The discharge occurred when a steel riser pipe failed. Samples taken by the Division indicate the wastewater reached surface waters (See attached lab results). Required Corrective Action for Violation 1: Please provide a description of the measures that were taken to make repairs to the failed riser pipe and to mitigate the wastewater discharged to the UT to Murphey's Creek. Include any costs incurred or expenditures that were necessary to complete the repairs and to stream cleanup. In addition, include your plan to prevent this type of violation from occurring in the future. You are required to take any necessary action to address the above violation. You are required to provide a written response to this Notice, including any additional information that you wish to provide related to this incident that you wish for the )(Division to consider, within 10 days of receipt of this letter. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. As a result of the violations in this Notice, this office is considering a recommendation for a civil penalty assessment to the Director of the Division. If you wish to present an explanation for the violations cited, or if you believe there are other factors, which should be considered, please send such information to me in writing within ten (10) days following receipt of this letter. This incident was reported to the Division on October 3, 2019. The timeline of this event is as follows: 1) On October 2, 20i9 at approximately 3:00 pm. The Environmental Manager for Murphy Family Ventures was notified of a possible animal wastewater spill near the intersection of GoldPond and Bonham Road in Magnolia NC. The Environmental Manager arrived at the location at approximately 3:30 pm and began to investigate. There was discoloration of the water in Murphey's Creek. There was no odor to the water. 2) The Environmental Manager and other staff rode the farm in an effort to determine the source of the spill. The source was located at about 4:5opm and was determined to be a broken irrigation riser. The system had been shut down at about 4: 00 pm by other farm staff in the normal operation of the day. 3) At approximately 5:30 the flow was contained on the farm side of Goldpond Road by the staff putting dirt in front of the culvert to stop the water flow. The staff began pumping the water into a tanker at approximately 8:30 pm and continued unti111:oopm. The water was hauled to another lagoon on a nearby farm. 4) The farm staff began remediation efforts at Murphey's Creek and Goldpond Road on October 3, 2019 at approximately 7:ooam. There was a pump set up and water was pulled from the creek and sent to a lagoon on a nearby farm. The staff continued to load tankers and haul to lagoon. 5) The remediation efforts continued on both days well into the night and began early the next day. The staff invested over 320 man hours and pumped approximately 423,86o gallons of water back into the lagoon. The containment dams were left in place until approximately 3:oopm on 10/3/2019. The pump ran from 7:3oam to 4:oopm with an estimated flow of 600 gpm. Both lagoons are three acres in size. Lagoon 3-3 levels for the day of event start 40" stop 45"• Lagoon 3-2 levels for the day of the event start 55" stop 6o". 2) The riser broke at some point during the day of the event. The estimate of 20,000 gallons lost is based on observation on the ground and the distance traveled with the addition of fresh water flow. The amount of the transfer was equal between lagoons. 3) The farm staff removed 6o,000 gallons of water from the tributary before the pump was keeping up with the flow. The corrective actions to be implemented as a result of this accidental discharge are to: i) The farm staff are to check the entire spray irrigation system prior to starting a transfer. 2) The riser was replaced. Incurred costs by the farm: 1) Labor cost equal to $6,400 for the 320 man hours 2) Equipment costs for pumps and hoses equal to $5,064 3) Equipment costs for tankers equal to $1,75o 4) Riser repair and upgrade equal to $1,200 5) Media cost for posting required by permit $159 Total Cost $14,573 There is a copy of the most recent waste analysis included with this letter as required by the farm permit. The information provided in this letter is that of the staff that responded to the incident. Upon a very thorough review, clearly the staff responded in a responsible manner and in accordance with the farms Emergency Action Procedures (EAP). In reading the Laboratory Results section, remember that materials with < 15% dry matter (generally liquids) are analyzed as received; all other wastes are dried first. Values in the Estimate of Nutrients Available for First Crop section are based on the type of waste and method of application you specify and reflects the fact that only 40-60% of the nitrogen becomes available within one year of application. The remainder may ormay not ever become available. ALE is Agricultural Lime Equivalence.
