property resulting from the violation;
The initial report was that there was a spill around 15,000 gals of wastewater and that it had made it to surface water.
This wastewater has pollutants and bacteria that can degrade water quality and jeopardize environmental and public health.
2) The duration and gravity of the violation;
Not sure on the duration and gravity of the violation because The Division has only received the 24-hour report. We heard
that it was around 15,000 gallons that was discharged and made it to surface waters.
3) The effect on ground or surface water quantity or quality or on air quality;
The volume of wastewater can cause surface water quality impacts and degradation.
4) The cost of rectifying the damage;
Unknown but it was stated that they had a septic tank service and Lewis Farms contracted to help with the SSO.
5) The amount of money saved by noncompliance;
Unknown. Not sure how the site was cleaned up due to the owner not sending in the required 5-day report.
6) Whether the violation was committed willfully or intentionally;
The violation was not committed willfully or intentionally.
7) The prior record of the violator in complying or failing to comply with programs over which the
Environmental Management Commission has regulatory authority; and
There is no prior record that The Division is aware of.
8) The cost to the State of the enforcement procedures.
