seven feet (27'). Our proposal is to utilize bulkheads versus 2:1 side slopes and increase the crossing width to a total outside width of thirty-eight feet (38'). Impacts have been minimized by the utilization of the existing crossing along with the construction of bulkheads versus fill slopes. The crossing will be utilized to allow for two-way vehicular traffic of heavy equipment from the plant area to the proposed pit area which is isolated by the subject wetlands. In accordance with Specific Condition 3 (B) of Mine Permit No. 98-30 as issued by the Division of Land Resources, a fifty foot (50') undisturbed buffer is required at the site between any affected land and any waterway or wetland, thus adhering to the Neuse River Buffer Requirements. Attached with the permit application is supporting documentation including a confirmed wetland jurisdictional determination, vicinity maps, flow calculations, and proposed crossing upgrade details. A copy of the same information has also been submitted to Mr. Todd Tugwell, Army Corps of Engineers (ACOE) Raleigh Regulatory Field Office. Two (2) existing 36" CMP's are in extremely poor condition and will be replaced with four (4) - 36" RCP's. Movement of material will be accomplished with the use of a bulldozer, backhoe or similar type equipment as as needed to accomplish the project. 13. PURPOSE OF PROPOSED WORK: Upgrade vehicular crossing to pit area to allow two way traffic of heavy equipment. 14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN WETLANDS. (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS): The property to be accessed is isolated by a wetland area to the east and Hominy Swamp to the west. The crossing upgrade as proposed utilizes an existing crossing instead of recommending new access to minimize wetland impacts. In addition, the crossing width has been minimized by using bulkheads for the outer limits of disturbance versus the typical 2:1 slide slope to provide just enough area to allow for two (2) way vehicular traffic and to provide necessary safety features as required by MSHA. 15. In accordance with Specific Condition 3 (B) of Mine Permit No. 98-30 as issued by the Division of Land Resources, a fifty foot (50') undisturbed buffer is required at the site between any affected land and any waterway or wetland, thus adhering to the Neuse River Buffer Requirements.
