Estimate to replace all with FabCo Filters was just below $100,Ofl0, but would still
require frequent maintenance, with confined space entry protocols. Monitoring
results were not favorable for pollutant removal efficiency.

Proprietary BMP Retrofits Uses
NCDOT believes its ongoing interaction with proprietary device developers is limited to
supporting research to move the science of stormwater control devices forward based on the
following:
a) NCDOT has only installed post -construction proprietary devices as part of research projects and associated retrofit
projects which fit the Retrofit Program's objective to support development of the Toolbox.
b) Permit requirements under the Toolbox require proprietary SCMS to be "evaluated in keeping with DEMLR
requirements for permitting new stormwater technologies". NEST requires the submittal of research data, which is
developed (in part) through NCDOT's research projects.
c) By policy, NCDOT does not typically to approve or mandate proprietary devices for projects. Therefore, any
request for approval under the NEST program should be made to NCDEQ. The Toolbox does not currently include
any proprietary devices.
d) The "Applicant" in the NEST program appears to be the developer of the device. Therefore, NCDOT believes any
request for approval under NEST is the responsibility of the applicant, and not NCDOT.
e) Should NCDOT decide to include a proprietary device in the Toolbox, NCDOT would only use those devices
approved by NCDEQ per paragraph "c" above so that NCDOT would not be showing favoritism.
f) Before a proprietary device is included in the Toolbox for implementation, the Toolbox must be approved by
NCDEQ. Therefore, NCDOT has two opportunities to review the device for function and applicability to NCDOT.

Product Evaluation Program
• Mandated program
• Administered by the Value Management Unit
• Reviews completed within one year
• Evaluates products viable for use in North Carolina's infrastructure
• Products evaluated are those typically those that have not been previously evaluated
by NCDOT and where a NCDOT Standard Specification does not exist
• Products evaluated by Technical Work Groups
• Different levels of approval
• Products can be removed from approved list

Procedures for Using Proprietary Items

— NCDOT and FHWAencourage competition in project lettings
— Requirements apply to any entity advertising projects through NCDOT, using Federal or State Funds governed
by CFR Title 23 Highways — 635.411 or NC General Statutes —133-3
— Purpose is to mandate and encourage free and open competition on public contracts
— Through the Stewardship and Oversight Agreement between NCDOT and NC Division of FHWA, NCDOT has
been given the responsibility to approve the use of proprietary products and processes
— Engineers have an inherent duty to use generic products instead of simply specifying proprietary products
— If proprietary products are used, must follow documented procedures
— Procedures are time consuming, limits competition and does not guarantee that the proprietary product will be
approved for use by FHWA or by NCDOT
Note: Proprietary BMPs proposed for compliance with the PCSP must get the project -specific approval of the State
Hydraulics Engineer since there are currently no proprietary BMPs in our Toolbox.
Federal Proprietary Product Law
Title 23 - Highways
• Federal Memorandum on Guidance on Patented and Proprietary Product Approvals:
http://www.fhwa.dot.gov/programadmin/contracts/011106.cfm
— Prohibits the expenditure of Federal -aid funds on a Federal -aid highway project "for any premium or royalty
on any patented or proprietary material, specification, or process" (referred to hereafter as "proprietary
product"), unless specific conditions are met. This regulation is intended to ensure competition in the
selection of materials, products, and processes while also allowing the opportunity for innovation where
there is a reasonable potential for improved performance.
