PROJECT DESCRIPTION
Land Management Group, representing Daniel and Leslie Spearman, has requested that the attached application be
processed under the Express Permit Review Program.
The applicant's property is located at 106 SE 63rd Street, in the Town of Oak Island, Brunswick County. To find
the property, take Highway 17 South from Wilmington and turn left on N.C. State Highway 87. Head south on
Hwy 87 and turn right onto E. Oak Island/Yaupon Drive. Travel west approximately one to two miles and turn left
onto SE 63rd Street. The subject property will be located on the left hand side of the road adjacent to the mini-golf
course.
The undeveloped property is approximately 0.10 acres, and is dominated by Section "404 type" wetlands.
Approximately 2/3 of the site contains Section "404 type" wetlands, as confirmed by the U.S Army Corp of
Engineers, on 9/14/06. The site ranges in elevation from 10'-11' above Mean Sea Level (MSL). Vegetation within
the "404 type" wetlands consists of Wax Myrtle (Myrica cerifera), Marsh Pennywort (Hydrocotyle umbellata),
Poison Ivy (Toxicodendron radicans), and Groundsel (Baccharis angustifolia). High ground vegetation consists of
Live Oak and Long-leaf Pine.
Although the applicant's property is located outside of the Ocean Erodible Area of Environment Concern (AEC), it
is located within the High Hazard AEC, as indicated on the 2006 FEMA F.I.R.M Maps.
The waters of the Atlantic Ocean, which are located approximately 2,600 feet south of the property, are classified as SB by
the Division of Water Quality. This area is NOT designated as a Primary Nursery Area by the Division ofMarine Fisheries
and according to maps provided by the Shellfish Sanitation Section, the area is CLOSED to the harvesting of shellfish.
PROPOSED PROJECT: The applicant is proposing to fill approximately 3,240 sq. ft. (54' x 60' x +2') of Section "404
type" wetlands for development of asingle-family residence with associated driveway and utilities. The applicant is
proposing to construct a private residence with a footprint of approximately 38' X 52' in size, with a 2' overhang on each
side. The proposed driveway would originate along SE 63rd Street, and would be 10' at its most narrow point and 36' at it's
widest. The driveway would extend towards the east and terminate beneath the proposed dwelling. Parking would be
located beneath the residence as well as a 17' x 17' storage area. According to the application package, the storage area
would be less than 300 square feet (total floor area) and would have break-away walls. Two septic tanks would be located
in the far southwest corner of the property. These tanks would pump waste to a repair area and drainage field, both located
along the eastern portion of the property. It should be noted that there is an existing private supply well located on the
adj oining property, however, the applicant has designed the prof ect so that the proposed waste system is at, or greater than,
50-feet from the existing supply well.
The applicant's have indicated that they plan to mitigate for the "404 wetland" impacts by contributing to the NC
Ecosystem Enhancement Program. According to the CAMA Major permit application, they plan to make a payment into
the EEP's in-lieu fee program for restoration of 0.25 acres ofnon-riparian wetlands within the Cape Fear River Basin. In
addition, they plan to preserve the remaining wetlands on-site.
The Brunswick County Health Dept. has approved the construction of a private, single-family residence, as well
the installation and use of a Puraflo Peat Biofilter System for wastewater discharge. The plan was approved under
Brunswick County file # BCHD 1996044205A1. Additionally, the applicant's received a 401 Water Quality
Certification from the Division of Water Quality, on 8/04/06.
10. ANTICIPATED IMPACTS
The proposed project would result in the filling of 3,240 sq ft (0.074 acres) of Section "404 type" wetlands and the
entire disturbed area would be approximately 4,400 sq. ft. including the wetlands fill, house construction,
driveway, utilities and subsequent landscaping. No coastal marsh would be impacted.

I. INTRODUCTION
The applicants propose to permanently impact 0.07 acre and temporarily impact 0.009 acre of 404
freshwater wetlands in order to construct one home and wastewater system within Lot # 1; Block 3A off of SE
63rd Street in Oak Island, NC. To mitigate for these impacts, they plan to preserve the remaining wetlands
within the lot (0.10 acre) and make payment into the NC Ecosystem Enhancement Program for the restoration
of 0.25 acre ofnon-riparian wetlands. This lot is located within a VE flood zone and a CAMA Major Permit is
required.
II. EXISTING CONDITIONS
The 0.35-acre lot is located off of SE 63rd Street, between E. Oak Island Drive and the Atlantic Ocean
in Oak Island, North Carolina (Sheets 1 & 2). Dimensions of the lot are 90' x 202' x 65' x 200' .Existing high
ground elevations are 9' to 11' above MLW (Sheet 3). Approximately 0.18 acre of freshwater wetlands exist in
the center of the lot (Sheet 4). The 404 wetlands were approved by Mr. Tom Farrell of the U.S. Army Corps of
Engineers on July 16, 2004. The site is currently forested (Sheet 5). Uplands support loblolly pine (Pinus
taeda), American holly (Ilex opaca), water oak (Quercus nigra), and live oak (Q. virginiana}. Wetlands
support water oak, red maple (Ater rubrum), gallberry (I. glabra), and loblolly bay (Gordonia lasianthus).
Soils are mapped as Wando fine sand by the Soil Conservation Service (Sheet 6). The 2000 CAMA Land Use
Plan for the Town of Oak Island classifies this area as Developed/Residential and it is zoned as residential (R-
5) bythe Town of Oak Island. Surrounding land use issingle-family residences to the south and east, SE 63rd
Street to the west, and the Oak Island Jungle Golf Course to the north. ~ ~ ~ ~ E

It should be noted that prior to discovering the proposed fill would be within a VE Zone, the
Spearmans applied for and received permits from the U. S. Army Corps of Engineers and from the Division of
Water Quality for the proposed wetland disturbance within the lot (Action ID#200400321; DWQ #040022).
The Spearmans have also received an Improvement Permit from the Brunswick County Health Department for
the installation of an on-site wastewater system.

III. PROJECT DESIGN AND OBJECTIVES

The applicants propose to build a small residence within the lot (Sheet 7). The proposed house
footprint is 38' x 48' and the house will be placed on pilings that are 8' 6" above finished grade. The top of
the house will be 34' 9" in height. A total of 0.07 acre of freshwater wetlands (54' x 60') will be filled to the
elevation of adjacent uplands in order to provide sufficient area to build the house and to provide for side
slope and adequate drainage away from the structure (Sheet 8). The existing elevation in this wetland pocket is
9' and the proposed elevation will be approximately 11' (Sheet 3). The driveway will be a Y shape with a 10'
width where it meets SE 63~d Street that will expand to 34' wide where it meets the front of the house. The
driveway and house pad will consist of concrete.
A Puraflow Peat Biofilter, Type A wastewater system has been permitted by the Brunswick County
Health Department for the site. An 8' x 5' septic tank and an 8' x 5' pump tank are proposed in uplands
located in the southwestern corner of the lot. The tanks will be buried underground with the top of the tank
being placed just below ground level. Current elevations in this area are 10.5' MSL. The area will be returned
to 10.5' MSL. The peat system, including the repair area, will be 30' x 18' in size and will be installed in
uplands in the eastern part of the lot. Three pods that are each 4.5' x 7' will be placed above ground. The bed
will be installed at ground level. Gravel and peat material will make up the bed. The existing elevation in this
area is 11' MSL and the area will be returned to 11' MSL except for the area containing the pods. A 2"PVC
supply line will run from the tank to the peat system. This line will be located within a 5' x 155' utility
corridor. Approximately 100' of this line will be installed in wetlands, which will temporarily impact 0.009
acre of freshwater wetlands. This pipe will be installed only a few inches below ground. Material excavated
will be sidecast within the 5' wide corridor. Once the pipe is installed, the material will be placed back into
the trench and the area will be restored to natural grade. Material that will be excavated from uplands in order

to install the tanks and the shallow bed will be temporarily placed in adjacent uplands. For the tanks, a 15' x
20' upland area directly west of the tanks will be used. For the bed, a 40' x 30' upland area located directly
south of the proposed bed will be used.
IV. POTENTIAL ENVIRONMENTAL IMPACTS ~~

The proposed project will permanently impact 0.07 acre and temporarily impact 0.009 acre of
freshwater wetlands. Secondary impacts to wetlands and water quality could occur during and after
construction of the project through erosion and stormwater runoff. However, this project will be aloes-density
development and will have minimal impervious cover. To reduce impacts to wetlands from erosion during
construction, silt fences will be used around the construction area.
The applicants plan to mitigate for this impact both on site and through the NC Ecosystem
Enhancement Program (EEP). The Spearmans plans to preserve all non-impacted wetlands on site (0.10 acre)
through a deed restriction (enclosed). In addition, they will make payment into the EEP's in-lieu fee program
for restoration of 0.25 acre ofnon-riparian wetlands within the Cape Fear River Basin. A letter of acceptance
has already been issued by the EEP (enclosed).
Based on proposed wetland mitigation and construction measures, the direct and cumulative impacts
from the proposed project are considered insignificant.
