Pender, Piedmont Region Coordinator Habitat Conservation Program DATE: 6 October 2000 SUBJECT: Pre-construction Notification Application for Hasentree Subdivision, Wake County, North Carolina. DWQ ID: 001061 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject pre-construction notification. A site visit was conducted on 4 October 2000 to further evaluate impacts to fish and wildlife resources. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), and North Carolina General Statutes (G.S. 113- 131 et seq.). Applicant proposes to impact 0.08 acres and 357 linear feet of stream with culverts and fill for access roads on a 720-acre tract of land for a residential development, Hasentree Subdivision. The streams that run through the project flow into Falls Lake of the Neuse River Drainage Basin. On the 4 October 2000 site visit, stream crossing No. 1 and No. 2 were viewed and were both flowing. Upon brief examination, the stream at crossing No. 1 was observed to average about 3 feet in width, to have noticeable pool and riffle areas, and to be inhabited by water striders and stoneflies. The stream at crossing No. 2 had an average width of about 1.5 feet and water striders and frogs were observed. The project area appears primarily a mixed hardwood (maple, oak, sweetgum) and pine forest. According to the site map, there are a number of lots that are located within Neuse River Buffer Zone area. We recommend that the following conditions be incorporated into the permit to reduce impacts to fish and wildlife resources. Lot owners should be informed that a portion of their property is within Neuse River Buffer Zone area and advised of the Neuse River Buffer Rules. We recommend that the riparian buffer be recorded on deeds and be placed in a conservation easement. A minimum 50-foot undisturbed, forested buffer should be maintained along all intermittent streams and wetland areas, while a minimum 100-foot undisturbed, forested buffer should be maintained along all perennial streams within the project area. Maintaining undisturbed, forested buffers along these areas will minimize impacts to fish and wildlife resources, water quality, aquatic habitat both within and downstream of the project area, and help prevent the extirpation of endangered and threatened species. In addition, wide riparian buffers are helpful in maintaining stability of stream banks and for treatment of pollutants associated with urban stormwater. 3. Use bridges for all permanent roadway crossings of streams to eliminate the need to fill and culvert. If culverts must be used, the culvert should be designed to allow for fish passage. Generally, this means that the culvert or pipe invert is buried at least one foot below the natural streambed. If multiple cells are required, the second and/or third cells should be placed so that their bottoms are at stream bankfull stage (similar to Lyonsfield design). This will allow sufficient water depth in the culvert or pipe during normal flows to accommodate fish movements. If culverts are long, baffle systems are required to trap gravel and provide resting areas for fish and other aquatic organisms. If multiple pipes or cells are used, at least one pipe or box should be designed to remain dry during normal flows to allow for wildlife passage. In addition, culverts or pipes should be situated so that no channel realignment or widening is required. Widening of the stream channel at the inlet or outlet of structures usually causes a decrease in water velocity causing sediment deposition that will require future maintenance. Finally, riprap should not be placed on the streambed. 4. Locate sewers and other utilities as far away from creeks as functionally possible and minimize stream crossings. It is preferable that sewers be located outside the riparian buffers. 5. Use grass swales to convey stormwater where practicable. Route stormwater to bioretention structures for treatment (i.e., rain gardens) or allow it to infiltrate into the riparian areas. To protect aquatic habitat, it is preferable that the post-development hydrograph not exceed the pre-development condition. Energy dissipaters should be installed as necessary to prevent scouring by stormwater discharges. Thank you for the opportunity to review this pre-construction notice. Box 19808 Raleigh, NC, 27619 APPROVAL of 401 Water Quality Certification and Additional Conditions Dear Mr. Dickerson: You have our approval, in accordance with the attached conditions, to place fill in 0.07787 acre of wetlands and 357 linear feet of streams to construct the Hasentree Subdivision in Wake County, as you described in your application received by the Division of Water Quality on August 11, 2000. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Numbers 3287 and 3289. This Certification allows you to use Nationwide Permit Numbers 39 and 14 when issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below. 1. Deed restrictions or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. (UTM Coordinates; Zone 17, 3985200 N, 716300 E). Proposed impacts to waters for the construction of the residential subdivision using the combined requested Nationwide Permit 39 and 14 will total 0.07787 acres (i.e. less than 1/2 acre) (0.0281 acres NWP 14 and 0.04977 acres NWP 39) and 357 LE (105 If unimportant channel) (252 If NWP 14 and 1051.f. NWP 39) for the construction of roads to gain access to home lots. The crossings utilizing Nationwide Permit 39 are not in _-:0 r-ri the mapped floodway. Crossings 1 and 2 also are believed to cross at points with flow c7 m less than lcfs (37.4 acres are drained at Crossing 1 and 13.8 acres at Crossing 2). . Construction of the subdivision will comply with the general conditions stated within o Nationwide Permits 39 and 14. 'i S&EC, Inc. believes that no mitigation will be required for this project. Proposed impacts totaling 0.060 acres and 306 linear feet will utilize Nationwide Permit 14 it, order to connect the existing Frank Bailey Road (S.R. 1920) to NC 98. The remaining proposed impacts of 0.019 acres and 135 linear feet will utilize Nationwide Permit 39 for the purpose of constructing a road in order to gain access to an otherwise isolated area of land. The U.S. Army Corps of Engineers has not evaluated the site at this time, however the NC Division of Water Quality has verified the Neuse Buffers. If for some unexpected reason wetland mitigation were to be required, our client proposes payment into the North Carolina Wetland Restoration Fund. Neuse Buffers are being completely avoided where possible and are being included in larger areas of open spaces. The proposed road crossings avoided impacting wetlands where possible. For example, crossing #2 impacts the smallest wetland area along the channel in that location. Open space for the proposed Hasentree Subdivision southwest of the existing Frank Bailey Road totals 66.75 acres. Wetland Delineation/1'ermitting/A4itigation Soil/Site Evaluations On-Site Septic Systems Environmental Assessments/Audits Neuse Basin and Watershed Buffer Evaluations Groundwater Hydrology Endangered Species Charlotte Office: (704) 516-3922 - Hickory Office: (828) 312-7902 The surface waters subject to the Neuse River Buffer regulations (15A NCAC 2B .0233) have been verified by Mr. Bob Zarzecki of the DWQ. The DWQ Project # 00-0781 and NBRRO Project # 00-156 reference Mr. Zarzecki's findings. S&EC, Inc. believes that no buffer mitigation will be required for this project. The proposed impacts are allowed under the current Neuse River Buffer regulations without requiring a variance from the Environmental Management Commission (i.e. all of the road crossing buffer impacts are under 1/3 acre). The tributary of Pierce Creek that Crossing 3 impacts drains 85.3 acres at its intersection with Pierce Creek. Pierce Creek drains 96.2 acres at its intersection with the Crossing 3 tributary. For this reason it is not believed that Crossing 3 and Crossing 4 impact the same channel and therefore no buffer mitigation is required. If for some unexpected reason buffer mitigation were to be required, our client proposes payment into the North Carolina Wetland Restoration Fund.
