Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit 198000291. Therefore, you may commence construction activity in strict accordance with applicable State authorization. Failure to comply with the State authorization or conditions of the general permit could result in civil and/or administrative penalties. The following are conditions that should be included with your DA permit: 1. The permittee shall comply with the attached list of United States Coast Guard Regulations. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. After reviewing your application, we have determined that this work is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. FIELD INVESTIGATION REPORT: CARTERET COUNTY (BULKHEAD CHANNEL) /CARTERET COUNTY PAGE #2 9. NARRATEVE DESCRIPTION: Project Setting Bulkhead Channel is located south of the Morehead City/Beaufort Causeway just east of Radio Island, immediately south of Pivers Island, and north and west of Town Marsh. A 44- slip marina is located on the tip of Radio Island at the confluence of Bulkhead Channel and Morgan Creek. The Duke University Marine Lab and their docks are located on Pivers Island while the Rachel Carson Reserve, a component of the North Carolina Coastal Reserve and the National Estuarine Research Reserve' is located on Town Marsh. The North Carolina State Ports Authority has some of its operation located on Radio Island as well. Bulkhead Channel is a federally maintained channel that joins the Morehead City Channel just south of Radio Island. Beaufort Inlet is located only a mile or so to the south. Bulkhead Channel provides the water entrance into the Town of Beaufort and Taylors Creek as well as providing access to Gallants/Beaufort Channel and Town Creek and the many marinas, commercial water related businesses, and private docks along the water. There are several federally maintained channels that are located "upstream" of Bulkhead Channel. According to the applicant, the North Carolina Wildlife Resources Commission has not approved this No Wake Zone; however, House Bill 1659 was passed in late July of this year and established several No Wake Speed Zones in Carteret County. This area was one of those zones. Project Description Carteret County proposes to install eight No Wake signs to delineate a No Wake Zone along Bulkhead Channel authorized by the General Assembly via HB 1659. Pursuant to the bill, the County is required to place signs indicating the No Wake area. The area proposed established a No-Wake Zone from the Duke Marine Laboratory's docks to the rock jetty on the east side of Radio Island. According to the Bill "No-wake speed is idle speed or a slow speed creating no appreciable wake. " The coordinates for the eight No Wake pilings can be found on the attached plats 1 and 2 dated 7/11/00. All waters within the area delineated by the coordinates would be included in the No Wake Zone. Construction will consist of the placement of eight salt treated pilings with appropriate signs. The pilings would be installed by a barge and driven and/or washed into place. Pilings would be approximately 40' in length with the sign some 8' to 10' above the MLW. The No Wake signs would be 4' X 4' in size. Anticipated Impacts There would be very little environmental impact as a result of the installation of the eight pilings for the No Wake Zone. Most of the potential impact would be associated with the boating public and the potential impact to commercial entities operating on the federal channel. The potential upside of the no-wake zone would be safer boating conditions along Bulkhead Channel. M.
