Project # 00-4767 UT to Speight Branch 103-04-02, 27-43-3.5, WS-III NSW I Dear Sirs, You have our approval, in accordance with the attached conditions, to place till within 115 linear feet of stream, 0.495 acres of wetlands and 0.303 acres of protected riparian buffers for the purpose of constructing the proposed road crossing, as described within your application received by the Division of Water Quality (DWQ) on August 17, 2000 and in subsequent correspondences received on 10/20/00 and 11/17/00. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3287. This Certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it. This approval will also act as your Authorization Certificate under the Neuse River Riparian Buffer Protection Rules (15A NCAC 2B .0233). In addition, you should get any other required federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control and Nun-Discharge. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. 1'his approval is only valid for the purpose and design that you described in your application and subsequent correspondence. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). If total buffer impacts for this project (now or in the future) exceed 1/3 acre or 150 feet, compensatory mitigation may be required as described in 15A NCAC 213 .0233. The condition is not applicable to the project for the following reasons: 1) The impacted areas subject to the Neuse River buffer rules based on a site meeting with Charles Brown of DWQ on 3/21/00 are less than 1/3 acre. Therefore, no buffer mitigation should be required. Mr. Brown's confirmation letter is attached. 2) The impacted area in question is not a significant stream based on the same meeting with Steve Mitchell. Therefore, we are not sure if stream mitigation is required. We would still like to have the site meeting we requested in our application or if you prefer assume no mitigation is required since less than 150' of stream subject to the buffer rule is impacted and it is probable that the area is not a significant stream if it is not subject to buffers. We apologize for this confusion. However, I did not realize that S&EC Staff had previously performed buffer work on-site when the application was submitted. Based on our previous DWQ approved delineation of buffers, the actual impacts are 115 linear feet of stream and .303 acres of buffers. At your convenience please provide us with a revised 401 certification that notes the correct impact (see summary at the end of this letter) and is not conditioned to require mitigation (stream nor buffer) or call me to set up a site meeting to determine if stream mitigation is required (buffer mitigation is definitely not required). Total impacts include 0.495 acre of wetlands and stream channel, which includes 240 linear feet of stream channel. Enclosed is a map depicting all of the proposed wetland and stream channel impacts. The USACE's current policy requires mitigation for impacts that exceed the requirements for notification. NC-DWQ's current policy requires mitigation for wetland and stream channel impacts above 1/3 of an acre and 150 linear feet. Because the proposed cumulative impacts resulting from the project exceed the aforementioned thresholds, S&EC believes that wetland or stream channel mitigation may be required. This will be determined after a significance determination is made by DWQ. The stream channel that will be impacted by the proposed road is subject to the Neuse River Basin (NRB) riparian buffer rules while the isolated pond is not based on soil maps and USGS Topo. The road crossing will impact approximately 0.60 acres of riparian buffer (0.37 acres in Zone 1 of the buffer and 0.23 in Zone 2) and 240 linear feet of stream channel. A "no practical alternative" letters is enclosed that explain the need to construct a road across the buffered channel. Current NC-DWQ policy allows road crossing with mitigation if the impacts are more than or equal to 150 linear feet of stream channel or 1/3 of an acre of riparian buffer. Because the project impacts are above these thresholds, S&EC believes that riparian buffer mitigation will be required. In making this road a six-lane facility, the constraints of the two horizontal curves at the design speed required did not leave enough room to meet standards set by the North Carolina Department Of Transportation (NCDOT) and the American Association of State Highway and Transportation Officials (AASHTO). In other words, the realignment of Walnut Street to the West of the dam was necessary in order to straighten out the road and give enough horizontal length between curves to work out the superelevation required. This realignment is shown as an approved thoroughfare on the Town of Cary's Southeast Gateway Area Plan, approved by the Town Council on March 12, 1998.
