This Office is in receipt of a fax copy of plans dated June 12, 2001 for the subject project. Item no. 2 in the previous letter from this
Office dated May 16, 2001 indicated the design criteria that would be acceptable for a level spreader design under the given conditions.
The design provided references a two year discharge or storm. The design also does not meet the 70 to 100 feet of level spreader per 10
cfs conservative design criteria indicated by this Office for a 10 year storm. As such, I have no reason believe that diffuse flow can be
achieved through the entire buffer based on the design provided. Therefore, it is recommended that an alternative design be provided that
would provide 30% total nitrogen removal so that a direct discharge could be provided through the buffer or that detention be provided so
that the velocity of the discharge over the berm be reduced to 0.67 fps in a 10 year storm event.

Dear Mr. Recktenwald:
This Office is in receipt of your plans dated May 10, 2001 for the subject project. More information is necessary for this Office to
complete the review of this project:
1. The plans indicate that clearing for a parallel sewer line is proposed for zone 1.. Mitigation is required for these impacts. Please
provide the square footage of impact in zone 1. Also, please provide a proposed mitigation plan for the impacts.
2. The stormwater from the site appears to be directed to a pond like structure. It is not clear from the plans that diffuse flow will
occur through the buffer even if the flow is spread over the entire lip of the device. This Office recommends that the stormwater
be split to discharged at several locations. Level spreaders should be designed to accommodate 10 cfs (in a 10 year storm) for
every 70 to 100 feet of level spreader if the slopes through the buffer are less than 10%.

Dear Todd:
Please be advised that, due to subsurface conditions, sheet piling will no longer be utilized in
dewatering the area to facilitate the construction of the approved culvert and channel
improvements. Because of subsurface rock, a rip rap coffer dam will be utilized across the
channel.
The temporary dam will be constructed entirely within the footprint of the approved rip rap
apron which the Corps and DWQ have approved and permitted. No disturbance of the channel
and/or waters of the US, other than that already permitted, will occur as a result of the design
change. The completed channel will also remain the same configuration as permitted.
The University is proceeding with the project based on the design change and no change to the
approved amount of channel disturbance.

APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules
Dear Madame/Sir:
You have our approval, in accordance with the conditions below, to impact 140 linear feet of stream channel and
riparian buffer for the purpose of a road crossing as described in your application dated June 27, 2000 (revised November
10. 2000) and site plan revisions dated September 15, 2000. After reviewing your application, we have decided that this
fill is covered by General Water Quality Certification Number 3287. This Certification allows you to use Nationwide
Permit Number 39 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A
NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater. Non-Discharge and Water
Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires
unless otherwise specified in the General Certification.
1. The impacts shall not occur until revised plans have been submitted to and approved in writing by this Office
for the flow spreading device adjacent to Capability Drive. The flow spreading device shall be sized to be 70
feet long (perpendicular to the flow) for every 10 cfs resulting from a 10 year rain event.
2. There shall be no grading conducted on the portion of the site that includes the proposed North Shore
Apartment complex until additional site plans are provided to and receive written approval from this Office for
written approval. The site plans must contain details showing the locations of any proposed buffer impacts and
details that show compliance with the Neuse Buffer Rules in regards to stormwater management.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. This approval shall
expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described
in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.

The Division of Water Quality has reviewed your submittal for a 401 Certification for the subject Neuse
Buffer Approval and 401 Water Quality Certification application. Staff from this Office reviewed the plans
for the stormwater device proposed to provide diffuse flow of the stormwater runoff from Capability Drive
through the Neuse buffer and determined that additional information is necessary to complete the review as
specified below. Also, no plans to provide diffuse flow through the buffer were provided for the apartment
complex. Specifically, the following information must be provided:
1) Can the diffuse flow spreader design for Capability Drive be lengthened to provide diffuse flow of
approximately 70 feet of dispersion (perpendicular to the flow) for every ten cfs of discharge (based on
the peak discharge in resulting from a ten year storm)?
2) Please provide the diffuse flow spreader designs for the proposed apartment complex. Please indicate
the extent of zones 1 and 2 on the site plans of the apartment complex. If diffuse flow cannot be
provided into zone 2 per the specifications requested in item no. 1, please provide an explanation.
This information is needed by DWQ in order for us to decide whether this project is approvable.

Certification and Neuse Buffer Rule approval for the North Shore Residential Development and South
Capability Drive Extension in Wake County. Please provide the following information so that we can
complete our review of your proposal:
1. Please describe how stormwater will be treated onsite, and include construction drawings for your
proposed stormwater management facilities. A wet pond alone will not be adequate to control
stormwater on this site, although a wet or dry pond combined with a level spreader may be
sufficient. The calculations and decision-making process you use to determine the size and the
design of your stormwater facility will be helpful in our review.
Until this information is received, I will request (by copy of this letter) that the Corps of Engineers place
this project on hold. Also, this project will be placed on hold for our processing due to incomplete

The 401 Wetlands Certification Unit has the following comments regarding the subject EA/FONSI
received on 6/21/00.
The subject project will impact riparian buffers protected under the Neuse River Buffer Rules (15A
NCAC 2B .0233). The proposed project will require written authorization from the Division and
will require mitigation under 15A NCAC 2B .0242 if the riparian buffer impacts exceed 150 linear
feet. In addition, concentrated runoff from new ditches or manmade conveyances shall be
converted to diffuse flow before the runoff enters the riparian buffer. Details of the Neuse River

A. PROPOSED PROJECT DESCRIPTION
North Carolina State University intends to construct a two lane curb and gutter roadway
(Capability Drive South Extension) from the existing dead end section of Capability Drive
west of Main Campus Drive and North of Lake Raleigh, to approximately 70 feet west of
North Creek (See Exhibit 3 section H). The proposed roadway will be ± 650 feet long.
Portions of the proposed alignment have been cleared and rough graded in conjunction
with the construction of the initial section of Capability Drive. The proposed roadway
extension will depart from the existing dead end and continue westward along the north
shore of Lake Raleigh, cross North Creek and terminate at the entrance to a future
residential site on the campus. The constructed facility will be 27' to 43' wide and cross
North Creek between Lake Raleigh and the existing stormwater basin in North Creek. The
proposed North Creek crossing includes a bottomless culvert designed to accommodate a
pedestrian greenway. The proposed roadway is being designed to meet the North Carolina
State University Centennial Campus, Phase I, master plan zoning compliance documents.
B. PURPOSE AND NEED FOR PROPOSED PROJECT
The project will provide a travelway for motored vehicles, bicycles and pedestrians. It will
provide access to underdeveloped portions of the campus as well as compliment the
existing vehicular and pedestrian circulation systems and introduce an ingress and egress
corridor for an undeveloped section of Centennial Campus.
C. ALTERNATIVES ANALYSIS
The no action alternative would result in a no build situation. This would represent a
failure of the University to meet its commitments to both the people of North Carolina and
the University's corporate partners. Alternative alignments would not serve the existing
and/or proposed development outlined in the approved Campus Master Plan. Selection of
an alternative alignment would be less supportive of existing development and would not
take advantage of the previously improved alignment. Selection of an alternate alignment
would therefore be less supportive of the existing, planned, and previously approved
alignment.
D. EXISTING ENVIRONMENTAL CHARACTERISTICS OF PROJECTED AREA
(1) Topography
Along the proposed project's alignment the terrain slopes westward from the existing end
of Capability Drive at elevation 303 down to North Creek at elevation 280, crosses the
creek, and then up the western slope to elevation 284 at its proposed terminus. Slopes on
the site range from 0% to 185% with elevations varying from 280 feet to 303 feet MSL.
(2) Soils
Geography, soils and topography
The site is located in the Raleigh Belt of the Piedmont physiographic province.
According to the USDA Soil Survey for Wake County (See exhibit 5, section H) most of
the site falls in the (Wo) Wehadkee series. These soils are typical of the region and present
no constraints to urban development. An exception to this description is an area of cut and
fill material excavated and/or placed on the site during the construction of the initial section
of Capability Drive. Additionally the proposed alignment crosses North Creek and its
limited flood plain. Soils in this area have been classified as the Wehadkee & Bibb soils
according to the Wake County Soils Survey. No water table was encountered in the
vicinity of this project during the prior grading operations. It is not anticipated that off site
borrow will be necessary for the project. However, should it become necessary to import
fill from outside the project area, it will be obtained from areas previously designated for
borrow areas on Centennial Campus. Should it become necessary to dispose of unsuitable
soil material, it will be removed to areas previously,designated for waste soil material on or
off campus. All appropriate permits will be obtained for off site borrow and waste areas if
not already in place.
(3) Land Use
This project will impact approximately 3.0 acres of land located 230 ft. west of the existing
intersection of Capability Drive and Main Campus Drive. It will also impact ± 140 linear
feet of North Creek's Channel and adjacent flood plain, that have previously been disturbed
during the construction of a sanitary sewer line and the existing stormwater basin to the
north. Approximately 0.07 acre of this area have been delineated as 404 jurisdictional area.
The proposed project is outlined in the approved Master Plan for the Centennial Campus
and previous environmental documents, which collectively describe a coherent organization
of land uses within the Centennial Campus. The project is consistent with the carrying
capacity of the natural and physical systems planned for the campus.
Adjacent land uses consist of undeveloped Centennial Campus land to the west, Lake
Raleigh to the south and an existing stormwater basin to the north. Existing Capability
Drive is to the east, which services the existing EGRC building and parking structure to the
northeast of the proposed project.
(4) Wetlands
Approximately 0.07 acre of 404 and 401 jurisdictional waters of the U.S. within the banks
of North Creek will be impacted by the proposed project, a copy of the delineated wetlands
is included in this document (See Exhibit 4 in section H).
(5) Prime and Unique Farmland
The supplement to the 1982 Wake County Soil Survey entitled Important Farmland
indicates no important farmland on this site. Although portions of the property appear to
have been farmed in the past, no farming activity has occurred within recent years.
According to Mr. Milton Cortes of the USDA (See Appendix #1, section J), there are no
unique farmlands in the area. USDA criteria outlines that prime farmland does not include
land already in or committed to urban development or water storage. Prime farmland
`already in' urban development includes all land that has been designated for commercial or
industrial use or residential use that is not intended at the same time to protect farmland in
a 1. Zoning code or ordinance adopted by a state or local unit of government or 2. A
comprehensive land use plan which has expressly been either adopted or reviewed in its
entirety by the unit of local government in whose jurisdiction it is operative within 10 years
preceding the implementation of the project.
(6) Public Lands and Scenic, Recreational, and State Natural Areas
The Centennial Campus property is owned by the State of North Carolina and allocated to
NC State University for management. Neither parkland nor designated or recognized
scenic areas nor any "informal" recreational uses presently exists on the proposed site.
(7) Archaeological and Historic Resources
The survey of Centennial Campus by Thomas H. Hargrove of Archaeological Research
Consultants, Inc. in November 1986 and included in the Environmental Impact Statement
for North Carolina State University Centennial Campus identified no significant discoveries
of archeological or historical value. (See Appendix #2, section J.)
(8) Air Quality
The University is committed to promoting and supporting a multi-modal transportation
system to reduce the number of single occupant vehicles accessing Centennial Campus.
The current Wolfline bus service will serve the Campus, and complement the use of remote
park and ride lots. Bicycle routes and pedestrian trails will also connect the Main Campus
with Centennial Campus to encourage non-motorized movement. Regardless, the
Centennial Campus roadway system has been planned and designed to efficiently move the
anticipated, long-term traffic.
The proposed site is within the City of Raleigh limits Current sources of air emissions in
the area are automobiles and heating boilers, air handling units, and emergency generators
from nearby office buildings, labs, and classrooms. During dry periods dust from adjacent
construction and the unimproved roadway also contribute to particulate matter in the air.
(9) Noise Levels
Current noise levels are minimal since the roadway currently terminates east of North
Creek. Existing noise levels in the vicinity are largely attributable to automobile traffic on
Main Campus Drive, Avent Ferry Road, Capability Drive, the existing section of Varsity
Drive and to nearby building construction on the Centennial Campus projects.
(10) Water Resources (Surface Water and Groundwater)
The proposed project falls within the Lake Raleigh/Walnut Creek Watershed. Lake
Raleigh is now classified as WS-III-NB-NSW and is a valuable natural resource, making it
important as a recreational and visual asset to Centennial Campus. The proposed roadway
and associated slopes drain to North Creek and then to Lake Raleigh, as well as overland
to Lake Raleigh.
Through July 1986, Lake Raleigh was classified as a WS-II water supply for the City of
Raleigh. The lake was reclassified to its current status by the North Carolina Division of
Environmental Management, Water Quality Section. This designation allows for
recreational uses, but still provides protection as a water supply. In September 1996, Lake
Raleigh's dam failed due to the heavy rains associated with Hurricane Fran and the lake
drained. The dam has been repaired and in the near future, the lake is expected to be
refilled. The University is committed to a stormwater management system designed to
prevent reduction of the water quality in Lake Raleigh.
The depth to groundwater on the proposed site is unknown. To date, borings have not
been made and no ground water has been encountered in prior grading within the proposed
construction area. Also, no significant pattern of ground water depths or flows has been
noted in the areas adjacent to the roadway where boring for other projects have been
performed.
The North Creek drainage way is located within the project area. It is classified as B NSW
water. The creek is currently the major drainage channel for and provides stormwater
management for the northern half of the Centennial Campus and a part of an off campus
area. Other surface drainage to the south of the project consists of surface runoff into
Lake Raleigh.
(11) Forest Resources

(12) Shellfish or Fish and Their Habitats
North Creek and Lake Raleigh to the south on the Centennial Campus are the only aquatic
habitat in proximity to the proposed project area. The proposed construction area
encroaches on North Creek but not the future refilled permanent pool of Lake Raleigh.
(13) Wildlife and Natural Vegetation
According to the National Institute for Urban Wildlife's inventory of the terrestrial ecology
for the Environmental Impact Statement for North Carolina State Centennial Campus,
there are no unique habitat or species and no threatened or endangered species present on
the Centennial Campus site. Since the project has been significantly disturbed in
conjunction with prior projects, no observed wildlife habitat exists within the project area
(EGRC, a sanitary sewer line, Phase I of South Capability Drive and the adjacent
stormwater basin). Adjacent areas consist of primarily grasses, scrub understory and mixed
hardwood and pines along the edge of Lake Raleigh. Neither protected species nor
indicators of such species have been found on the site or in North Creek.
E. PREDICTED ENVIRONMENTAL EFFECTS OF PROJECT
(1) Topography

(3) Land Use
Changes in land use resulting from the extension of South Capability Drive will be
consistent with the North Carolina State University Centennial Campus Master Plan, the
Open Space and Recreation Master Plan, the FEIS and previously submitted EA's.
(4) Wetlands
The proposed project will impact 140 linear feet of North Creek's Channel and adjacent
flood plain, which have previously been disturbed in conjunction with the construction of
the North Creek stormwater basin and City of Raleigh sanitary sewer outfall. There are no
adjacent wetlands within the project's proposed limits of construction.
(5) Prime or Unique Agricultural Lands

(8) Air Quality
Capability Drive will be extended at its south end (referred to as South Capability Drive) to
connect to Main Campus Drive. North Carolina Administrative Code title 15A Chapter 2D
requires that a permit be obtained for construction or modification of any highway with an
expected maximum traffic volume of 2,000 vehicles per hour or more within 10 years.
A traffic report prepared for South Capability Drive by Kinley-Horn and Associates, Inc.
(dated June 10, 1998) projected that this road would carry 2,000 vehicles per day at build-
out of north Centennial Campus (including the North Shore Apartments.) Since the
projected traffic is substantially below the level cited in the Code, a permit is not required
for this project.
(9) Noise Levels
Noise levels, which will be generated within and around the proposed roadway, walkway
and greenway systems, will not be objectionable. During the building process, noise levels
normally associated with roadway construction will occur. It is projected that vehicles
utilizing the roadway after its completion will not create significant noise levels.
(10) Water Resources
Groundwater, Surface Waters, Eutrophication of Receiving Waters
Ground water is not expected to be encountered during construction except where it may
exist in the vicinity of the North Creek culvert construction. However, if it is, appropriate
measures, consistent with the FEIS and regulatory constraints will be employed. If ground
water is encountered during construction, measures will be taken to divert it as well as
surface water through or around the construction. Permanent measures will be installed to
assure that neither ground nor surface water is trapped on the project.
The construction of Capability Drive extension with the associated walkways and
greenway will create approximately 0.45 acre of impervious surface. Stormwater runoff
from these areas will be directed to stormwater drainage facilities. These facilities will
consist of subsurface storm drainage culverts, surface curb and gutter, stormwater control
devices and overland flow.
The stormwater from the project will be released and its velocity controlled prior to it
entering the Neuse River buffers adjacent to North Creek and Lake Raleigh. Prior to
construction, a sediment and erosion control permit will be obtained for all areas to be
disturbed during this project. An NPDES permit for the construction will also be obtained,
if necessary, as well as the appropriate Neuse River buffer and 404 approvals.
The direction of surface water runoff will remain as it now is, into North Creek and Lake
Raleigh. There will be no new impervious surface that will not be controlled by surface
flow and diffusion through the vegetated buffers. With this surface flow system in place,
long-term increases in stormwater velocity or quantity from the project area are not
expected, nor will there be any long-term detrimental impacts on stormwater or
groundwater quality. Minimal short-term impacts to surface waters may be seen from land
disturbing activities associated with construction of the project.
Areas subject to the Neuse River Buffer Rules have been identified within this project. The
Neuse River rules apply to the North Creek streambed and 50 feet on both sides of the
stream as measured from top of bank, as well as to the future permanent pool of Lake
Raleigh.
Existing measures have been incorporated into the Centennial Campus to reduce
stormwater velocities, quantities and suspended solids. Additional surface stormwater
velocity control measures are to be incorporated into this project. Based on the currently
available information and the existing and proposed improvements, this project will have no
long-term adverse impact on groundwater, surface waters, or the eutrophication of
receiving waters.

No toxic wastes should be associated with this project. No operations should occur which
would generate such wastes within the Limits of this project.
F. MITIGATIVE MEASURES
(1) Topography
Capability Drive extension has been redesigned to have a lower profile and to be
constructed closer to existing grades. Because of this effort, it will have smaller fill slopes
and less impact on North Creek and Lake Raleigh. The lower profile roadway will also
provide more open and aesthetic views from the north, along North Creek and across Lake
Raleigh.

The University is committed to ensure that development on Centennial Campus is
conducted in accordance with responsible land stewardship, as well as the
recommendations and agreements included in the FEIS, approved Phase I Master Plan and
Zoning Conditions established for the campus. South Capability Drive will be a more
pedestrian friendly roadway and afford a more personable atmosphere between the
residential and institutional uses it connects.
(4) Wetlands
The waters of North Creek and its channel downstream to Lake Raleigh will be protected
by sediment and erosion control facilities during construction and by sediment control and
stormwater BMPs as described in the previous environmental documents for Centennial
Campus. Surface drainage and diffusion of stormwater prior to it entering the Neuse
buffers will protect the stream and lake during construction and after the project is
completed.

Stormwater management will be provided on site via velocity, quantity and quality control
measures. Storm runoff from the completed facility will be collected in curb & gutter, curb
inlets and pipes, then discharged into velocity control devices and level spreaders prior to
entering the Neuse buffer. The diffused runoff would then sheet flow over and through the
Neuse buffer to North Creek's channel and Lake Raleigh. Other measures at the North
Creek channel crossing would include velocity control and a bottomless culvert, which,
when complete, will provide a channel conducive to flows and a habitat similar to the
existing facility. These provisions will mitigate water quality and quantity impacts of the
proposed project.
Sedimentation and Erosion Control
During construction and prior to completion of the project, appropriate sedimentation and
erosion control measures and devices will be installed and maintained to ensure maximum
performance.
The control of sedimentation and erosion will be outlined on plans submitted to and
approved by the NCDENR Division of Land Resources, Land Quality Section and the City
of Raleigh (courtesy review) for this specific project. Methods and devices to meet these
requirements will be installed and maintained to provide proper control. Care will be taken
to contain sediment and keep it from entering North Creek and the unnamed tributary. The
disturbed area will be reseeded and stabilized immediately following the project and
landscaped with trees and shrubs at the appropriate time of year depending on species.

Comments received from the North Carolina Wildlife Resources commission for
EA/FONSI 98-0227 and. subsequent EA's have been reviewed in conjunction with the on
going planning for the Centennial Campus and will be taken into consideration as future
landscape plans and streetscape are developed. Where appropriate, species will be selected
and planted which will afford value to wildlife in the short and long term.
Streetyard and pedestrian ways adjacent to the proposed roadway will include appropriate
plantings to limit views into parking areas and enhance the overall Centennial Campus
Master Plan and City of Raleigh zoning conditions. Landscaping of areas not covered by
the roadway and pedestrian ways will include trees, shrubs, grasses, mulches and/or ground
covers. Selection of plant material will take into consideration species that might provide
sources of food for songbirds and other wildlife species found on the Centennial Campus.
The arch culvert to be installed will be constructed to provide a native type streambed
under the road. This will provide continuity for the channel between North Creek's
stormwater basin and Lake Raleigh. It will also provide a more natural travel path for
wildlife between Lake Raleigh and the storm basin.
The inclusion of a pedestrian path through the culvert will also provide easier access for
wildlife from one side of the new road to the other.

The following information is in response to your request asking for information on farmlands in the
NCSU Centennial Campus, Capability Drive South, Capability Drive Extension Project.
Prime farmland does not include land already in or committed to urban development or water storage.
Other Prime Farmland "already in" urban development includes all land that has been designated for
commercial or industrial use or residential use that is not intended. at the same time to protect farmland
in a ,
1. Zoning code or ordinance adopted by the state or local unit of government or,
2. A comprehensive land use plan which has expressly been either adopted or reviewed in its
entirety by the unit of local government in whose jurisdiction it is operative within 10 years
preceding the implementation of the project or,
3. When funds have already been committed for utilities, water lines, and road replacement and
widening, the land is committed to development and can be exempt from having to make
determination.
If the area in question meets the above criteria, you will NOT need to complete a Farmland Conversion
Impact Rating form (AD1006).
Otherwise please proceed to submit a Farmland Conversion Impact Rating form AD1006. The AD1006
should be originated by the corresponding federal agency who will provide the permits and/or funds,
according to Federal Register 7CFR Part 658, Farmland Protection Policy Act; 1-1-99 Edition. We do
not originate the form AD1006. Any evaluation requires an AD1006 form.

We have alfernate offices where you should send your upcoming AD-1006 for review. You

according to the project location.
Starting on January 2000 all Farmland Conversion Impact Rating (form AD1006 requests
received in our State Office in Raleigh, NC will be forwarded to one of the field Resource Soil
Scientists. We have been. encouraging our clients to use the Resource Soils Scientists offices,
to request the Farmland Conversion Impact Rating (AD 1006) evaluations and help us to
expedite the process. Sometimes a site visit (field visit) is required and, usually, our field Soil
Scientists are closer to the projects location.
