After reviewing your application, we have determined that this work is covered by General Water Quality Certification Numbers 3274. This Certification allows you to use your CAMA Permit when it is issued by the Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. PROJECT SUMMARY: The applicant, Norman Bibeau, proposes to construct a 143' bulkhead, a swimming pool and residence adjacent to the Currituck Sound. Development of the property will include the filling of approximately 4,343 square feet of Section "404" wetlands. Norman Bibeau Field Report Page 2 PROJECT SETTING The applicant's property is in Phase 1, Section 3, of Monteray Shore's Planned Unit Development, more specifically described as being, Lot 188 on Ocean Forrest Court, adjacent to the Currituck Sound, in Corolla, Currituck County. According to the application the lot consists of approximately 9,533 square feet of Section "404" jurisdictional wetlands and 12,948 square feet of high ground for a total lot size of 22,481 square feet. Staff calculations indicate that the total area of wetlands is closer to 10,281 square feet in size. West of the project site is the Currituck Sound and to the east is Ocean Forrest Drive. North of the property is a developed residential lot with a natural undisturbed shoreline, while the developed lot to the south has a bulkheaded shoreline. A small area of rock riprap, approximately 50 square feet in size, extends from the northern corner of the adjacent bulkhead into the applicants property and the Currituck Sound. Currently the applicant's property is vacant and heavily vegetated. High ground vegetation includes. but is not limited to. live oak (Quercus virginica), lobloliv pine (Pines taedu), wax myrtle (Mvrica cerifera). poison ivN (Taxiodendron radicans), and saw brier (Smilax bona-nox). Section "404" Wetland vegetation includes. but is not limited to, red bay (Magnolia virginiana), soft rush (Juncuv effuses), arrow arum (Pehandra virginica) and cinnamon fern (Osmunda cinnamomea). The Section -404" wetlands on the applicant's property extend into the property to the north and transition into a coastal wetland dominated by black needle rush (Juncus roemerianuv). According to the application the average elevation of the site is seven feet above normal water level. However, the amount of wetlands on the property indicate that the elevation noted may be above sea level and not normal water level (NWL). The property has a gentle drop in elevation from Ocean Forrest Drive to the sound. The shoreline along the property is irregularly shaped with a one foot erosion scarp that drops to a narrow sandy beach. Erosion is evident on the applicant's property by the large number of exposed tree roots and fallen trees littering the shoreline. Based on available ariel photographs and staffs familiarity with the location, it is estimated that the erosion rate is approximately two feet per year. The water bottom is sandy. and gently slopes away from the shoreline into the sound, with an average depth of six inches, at a distance of ten feet waterward of NWL. There is little to no submerged aquatic vegetation adjacent to the applicants property and the alignment appears to be landward of a very small amount of water milfoii (less than 1 /4 square foot in area). Currituck Sound is classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Currituck Sound is SC (fish propagation). Additional review indicates that there are no known archeological sites or geological formations associated with the applicant's property. PROJECT DESCRIPTION The applicant, Norman Bibeau, would like to construct a 143' wooden bulkhead a maximum of 10', and an average of approximately 5', waterward of NWL. The total area of shallow water bottom to be filled, according to the application, is 857 square feet and involves 25 cubic yards of fill in Estuarine Waters. Staff field measurements indicate approximately 715 square feet of shallow water bottom will be involved, with an estimated 7 cubic yards of fill in Estuarine Waters). However, approximately 220 cubic yards of additional material will be necessary to backfrll the proposed bulkhead, above and landward of NWL. The Norman Bibeau Field Report Page 3 bulkhead will be in line with, and tie into, an existing bulkhead located to the south (Lot 187) and terminate with a 12' return wall along the northern property line. Approximately 513 square feet of wetlands will be filled in association with the proposed bulkhead. In addition, the applicant proposes to fill approximately 3,564 square feet of Section 404 Wetlands for a swimming pool. Extending from the proposed bulkhead, a 57' wide section of wetlands will be filled at an average distance of 62.5' from the bulkhead, and will held in place by a retaining wall on the north and south sides. Approximately 990 square feet of the fill, swimming pool and pool deck will be located within the 30' buffer (effective August 1, 2000). A third area of wetlands 266 square feet in size will be filled on the north side of the proposed driveway, and will be landward of the Estuarine Shoreline AEC. The total area of Section "404" Wetlands to be filled in association with the project is 4,343 square feet. The final aspect of the project is the construction of a dwelling 51' from the proposed bulkhead alignment. Approximately 1,155 square feet of the dwelling will be within the Estuarine Shoreline Area of Environmental Concern AEC. Impervious surfaces within the Estuarine Shoreline AEC will be approximately 2,958 square feet and will result in 29.5% lot cover within the 75' AEC. High ground disturbance includes approximately 1,500 square feet for the dwelling and 3,117 square feet for the driveway. for a total of 4,617 square feet. ANTICIPATED IMPACTS • Construction of the bulkhead as proposed will result in the loss of approximately 857 square feet of shallow water bottom and Estuarine Water per the application (715 square feet per staff calculations). • Temporary localized turbidity can be expected during the installation of the bulkhead. • The proposed wetland fill will result in the loss of approximately 4,343 square feet of Section "404" Wetlands. • The development will result in approximately 2,958 square feet of impervious surface within the Estuarine Shoreline AEC. • High ground/ upland disturbance within the Estuarine Shoreline AEC will equal approximately 4,617 square feet for the residence. • The project will result in the filling of 990 square feet of Section 404 Wetlands for the construction of a swimming pool and pool deck within the 30' of Currituck Sound, and is not in association with the construction of a bulkhead. Mathis Date: July 26, 2000 PROJECT NARRATIVE Norman Bibeau - Lot 188, Monteray Shores S/D, Corolla Our client is proposing to construct a wooden bulkhead along his shoreline to prevent further shoreline erosion to his Soundfront property on the Currituck Sound in Monteray Shores Subdivision. Mr. Bibeau is also proposing to construct a driveway, parking area and a single family residence with an in-ground swimming pool and decking with a wooden retaining wall (see attached site plan). The site will be prepped with fill material to accommodate site plan efficiency. The proposed three story house will be constructed on monolithic pour and pilings. The base flood elevation is eight feet. The first floor will be constructed at or above the base flood elevation. The wooden bulkhead is proposed at 143 linear feet. two to ten feet waterward of the NWL. Backfill will be trucked in, graded and smoothed behind the bulkhead and retaining wall, using a bulldozer. The size of lot 188 is 22,481 square feet. The proposed driveway and parking area coverage is 3,117 square feet. Total 404 wetland fill proposed is 4,343 square feet. Total proposed impervious area within the AEC is 2,958 square feet (29.5%). Total fill below the NWL will not exceed 25 cubic yards. Although it is likely we are exceeding the annual erosion rate, we are applying for the alignment pursuant to the provisions T15A NCAC.07H.0208(b)(7)(D). I finally got to access the FileMaker Pro program yesterday afternoon and I spent some time looking at what kind of information you require in your reports from our office. I still have some questions about some of the responses that are required to complete the form prior to submission. I hope that we can take a few minutes on Monday to actually run through one so that I can ask you questions as we go step by step through the form. That would certainly be beneficial for me. In the mean time, I just wanted to comment on a few of the CAMA major permit applications for projects at sites that I visited in the past few weeks. 1. NC Seafood Industrial Park Authority. DWQ #00-1054. As far as I could tell, this project would pose very minimal water quality impacts. I would say that it should be permitted. It seems to me that he is trying to develop his lot by building much too close to the water. I would NOT issue a permit for this. His two neighbors have situated their homes further back from the water's edge and there does not appear to be any valid reason for allowing him to build his house closer. This proposed project is not consistant with the intent of the Buffer Rules. I would probably go along with approving his bulkhead proposal, but not the installation of the deck, pool and house footprint. The neighbor to the south does have a bulkhead while the other adjacent property owner does hst. It probably would aid in reducing the potential for erosion of the prop t . CU""-; -(,) P?6 V/a/ob 3. Harold Miller, Revocable Trust, Dare County. 00-1042 I did not have the opportunity to travel down the Hatteras peninsula while I inspected the other northernly sites. Therefore, I have not been to Mr. Miller's property. Based on the report that I was provided, the proposed project for the installation of a 79 foot long bulkhead seems reasonable. Most lots along the sound have similar erosion control devices in place. I look forward to having the opportunity to discuss these projects his you in person next week. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. The bulkhead, swimming pool, and all associated backfill (fill) activities will be located landward of the Coastal Shoreline Area of Environmental Concern (30' Buffer). 2. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters outside of the authorized areas.
