APPROVAL of 401 Water Quality Certification
To Whom It May Concern:
You have our approval, in accordance with the attached conditions, to disturb 0.02 acre of uplands in order to
enlarge the pedestrian beach access walkway to Fort Fisher in New Hanover County, as described in your
application received 13 September 2000. After reviewing your application, we have determined that this work is
covered by General Water Quality Certification Numbers 3274. This Certification allows you to use your CAMA
Permit when it is issued by the Division of Coastal Management. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will
expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application for a new certification. If
the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby
responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed
one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to
be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final ana binding unless you ask
for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.

Regional Beach Access Site: to enlarge the existing pedestrian beach access walkway to a width
of 11 feet, enlarge the shower area, and incorporate, into the design, a ramp for handicap access
to the beach.

9. PROJECT DESCRIPTION
The existing beach access facility is located on the oceanfront at Fort Fisher State Recreational
Area, at 1000 Fort Fisher Access Road, off US Highway 421, in southeastern New Hanover
County. The Beach Access Complex is a small part of the 287 acre Recreational Area managed
by the NC Division of Parks and Recreation, which includes all of the area from the Fort Fisher
Historic Site to New Inlet (Comcake Inlet). However, because of its bathroom and parking
facilities, it is a very high-use area for tourists, school and church groups, as well as, residents.
The existing facilities consist of a large paved parking lot (220' X 120'), an office and
educational/concessions building, public bath house and rest rooms, and a beach access walkway,
that includes a sand shower area. The original walkway to the beach from the bath house was
approximately 220 feet long and 6 feet wide, however, following the hurricanes of recent years
and recession of the shoreline, the rebuilt structure is only 140 feet in length.
The waters of the Atlantic Ocean are classified SB, by the Division of Water Quality. These
waters are OPEN to the harvest of shellfish. The Wilmington-New Hanover County Land Use
Plan classifies the area as Conservation. The Long Term Average Annual Shoreline Change (1992
Update) is 7.5 feet per year.
The State is proposing widen the existing beach access walkway from six (6) to eleven (11) feet.
At a point 30 feet landward of the existing stairs to the beach, the new section would begin to
ramp down to the sand at a 12:1 slope. This would allow handicap access all the way to the beach.
The division of the walkway and ramp would be separated by handrails. The applicant also
proposes to expand the wash-off shower area by constructing a 14 ft. by 7 ft. deck area to either
side of the existing shower area. This will eliminate congestion of the walkway around the
showers.
10. ANTICIPATm impACTS
The proposed project would disturb approximately 900 square feet of beach and dune area. The
proposed improvements would provide handicap access to the beach strand, as well as, an
improved facility for the public.
