After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below. 1. Dredging must not be conducted in Primary Nursery Area waters; 2. Turbidity controls must be maintained throughout construction, so that turbidity does not exceed 25 NTU's outside the project area. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to construct a pier and community docking facility (10 slips) to provide water access for their subdivision. Shandy Lane P.O.A. Page 2 9. PROTECT DESC' TP't'i(1N The project site is located adjacent to Masonboro Sound, at the end of Shandy Avenue, in New Hanover County. Shandy Lane is an existing subdivision consisting of twenty-three (23) single- family lots, of which, the majority have already completed residential development. The project site is a 1.71 acre (Tract B) which includes common area adjacent to Shandy Avenue and an easement, forty (40) wide, through a broad expanse of salt marsh to access a portion of an island, which is adjacent to the entrance canal for Shandy Point boat basin. Shandy Point subdivision is located north of the Shandy Lane development. Average elevations of the portions of the property that are above, mean high water (MHW) are 3-5 feet above mean sea level. The mainland portion of the tract is wooded. It includes what appears to be a stormwater retention basin for the subdivision. Here the shoreline includes a border of high marsh coastal wetlands, Black Needle Rush (Juncus roem ri mss), intermixed with Spike Grass (Dist- ichlis spi a a), Sea Lavender (LimQni=, spp.), Saltwort (SWimniia, spp.), Sea Oxeye Borric is fi es=), and Salt Meadow Grass (gip mina patens). The high marsh transitions to a marsh cove of Smooth Cordgrass ap mina alter„iflnra), which is approximately 600 feet in width from the mainland to the island. The highground island vegetation includes several Live Oaks, Pine, Red Cedar, Yaupon, and Wax Myrtle, fronted with shrubs, Marsh-elder (Iva frutescenc), and Grounsel-bush (BacLhM.S h lim'fo ia). The island's high marsh perimeter is similar to that listed above, which transitions to a border of Smooth Cordgrass (Sparrtina alte iflo ), approximately 130 feet wide, between the island and the open water of the Shandy Point boat basin entrance canal. The tract also includes a narrow bean between the island and another section of the mainland. When viewed on aerial photography, the berm is one several, between different islands in this area. They appear to be remnants of historical access from the mainland to the sound. The relic berm has some Red Cedar and highground shrub vegetation, flanked on both side slopes by areas of high coastal marsh. The berm is subject to occasionally overwash by extreme high, lunar and storm tides. The waters adjacent to project site are classified as SB# by the NC Division of Water Quality. The pound sign (#) indicates that wastewater discharges are prohibited to this segment of SB classification. The waters are designated as primary nursery area by the NC Division of Marine Fisheries, but they are CLOSED to the taking of shellfish. The width of the water body (open water area) is 182 feet, between the marsh vegetation bordering either side of Shandy Point entrance channel. The Wilmington-New Hanover Land Use Plan classifies the wetland area of the project site as Conservation and those areas above the 100 year flood elevation as Resource Protection. The applicant proposes to construct a pier and community docking facility (10 slips) to provide water access for their subdivision. The pier would be in two (2) sections. The first section would provide an elevated walkway from the shoreline to the island, and would be 631 feet long and 6 feet wide. Homeowners would utilize a highground foot path to the north side of the island where a second section of pier, 152 feet long and 6 feet wide, would access the floating dock. The floating dock would be oriented parallel to the channel, ranging from 15 to 25 feet waterward of the marsh vegetation, and would be 231 feet long and 5 feet wide. The structure would include nine (9) angled fingers piers on the waterward side (north) of the main floating dock, each Shandy Lane P.O.A. Page 3 measuring 20 feet in length by 4 feet in width. Nine (9) mooring pilings are proposed. Individual pilings would be located five (5) feet waterward of the end of each finger pier. Electricity, potable water, and lighting would be provided to the docks. 10. ANTICIPAT D IMPACT The proposed floating dock facilities would incorporate 5775 square feet of Public Trust Area and Estuarine Waters. The proposed pier sections would shade approximately 4608 square feet of coastal wetlands. There would be some disturbance of the marsh and shallow bottom along the proposed walkway alignments during initial construction, however, provided that the walkways are sufficiently elevated to avoid excessive shading impacts to wetland vegetation, no long-term adverse impacts are anticipated as a result of the pier construction. The long pier length and isolated location of the docks, may increase the potential for theft and/or vandalism problems. With the proposed slanting of the finger piers, the applicant is trying to address previous comments concerning the intrusion of the moored vessels extending into the waterbody, to reduce the potential for restricted navigation and congestion in the Shandy Point entrance channel. This new application for slips replaces the former application for 24 commercial slips that was previously filed and objected to by adjoining riparian property owners. The new application contains plans which angles the slips and moves their location closer to shore in order to be less obtrusive to' navigable traffic in Shandy Creek. Copies of the plans, surveys and plat for the residential slips will be sent to all adjoining riparian lot owners. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. If the subject project disturbs five acres or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. The stormwater rules require the Division to permit the common plan of development, therefore, any future development on the property, regardless of whether a CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Water Quality prior to any construction.
