After reviewing your application, we have determined that this work is covered by General Water Quality Certification Numbers 3274. This Certification allows you to use your CAMA Permit when it is issued by the Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the-conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. PROJECT DESCRIPTION This property is located at the end of Cobia Street on the barrier island of Sunset Beach in Brunswick County. The lot can be reached by crossing the Sunset Beach bridge and turning left onto East Main Street, traveling to Cobia and proceeding to the end of the street on the left. The lot is on the corner, bordered on two sides by man-made canals. The lot is vacant and covered by weeds and lawn grasses. The lot was originally platted at a size of approximately 52' x 85'. The property left above the mean high water line is now roughly 70' x 45'. The application states that the lot is approximately 5' msl in elevation. The shoreline of the lot is a gradual sandy, unvegetated, slope where the lot is collapsing towards the canal. There is a short erosion escarpment along the shoreline interface. Some Spartina patens vegetation is present on the high ground portion of the lot. The applicant proposes to construct a wooden bulkhead to stop the erosion of the lot and reclaim some of the property that has been lost over the last several years. The proposed bulkhead wall would be located an average of 12' waterward of mean high water. The maximum distance waterward of mean high water would be 19'. See sheet 9 of 14 of the plans for the proposed bulkhead location relative to mean high water. A total of 144 linear feet of shoreline would be bulkheaded as a result of this project. Backfill material would have to be hauled in from off site to be placed behind the wall. Both adjoining properties have an existing bulkhead. The applicant is proposing that his bulkhead line up with the adjacent bulkhead on Lot #34 and is asking that he be allowed to construct the proposed bulkhead 7' waterward of the Town's adjoining bulkhead at the street end of Cobia Street. The waters in Canal D have been classified as SC and the waters of the connecting canal have been classified as SA by the Division of Water Quality. Both canals are closed to the taking of shellfish and are not designated Primary Nursery Areas as determined by the Division of Marine Fisheries and Shellfish Sanitation. The waters are public trust and estuarine waters in accordance with Coastal Management designations. The waters of the canal are approximately -3' at low tide. The high ground portion of the lot falls within the Coastal Shoreline Area of Environmental Concern. 10. ANTICIPATED EMPACTS The project would result in the filling of approximately 1700 square feet of sandy shallow bottom. In addition approximately 700 square feet of high ground would be filled for the bulkhead installation. Some temporary turbidity in adjacent waters could result from the installation of the wall. About 98 cubic yards of backfill material will be required to fill behind the bulkhead, most of that being below mean high water. The wall structure must be constructed prior to any fill activity in order to avoid excessive off-site sedimentation. There are no vegetated wetlands on the site. Janet M. Russell / Wilmington / September 1, 2000 nn _7?2?cEHvE Project Narrative CAMA Major Application AUG 1162000,, Page lot, Lot 35-Canal D, Sunset Beach Brunswick County DIVISION OF COASTAL MANAGEMENT Purpose: The applicant proposes to construct a wooden bulkhead on a single-family, residential lot located on Cobia Street in Sunset Beach. The bulkhead would be located waterward of mean high water in an effort to reclaim eroded area and to align with an existing bulkhead. Existing Conditions: The lot is currently maintained in a mowed condition with grass varieties, Wild iris, and Hydrocotyle present. There are no structures on the lot. The lot is bounded to the southwest by Canal-D and is bounded to the west by a man-made canal which eventually connects to finks Creek. The canal which connects to Jinks Creek is classified as SA waters, while Canal-D is classified as SC waters. The lot is bounded to the north by Cobia Street and to the northeast by Lot 34. Adjacent bulkheads are existing on either side of the lot, on Lot 34 and at the end of Cobia Street. With two sides exposed to man-made canals which have heavy boat traffic, erosion has created an eroding bank along these sides. Waterward of the eroding bank, a sandy intertidal area exists and is devoid of vegetation. No coastal wetlands are found in this intertidal area. This has been confirmed by NC DCM staff during a 4/2000 site visit. Proposed Project: The applicant proposes to construct a wooden bulkhead along both sides exposed to the man- made canals. The bulkhead would align with the existing bulkhead on Lot 34, and would extend T waterward of the bulkhead at the end of Cobia Street. This additional T is requested to restore the lot to its original dimensions (as seen on the original plat enclosed). The owner would like to re-claim the original 52' of road frontage since the size of the lot is limiting, even with the original dimensions. Good bulkhead construction techniques would be used, with filter cloth placed behind all bulkhead. The backfill area will be seeded as a permanent erosion control method. No upland development is proposed. Stormwater Permit: The lot has been platted since 1972 and no impervious cover is proposed with this project. A CAMA Major permit (rather than a CAMA General permit) is required only because the bulkhead is proposed waterward of mean high water. Since this status is the only trigger for a Stormwater permit, and no impervious cover is proposed, we would like to request a single family exclusion. To ensure stormwater flow towards the street and away from the canals, backfill would be graded to create a slope in that direction. Any construction on the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement action by this Office. Either a Stormwater Permit Application Package including 2 sets of plans, completed application form, fee, and supporting documentation, or a written response regarding the status of this project and the expected submittal date must be received in this Office no later than September 16, 2000. Failure to respond to this request may result in the initiation of enforcement action, and construction may experience a subsequent delay. The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan approval letter must NOT be considered the Coastal Stormwater Management Permit, which will be signed by the Water Quality Supervisor.
