Dear Mr. McDonnell,
On September 7, 2000, I met with you at the subject property located southeast of Wayne Memorial Road
(SR 1556) and east of Cox Road, Goldsboro, Wayne County (see attached map). The purpose of this
meeting was to determine the applicability of a stream feature indicated as existing on the subject property
on the Northeast Goldsboro, NC USGS topo map to the Neuse River Riparian Buffer Protection
Regulations (15A NCAC 2B .0233).
As a result of this meeting it was determined that the stream feature indicated on the USGS topo map is no
longer present within the boundaries of the Southeastern Medical Oncology Center property (see attached
photo). Per our discussion, you stated that the stream feature was piped and filled approximately 15 years
ago. It is the determination of this office that because the stream feature no longer exists on the subject
property, that the Riparian Buffer Protection Rules (15A NCAC 2B .0233) do not apply to said feature.
It is also the determination of this office that the stream feature does exist south of the property and existing
unnamed road. This feature was not evaluated as to whether or not it is a modified natural stream or a
"ditch". Therefore, the feature south of the property and unnamed road is subject to the buffer rules.

RE: Southeastern Medical Oncology Center
Enclosed is a section of USGS 15' Quadrangle for Northeast
Goldsboro, N. C. I circled the area in question. The USGS map
shows the blue line ditch continuing towards Wayne Memorial Drive
to approximately 400 feet from the centerline of the road. This
ditch was filled in approximately 12 to 15 years ago, and a
concrete storm drain was installed. The area of development that
I am working on is within the limits of the storm drain line.
The existing ditch is located south of the proposed development.
The existing ditch is now located approximately 1100 L.F. from
the center of Wayne Memorial Drive.
The development plans were reviewed by the City of Goldsboro, and
Item 12 of the enclosed pertains to this subject. Please comment
on this matter so that I can forward the information to the City
of Goldsboro Engineering Department.

10 Show the location and dimensions of existing and proposed water and sanitary sewer
service taps The Planning Department has informed the Engineering Department that the
site of the proposed building is outside the City limits. It is assumed that the new building
will be served by city water and sewer lines. Section 53.17 (A)(1) of the City of
Goldsboro's Code of Ordinances requires that access to water and sewer lines will be
provided to a requesting developer or private property owner outside the city limits oril}
upon the receipt and approval of a voluntary petition for annexation by the developer or
private property owner. This property must comply with the requirement for annexation.
11, Show all existing improvements and facilities, including but not limited to, existing storm
drainage lines, parking lots; structures, and water meters on the site plan. Clearly
delineate between existing and proposed facilities.
12. The U. S Geological Survey Quadrangle map of the area shows a ditch traversing this
property. The drainage ditch is therefore subject to the Neuse River riparian buffer rules.
Contact NCDENR for a determination of permissible development within the vicinity of
this ditch. Provide a copy of all correspondence regarding this determination to the
Engineering Department
13 Explain the disposition of the existing storm drainage system.
14 There is an existing 18-inch storm drainage line located within an existing 20 foot storm
sewer easement. This storm drainage line convevs stormwater from McLamb Place which
is maintained by the City of Goldsboro. The submitted site plan shows relocating this
storm drainage line within a proposed private easement. A private easement is not
permissible since the storm drainage line conveys stormwater from a public street. The
actions required to relocate this storm drainage line are as follows-
Prepare an 18-inch by 24-inch utility easement map suitable for recording in the
Wayne County Registry that shows existing property lines, streets, structures,
storm drainage lines, and easements.
• The map must show the proposed 18-inch reinforced concrete pipe within a
proposed 20 foot storm sewer easement at the new alignment
• The section of storm drainage pipe and easement to be withdrawn must be clearly
delineated and labeled.
