Please find attached the Initial Credit Release letters for the WLS Yadkin 01 Umbrella Mitigation Bank: Grassy Creek
Tributaries Mitigation Site (SAW-2017-02528). As requested, 15% credit is being released for satisfying the initial release
requirements pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish the WLS Yadkin 01
Umbrella Mitigation Bank, signed by USACE on December 18, 2019, and the Grassy Creek Tributaries Final Mitigation
Plan, dated September 2019. In accordance with the plan, 758.5 stream mitigation units (SMU's) are now available for
the Grassy Creek Tributaries Mitigation Site. Feel free to contact me with any questions.

Dear Mr. McIntyre:
This correspondence is in reference to your December 26, 2019 request for the initial credit
release for the Grassy Creek Tributaries Mitigation Site, part of the WLS Yadkin 01 Umbrella
Mitigation Bank. The Grassy Creek Mitigation Site is located approximately five miles south of
the Town of Pilot Mountain in Pinnacle, Surry County, North Carolina. The 13.1-acre project
presents 6,351 linear feet (LF) of stream restoration and enhancement generating 5,057 warm
Stream Mitigation Units (SMU), along Grassy Creek and its unnamed tributaries in the Upper
Yadkin Watershed of the Upper Pee Dee River Basin (03040101). The purpose of this letter is to
confirm the initial release of credits for this mitigation site.
Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish the
WLS Yadkin 01 Umbrella Mitigation Bank, approved January 27, 2020; and the site -specific
Grassy Creek Tributaries Final Mitigation Plan dated September 2019, fifteen percent (15%) of
the mitigation site's total restoration and enhancement credits shall be available for sale
immediately upon completion of all the following:
a. Execution of the MBI by the Sponsor, the Corps, and other agencies eligible for
membership in the IRT who chose to execute the agreement.
b. Approval of the Final Mitigation Plan.
c. The mitigation site must be secured.
d. Delivery of the executed financial assurance documents as described in Section IX of the
UMBI and Section 12, page 57 of the Grassy Creek Tributaries Final Mitigation Plan,
dated September 2019 and approved January 27, 2020.
e. Recordation of the Corps -approved site protection mechanism described in Section X of
the UMBI, and both Section 2.3 and Appendix D of the Grassy Creek Tributaries Final

Mitigation Plan, dated September 2019 and approved January 27, 2020, including a title
opinion covering the property.
f. Issuance of the 404-permit authorization for site construction.
By copy of this correspondence, we confirm that you have satisfied the above
requirements for initial release for all parcels within the bank; and 758.55 SMU's constituting
15% of the mitigation site's total restoration and enhancement credits are now available for sale.
This site does not include any wetland or preservation credits.
