Dear Mr. Gomto:
You have our approval, in accordance with the attached conditions, to place fill material in 0.05 acres of wetlands for the
purpose of constructing the City of Wilmington Pump Station No.44 project, as you described in your application dated July 24, 2000.
After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3289. This
Certification allows you to use Nationwide Permit Number 12 when the Corps of Engineers issues it. In addition, you should get any
other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future)
exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you
must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

The City of Wilmington has acquired the services of Kimley-Horn and
Associates, Inc. to design, permit, and provide construction observation services
for Pump Station No. 44 on Division Drive. The Pump Station No. 44 project
includes an intercepting sewer, regional pump station, and force main to serve
the Wilmington Industrial Park and other facilities on Division Drive and rn
accommodate the City's long range planning for the Division Drive area. The C-3 -.c
project consists of a 600 GPM duplex suction lift wastewater pumping station m
with associated site work, approximately 2,550 LF of sanitary sewer, and ^C

We have made attempts to minimize and avoid impacts where possible by
rotating our site plan and crossing wetlands where necessary at close to 90-
degree angles. The encroachment area, as delineated on our plans, totals about
2,040 SF or 1/201h of an acre. Temporary dewatering will be required for
construction.
Attached please find seven (7) copies of drawings for the areas of the project that
involve a wetlands encroachment. The wetland encroachments are delineated
with a hatch pattern. The encroachment areas are as follows:
• At the pump station site (sheet C3), we will need to clear
approximately .02 acres of wetlands and will fill possibly a few
inches over an area of approximately 1 1 sf. This area is located
where the 8 contour line crosses the hatched pattern representing the
wetlands. Based on the standard precision of both delineation and
construction, there may actually be no fill at all. We do not see that
permitting a few inches of fill in 1/40001h of an acre is necessary but
will proceed based on your ruling. The areas to be cleared will be
returned to pre-construction conditions.
• Approximately 110 linear feet of gravity sewer will encroach on

wetlands along the shoulder of Division Drive as denoted on sheet
C4. This area is approximated to be 0.013 acres. Of the 110 linear
feet, approximately 30 feet will be for the creek crossing and will be
encased in concrete. The width of the clearing will be approximately
15-20 at the creek crossing and 8-10 feet along the shoulder of
Division Drive. No permanent fill will be placed in this area and
they will be returned to pre-construction conditions.
Approximately 60 linear feet of force main sewer will encroach on
approximately 0.014 acres of wetlands as denoted on sheet C6. The
width of the encroachment is approximated to be 10 feet. The areas
to be cleared will be returned to pre-construction conditions.

Division Drive, approximately 0.25 miles south of the intersection of Division Drive and N 23`d Street, in

Description of Activity: Mechanized land clearing and filling of 0.05 acre of jurisdictional wetlands associated

On July 26, 2000, your application on behalf of the City of Wilmington for a 401
Water Quality Certification for a project in New Hanover County was received by the
N.C. Division of Water Quality. Please note that beginning January 1, 1999, the N.C.
General Assembly passed legislation requiring payment of a fee for all 401 applications.
Your application is being returned since no payment was received with the package. The
fee for applications is $200 for projects impacting less than an acre of wetland and less
than 150 linear feet of streams. For projects impacting one or more acres of wetland or
150 or more feet of streams, the fee is $475. In order for DWQ to review and process
