An evaluation of the stream features were - *^ r performed to determine whether the site would require compliance with the Neuse Buffer Rule. This =.` specific project is referenced by the Raleigh Regional Office as NBRRO-00-146. The features represented on the Wake County Soils and the USGS Garner quad maps were evaluated to determine their subjectivity to the Neuse Buffer Rule. It was determined that there are three features located on the property that are subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative p :Code T15A:02B.0233 (NCAC 0233). These features and the required buffer are depicted on the plat ` map received by this Office on May 18, 2000. y__ f This letter addresses only those issues involving the riparian area. C. 27603 BILL HOLMAN SECRETARY Subject: Neuse River Basin Riparian Buffer Rules NBRRO 00-238 and 00-086 Bannister Industrial Park Wake County Dear Mr. Bannister: Last year I met with you several times at the subject property to conduct site visits for the project referenced by the Raleigh Regional Office as NBRRO 00-238. This site is located on the West side of Highway 70 (South). The features represented on the Wake County Soils and the USGS Garner maps were evaluated to determine their subjectivity to the Neuse Buffer Rule. As a result, it was determined that there three features (streams) present on the property that are subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). The unnamed tributaries to the Neuse River have been delineated on the map received by this Office on August 31, 2000 This letter only addresses the applicability of the Neuse Buffer Rules. This project is referenced by the Raleigh Regional Office as NBRRO 00-086. It was determined that there are three features on site that are at least intermittent streams. Three are represented on the Wake County Soils Map and two are shown on the Garner USGS Map. The Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233) states that water bodies that are at least intermittent are subject to protection. Therefore, these three features are subject to buffer protection. Please be reminded that a PreConstruction Notification and the appropriate fee must be transmitted and approved prior to any impacts to the buffer.
