Due to the past history of the site this office is concerned with the accumulation of nutrients in the
stormwater and its runoff. The accumulation of the nutrients in the stormwater ponds may pose
future issues/problems.
This office would like to be notified if problems with nitrogen and phophorous occurs with the
stormwater pond. (i.e. high algae production in the ponds or algae growth at discharge locations
,tfall.) of the ponds. At that time additional measures may be required . protect water quality,

the confluence of the Brunswick and Cape Fear River in Brunswick County.

9. PROJECT DESCRIPTION
KCS International has purchased a 60-acre tract of land within the town limits of Navassa in Brunswick
County. The site is located on Navassa Road (SR 1430 & 1435) at the confluence of the Brunswick River
and the Cape Fear River immediately South of the railroad trestle. The tract of land is relatively high,
12-20' NVGD. The high ground along the shoreline borders federal 404 wetlands transitioning to a wide
span of coastal marsh. The predominant coastal species present is Sn rtina It rniflora or smooth
cordgrass. The applicant is requesting to fill one finger of federal wetlands on the tract. The amount of
fill being requested is .1 acres and is described in the Project Narrative and shown on the sheet entitled
site Design "Fill Request". No impacts to coastal wetlands are proposed.
The site was previously developed and was the location of fertilizer factory. The old factory partially
burned, was subsequently demolished and the debris removed. Site work is underway for the KCS
facility. The company manufactures Rampage and Cruiser Yachts. Grading and land disturbance is
estimated to be 35 acres. Sedimentation and Erosion Control plans have been approved through Land
Quality and Stormwater Management Plans have been approved by the Water Quality Section of DENR.
Two stormwater basins have been constructed with a gravel swale and curb and gutter directing runoff
to the basins. 300,000 square feet of building space will include an assembly building, a lamination
building, storage, maintenance and offices. Structures such as gravel pads, parking lots and buildings,
etc. will be more than 100' from mean high water. Please see sheet C 1, Grading, Drainage & Erosion
Control Plan for details.
The applicant is also proposing to construct a travel lift to take boats in and out of the water. The travel
lift, as depicted on the plans, would slightly exceed the 1/4 width of the waterbody. In addition to the
travel lift, a pier and floating dock system are proposed. The pier is proposed at 135' long by 8' wide
with 100' of the proposed pier structure being over high ground. A 225' long by 8' wide "L" dock is
proposed off of the pier with five floating fingers (approximately 8' x 45') A total of 4 boat slips are
being proposed. Boat sizes are estimated at 16' wide by 50-55' long. No pumpout facility or fuel pumps
on the dock are proposed. The docking system would be used to moor yachts being manufactured and
tested at the facility. The Brunswick River is deep in the vicinity of this project, as evidenced by the
soundings on the plans (-17' to -53' deep). No dredging is being proposed. Any and all remnant pilings
from previous stricture(s) are to be removed prior to the commencement of construction of new docking.
Approximately 220 linear feet of rip rap rock is proposed for shoreline stabilization in the vicinity of the
dock and travel lift. The slope in this area is roughly 18' high with shorter slopes adjoining. All of the
rock material would be landward of mean high water and above and out of all wetlands. A cross-sectional
view of the rock is included with the application package.
The Brunswick River has been designated as a Primary Nursery Area by the Division of Marine Fisheries.
Primary nursery areas are those areas in the estuarine system where initial post-larval development takes
place. The area is not open to the taking of shellfish. Waters have been classified as SC by the Division
of Water Quality. The SC classification is a tidal salt water class whose best uses are listed as aquatic
life propagation and survival, fishing, wildlife, and secondary recreation.

10. ANTICIPATED DdPACTS
The proposed project will result in the redevelopment of a 60-acre tract of land bordering coastal
wetlands, federal wetlands and public trust waters. Approximately 35 acres may be disturbed in the
grading process. No impervious surfaces are planned within 75' of mean high water. Stormwater control
measures are required and either have been or will be installed. The pier, docking facility, travel lift and
boat slip areas will result in the shading of approximately 16,200 square feet of public trust waters. No
wetlands will be crossed to gain access to the water. If authorized, .1 acre of federal wetlands may be
filled as a result of this development. No dredging will be done and there are no anticipated impacts to
coastal marsh.

1. INTRODUCTION DIVISION OF
COASTAL MANAGEMENT
The project site (an approximate 60-acre tract) is located at the northern confluence of the Brunswick and
Cape Fear Rivers to the east of the intersection of State Routes 1430 and 1435 in the town of Navassa
(Brunswick County), NC. The site is zoned `Industrial' and is classified as `Developed' according to the
CAMA Land Use Plan. The applicant, KCS International, Inc., is constructing a boat manufacturing and
testing facility that would produce their line of Rampage and Cruiser Yachts currently manufactured in
their Oconto, WI facility. Site development will include the construction of assembly and maintenance
buildings, offices, and waterfront dockagehravel lift.
II. PROJECT DESIGN AND OBJECTIVES
KCS is experiencing capacity restraints in other facilities while continuing to experience unprecedented
demand. The company looked at over 40 sites in five different states, before selecting the Navassa tract as
the future site of their new manufacturing facility. The tract is unique in that it provides enough space for
current facility designs while providing deep water access to allow for water-delivery and year-round boat
testing capability. Buildings totaling approximately 300,000 square feet will house lamination,
subassembly operations, final assembly, raw material storage, maintenance, and offices. Currently, KCS is
under contract for over $10 million for proposed work. It is expected that the facility will employ 600
people (making it the third largest employer in the county behind CP&L and Dupont). Approximately $12
million will enter the Brunswick Economy annually through direct payroll compensation. In addition,
market research indicates that 5% of the net sales volume annually will be spent by KCS on local goods
and services (e.g. of $30 million of net sales, approximately $1.5 million will be spent locally).
KCS has had an impeccable environmental record since its inception in March, 1993. They have had no
incidences of hazardous material spills and are in compliance with all operating permits at their other
facilities. The primary hazardous waste of their manufacturing facilities is used acetone. The used acetone
is collected in the plant and sent to a reclaiming service that distills the impurities and resells the acetone
back to the facility. All non-hazardous waste (e.g. finished fiberglass, plywood, canvas, carpet remnants,
and packaging materials) is landfilled. A contingency plan (based on their other facilities) will be
implemented to address any potential environmental issues that may arise during operation.
III. SITE HISTORY AND EXISTING CONDITIONS
The tract historically was the site of a guano fertilizer factory which began operation in the 1880's. The
Navassa guano plant was later purchased by the Virginia-Carolina Chemical Company. In 1991, the
abandoned factory burned with a portion of the structures still remaining. These remaining structures were
contaminated with asbestos material. In addition, much of the site had been used as a dumphransfer area
for concrete, bricks, metal refuse, and tires. Site remediation was initiated immediately prior to the transfer
of property ownership to KCS International. Asbestos material and other refuse has been cleared in
preparation for the proposed development of a boat manufacturing facility.
Upland elevations on the tract range generally between 12-20' NGVD. Much of the tract was open field
with various upland grasses, dog fennel (Eupatorium leptophyllum), and blackberry (Rubus species)
dominant. Tidal oligohaline marsh bounds the east side of the tract. Dominant vegetation of these areas
include smooth cordgrass (Spartina alterni flora). rough cordgrass (S. cynoseroides), cattail (Typha
species), bulrush (Scirpus species), and arrow-head (Sagittaria species). Another wetland area extends
onto the southwestern corner of the site. This area is characterized by various scrub/shrub vegetation at the
head of a wetland draw contiguous with the Brunswick River. In addition, a narrow wetland finger
contiguous with the marsh extends into uplands along the central eastern edge of the property. This area is
predominantly unvegetated and appears to carry ephemeral flow during periods of high site discharge.
Stormwater Certification and a Sediment and Erosion Control Permit has been received and site grading
has been initiated in areas outside of the 75' setback Area of Environmental Concern (AEC). Wetlands
have been physically flagged in the field, and a confirmation of the wetland boundary has been received
from the US Army Corps of Engineers (ACOE) (refer to the signed wetland survey in the enclosed
application).
IV. POTENTIAL ENVIRONMENTAL IMPACTS
The applicant is requesting fill of 0.1 acres of jurisdictional 404 wetlands. The requested fill area is
characterized primarily as an unvegetated stormwater drainage outlet (ranging between 5' to 15' wide). An
old outlet structure (tile drain) at the head of the wetland finger appears to be the primary source of
hydrology. The drainage area is highly degraded with concrete, bricks, and refuse clearly evident (refer to
photographs attached in the application). In light of the historical use of the site, this drainage outlet is
likely a conduit for high nitrogen (N) and phosphorous (P) to the adjacent marsh as evidenced by the
abundance of algae on surface sediments and in microdepressional channels. The edges of this area is
characterized by wax myrtle (Myrica cerifera), but much of the drain itself is unvegetated. From a
functional standpoint, it does not possess any characteristics that contribute or give rise to common wetland
functions. Its low vegetative density and physical condition results in reduced residency times. Therefore,
its capacity for flood attenuation, nutrient filtration/transformation, and groundwater recharge is considered
poor. Its ecological integrity has been compromised by previous site use. The area provides limited (if
any) wildlife habitat nor does it provide any aesthetic, recreational, and educational potential. In fact, the
requested fill will help to remove a source of high N and P to adjacent waters and will allow for stormwater
to be directed into a basin and treated via sediment and nutrient removal.
No other fill activity is requested on the site. The proposed site design represents little if any detrimental
impact to wetland and aquatic resources. Removal of rotting pilings and dockage along the waterfront in
addition to stabilization of an eroding bank on the northeastern corner of the property will have positive
environmental effects. The bank rip-rap will be installed above mean high water and will help prevent
current erosion and sediment loading to the river. The proposed land use is of relatively low impact
compared to other industrial development. Water-related structures do not require dredging of any kind.
Boats will be launched via the travel lift and will be tied at the docks only during brief periods of testing.
There will be an above ground storage tank (AST) located adjacent to the manufacturing facility for fueling
prior to boat launch (the tank will be installed and operated in compliance with all AST standards). In light
of the historical use of the site and the condition of the site immediately prior to KCS ownership, this
project has and will continue to help remedy long-term environmental site issues (i.e. asbestos
contamination, on-site waste/debris, and nutrient loading to adjacent waters).

APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Madame/Sir:
You have our approval, in accordance with the attached conditions, to fill 0.10 acre of vegetated wetlands
in order to construct a boat manufacturing facility at the confluence of the Brunswick and Cape Fear Rivers in
Brunswick County, as described in your application received 10 August 2000. After reviewing your application,
we have determined that this work is covered by General Water Quality Certification Numbers 3274. This
Certification allows you to use your CAMA Permit when it is issued by the Division of Coastal Management. In
addition, you should get any other federal, state or local permits before you go ahead with your project including
(but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application for a new
certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter
and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the
future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For
this approval to be valid, you must follow the conditions listed in the attached certification as well as the additional
condition listed below:
An additional condition is that a final, written stormwater management plan shall be approved by this Office
before the impacts specified in this Certification occur. The stormwater management plan must include plans
and specifications for stormwater management facilities including construction of an extended detention
wetlands designed to remove 85% TSS according to the most recent version of the NC DENR Stormwater Best
Management Practices Manual. Also, before any permanent building is occupied at the subject site, the
facilities, as approved by this Office, shall be constructed and operational, and the stormwater management
plan, as approved by this Office, shall be implemented.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.

Reference your application for a Department of the Army (DA) permit to construct a boat
manufacturing facility with a travel life, pier and floating dock system, four boat slips and rock
riprap in the Brunswick River near Navassa, Brunswick County, North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of general permit No. 198000291. Therefore, you inay commence construction activity
in strict accordance with applicable State authorization and the enclosed plan. Failure to comply
with the State authorization or conditions of the general permit could result in civil and/or
administrative penalties.
Please be advised that the following is a condition of this DA permit:
1. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States.
No claim shall be made against the United States on account of any such removal, relocation, or
alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE, Chief Source
Data Unit, Attention: Sharon Tear N CS261, 1315 E West HWY RM 7316, Silver Spring, MD
20910-3282 at least two weeks prior to beginning work and upon completion of work.
2. No fill material will be placed at any time, including temporarily, in waters or wetlands
outside the footprint of that shown on the permit plans.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified.
