Stevens, Director 1•s `fir D E N R August 31, 2000 DWQ# 00-0938 Craven County Jerry and Ann O' Corr 114 Johnson Point Road New Bern, NC, APPROVAL of 401 Water Quality Certification Dear Mr. and Ms. O'Corr: You have our approval, in accordance with the attached conditions, to place fill material in 0.04 acre of waters in order to construct a stone sill for shoreline stabilization on your property in Craven County, as described in your application dated 19 July 2000. After reviewing your application, we have determined that this work is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner .must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation maybe required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the 'conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. DIRECTOR DATE: July 17, 2'000 Please find attached a modification to the above mentioned CAMA Major Permit. As you may recall, this permit was issued on March 22, 2000, as a blanket authorization to allow for the installation of "experimental" shoreline stabilization projects. The intent is to document the effectiveness of these methods over the traditional vertical bulkhead. A brief description of the proposals and site characteristics follow: 1) Jerry and Anne O'Corr 114 Johnson Point Rd. New Bern, NC SITE CHARACTERISTICS: Water Quality - SB sw NSW Shellfish - No Resource PNA - No Land Use Plan - Developed, Conservation within AEC This is a residential site in the Johnson Point area of south New Bern. The property has a steep back yard, periodically ponding in the lower areas, evidently from stormwater and groundwater seepage. Within this area, there are scattered federal wetland species, mixed within a predominance of lawn vegetation. Bald Cypress grows along the river shoreline. There is a rock revetment currently, 20'- 30' landward of the normal water contour. There are two rock groins existing as well, extending 10'- 20' waterward of the normal water contour. The Neuse River shoreline in the vicinity of this project site is very sandy. This structure is different than the other proposed NCCF sills in that it will only be sloped on the waterward side. The landward side of the structure will be somewhat perpendicular to the base, supporting and supported by the fill behind the sill. This was a change made to the proposal by the property owner, to minimize the cost of the project. The sill will begin on the north side of the property, straddling the normal water line, and continue for 126' in this location. Between the two existing groins, for the last 50' of structure, the sill will continue in somewhat the same alignment, but the water line cuts in such that the sill's location will extend as much as 15' waterward of this contour. There is a 5' "drop down" area 75' into the proposed structure, to allow for water circulation. In order to stabilize the shoreline with vegetation, sand and topsoil will be used to fill the area landward of the sill, and suitable wetland and upland species will be planted. POTENTIAL IMPACTS: Direct impacts will be from the loss of bottom area in the amount of approximately 1408 square feet of rock, another 250 square feet below the normal high water line of sandy fill, and another 4400 square feet of sandy beach subject only to irregular flooding. Potentially, there could be turbidity during the construction phase, as well as during the period between planting and such time as the vegetation has a stabilizing effect on the sediment. ******* Please see the field report dated December 23, 1999, associated with permit #42-00, for additional information. Included in that report were standard conditions to be included with all 30 of these proposals.
