Dear Secretary Trogdon:
On September 23-25, 2019, staff from the North Carolina Department of Environmental Quality
(DEQ) conducted a compliance audit of the North Carolina Department of Transportation
(NCDOT) National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm
Sewer System (MS4) Permit. The audit identified no major deficiencies with the specific
components of the MS4 Permit that were reviewed. For your reference, a copy of the MS4
Program Audit Report issued by DEQ is available through the NCDEQ DWR Laserfiche WebLink.
The current NCDOT MS4 permit expires on September 30, 2020 and a permit renewal application
is required to be submitted on or before April 3, 2020. In accordance with Part IV of the permit,
DEQ policy and this notice, the NCDOT is required to complete the following actions:
(1) Respond in writing within thirty (30) calendar days from the date of receipt of this notice
to acknowledge these requirements and the intent to comply.
(2) Submit a Statewide NPDES MS4 Permit Renewal Application on or before April 3, 2020.
NCDEQ will provide the Statewide Permit Renewal Application Form to NCDOT
Hydraulics Engineering staff via e-mail.
(3) Meet with NCDEQ MS4 Program staff within forty-five (45) days of submitting the
permit renewal application to j ointly review and evaluate current and proposed new permit
conditions.
(4) DEQ will provide NCDOT with a Draft NCDOT NPDES MS4 Permit following the
meeting(s) in Item 3 above. Within one hundred twenty (120) days of receipt of the Draft

NCDOT MS4 Permit, NCDOT shall submit a Draft NCDOT Stormwater Management
Plan (SWMP) which details specific actions, measurable goals, implementation timelines
and annual reporting metrics that demonstrate compliance with the permit requirements.
The submitted Draft NCDOT SWMP must document the compliant stormwater
management program that will be implemented over the full 5-year term of the new permit.
The Draft NCDOT SWMP must correlate in structure and format to the provided Draft
NCDOT NPDES MS4 Permit.
(5) Within thirty (30) days of receiving NCDEQ and public comments on the Draft NCDOT
SWMP, address each comment and submit a Final NCDOT SWMP for concurrent DEQ
approval and final permit issuance. The final DEQ-approved NCDOT SWMP shall
become an enforceable component of the issued NCDOT NPDES MS4 permit.
(6) The current NPDES MS4 permit conditions shall remain in effect until such time as a
new permit is issued.
