PROJECT SUMMARY: The applicant proposes to expand an existing docking facility by installing a new 12' x 12' boatlift, creating a total of three (3) slips. Jonathan Holland Page 2 9. PROJECT DESCRIPTION: The project site is located at 480 Roberts Road, adjacent to the AIWW and Topsail Sound, in Hampstead, Pender County. To find the property from the Wilmington Regional Office, take Highway 17 North from Wilmington approximately 12 miles and turn right onto Sloop Point Road (at the C-Store Gas Station/Subway). Travel approximately 2.1 miles to the intersection of Sloop Point and Roberts Road. Turn right onto Roberts Road and continue to the end of the road (turns to gravel/dirt). The subject property will be located at the terminal end of the road at house number 480 (new home construction). Existing man-made features on the property include a single-family residential dwelling (under construction) and a private docking facility. High ground vegetation consists of lawn grass and ornamental shrubs. The high ground portion is elevated approximately T-5' above the normal high water (NHW) level, and the shoreline (+/- 77 linear feet) is stabilized by rip-rap/concrete rubble. There is a narrow fringe of Coastal Wetlands bordering the property along the eastern shoreline. Residential properties border the property to the north, south and west and the AIWW and Topsail Sound border the property to the east. The existing pier and docking facility were authorized in June 2019 under CAMA General Permit No. 74315-D. The facility is located along the eastern portion of the property and extends approximately 45' beyond the outer edge of marsh, into a maintained access channel. The facility consists of a 6' x 20' access pier, 17' x 17' covered platform, 5' x 20' finger pier, 8' x 40' floating dock and 12' x 16' boatlift (located on north side of the existing finger pier). The existing docking facility extends approximately 43' beyond the outer edge of marsh, which places the entire structure within 1/4 of the width of the water body and just outside of the existing channel. The waters of Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They ARE designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish. Based on visual observations made by DCM staff during the January 2020 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding area. Water depths in the vicinity of the existing facility range from -2' to -6', relative to normal low water (NLW). PROPOSED PROJECT: The applicant proposes to expand the existing docking facility by installing a new 12' x 12' boatlift, creating a total of three (3) boat slips. According to the application package, a new boatlift would be installed along the north western side of the existing 5' x 20' finger pier, between the finger pier and the shoreline. The proposed boatlift would provide dockage for a single vessel. The additional lift would create up to three (3) potential docking spaces, when combined with the existing structures (existing boatlift and floating dock). The proposed boat lift would not encroach within the 15-foot riparian corridor setback of either adjacent riparian property owner. Water depths surrounding the existing floating dock and proposed boat lift average -2.5 to -3.0' during periods of low tide. Jonathan Holland Page 3 10. ANTICIPATED IMPACTS: The proposed structure would incorporate approximately 144 sq. ft. of Estuarine Waters and Pubic Trust Area. The boatlift would remain consistent with similar pier length requirements (established pier -head line) and would be located outside of the federal channel setback. Coastal Resources Commission for development activities at 480 Roberts Road, adjacent to the AIWW and Topsail Sound, in Hampstead, Pender County. The projected deadline for making a decision on your permit application is March 29, 2020. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from January 14, 2020, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road.
