CERTIFICATE and MINOR VARIANCE [15A NCAC 2B.0259(9)(b)] with ADDITIONAL
CONDITIONS
Dear Mr. Thomas,
You have our approval, in accordance with the conditions listed below, to impact ± 2,020 ft' of Zone
2 of the protected riparian buffers for the purpose of constructing the proposed road, Lucas Street
Redevelopment Project. This letter shall act as your Minor Variance approval as described within 15A NC AC
213 .0259(9)(b) and Authorization Certificate. In addition, you should get any other required federal. state or
iocal permits before you proceed with your project including (but not limited to) 404/401 Wetlands
Certification and Sediment and Erosion Control Permits.
This approval is only valid for the purpose and design that you described in revisions dated 11/3/00
to the Minor Variance Request dated 10/4/00 except as modified below. If you change your project, you must
notify us and you may be required to send us a new request for approval. If the property is sold, the new
owner must be given a copy of this approval and is thereby responsible for complying with'all conditions. For
this approval to be valid, you trust follow the conditions listed below.
No impacts shall occur to Zone 1 of the protected riparian buffers. This office recommends
that tree protection fencing be placed along the boundary of Zone 1 near the construction
area to ensure that no impacts to Zone 1 occur.
Diffuse Flow of all stormwater run-off must be provided at non-erosive velocities prior to
entering all retained portions of the protected stream buffers as identified within 15A NCAC
2B .0259(5). Any additional stormwater located on the remainder of the property shall be
directed to sheet-flow at non-erosive velocities prior to entering the protected riparian
buffers. No new ditching or piping of stormwater through the protected buffers is allowed.

3. Riparian Buffer Mitigation must be provided per 15A NCAC 2B .0260 prior to construction
as a condition of this Minor Variance and as required under 15A NCAC 2B .0260(6) for
road impacts other than perpendicular crossinss. This mitigation will require a ratio of 1.5:1
for impacts to Zone 2. Therefore, the required area of mitigation will be ± 3,030 ft`. One
option to provide this mitigation is to make a payment into the Riparian Buffer Restoration
Fund at a cost of 50.96/ft2.
If you decide to choose this option in accordance with 15A NCAC 2B .0260(7).
this contribution will satisfy our compensatory mitigation requirements under 15A NCAC
2B .0250(10). Until the Wetland Restoration Program receives and clears your check (made
payable to: DENR - Wetlands Restoration Program), buffer impacts shall not occur. Mr.
Ron Ferrell should be contacted at (919)733-5208 if you have any questions concerning the
Wetland Restoration Program. You have one month from the date of this Certification to
make this payment. For accounting purposes, this Certification authorizes payment into
the Riparian Buffer Restoration Fund to compensate for 3,030 ftZ of required riparian
buffer, mitigation for impacts to 2,020 ft2 of Zone 2 of the protected riparian buffers:
03-03-02 river and subbasin.
If you do not accept any of the conditions of this certification, you may ask for and adjudicator
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing. send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes.to the Office of
Administrative Hearings. PO Box 27447, Raleigh. N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River Riparian
Buffer Protection Rules [ 15A NCAC 2B .0233(9)(b)]. Please call Bob Zarzecki at 919-733-9726 if you have

Dear Mr. Zarzecki:
Per our conversation today, November 2, 2000, the fill slope for the proposed
roadway has been increased from 4:1 to 3:1. This modification will insure that
land is not disturb d_?n 1. I have included the revised drawing and the
storm water calculation for the level spreader. A minor variance request was
submitted October 4, 2000 due to storm water discharge from the proposed
road into Zone 2. This impact could not be avoided and the total Zone 2
impact is 2020 square feet.
The topography is flat in this region, and it is impossible to place the storm
water outlet outside of the buffer zone. Steve Mitchell and I discussed this
storm water outlet within buffer zone and deduced that a minor variance would
be required.
We appreciate DWQ's technical assistance on this project. Please review these
plans with revisions at your earliest convenience and if you have any
questions, or require additional information, please do not hesitate to call me.

Please find enclosed seven(7) copies of the "Variance Request Form- for Mnor
Variances". In your letter dated August 11, 2000 the Division of Water Quality has
placed this project (DWQ Project No. 00-0856) on hold until design revisions are
made. I have worked closely with the Division of Water Quality to minimize buffer
zone impacts. The topography is very flat in this region and it is impossible to place
the storm water outlet outside of the buffer zone. Steve Mitchell and myself
discussed this storm water outlet within buffer zone and deduced that a minor
variance would be required.
I just want to reiterate this project's purpose: to upgrade public facilities (paved
road, water and sewer services) to a small, low income, rural community with
federal monies. Currently the residents of this neighborhood are on wells and septic
tanks. Most houses do not meet the current building code for well and septic tank
11
separation distances. Wellsepiic` tank separation.` distances not up to code in
conjunction with high water tables makes this project a serious public health issue.

The City of Rocky Mount has acquired a grant from the Federal Housing Administration
to upgrade public facilities to a small, low income, rural community. The following
services will be provided: a paved road (27' from back of curb to back of curb), public
water for domestic use and fire protection, and sanitary sewer. Currently, the residents
of this neighborhood are on wells and septic tanks. Most houses do not meet the current
building code for well and septic tank separation distances. This fact makes this project
a serious public health issue. After the Owner (City of Rocky Mount) and the Engineers
(Peirson & Whitman) accept this work, all septic tanks and some of the wells will be
abandoned per State code.
We have submitted this project to the Division of Land Quality, and they have rejected
the plan due to the Tar-Pamlico riparian buffer rules. We have worked closely with
Steve Mitchell, Todd St. John and Bob Zarzecki to minimize impact to the riparian
buffer. We have changed the design to incorporate all of DWQ's suggestions which are;
move the proposed road, move the proposed sanitary sewer into the proposed road,
change the concentrated storm water flow into sheet flow and add some trees on the
stream bank.
Please find enclosed seven (7) copies of the Pre-Construction Notification Application,
review these plans at your earliest convenience, and send us a copy of your approval
letter for our files. If you have any questions, or require additional information, please

Dear Mr. Raper:
On June 27, 2000, the NC Division of Water Quality (DWQ) received your application for a 401 Water Quality
Certification and Neuse Buffer Rule Approval to impact streams and wetlands in order to construct the Lucas Street
Redevelopment Project in Nash County. In accordance with 15A NCAC 2H.0506, a thorough inspection of the site has
been conducted by staff of the DWQ Raleigh Regional Office. Mr. Steve Mitchell of the DWQ Raleigh Regional Office
has informed us that the plan revisions he requested have not been fully incorporated into the design of this project; rather,
the plans still show stormwater outlets within the buffer. Based on this review, we have determined that significant uses
would be removed or degraded by this project. Insufficient evidence is provided in your application to conclude that your
project must be built as planned in buffers associated with Stony Creek. Therefore, unless the requested modifications of
the proposal are made, we will move toward denial of the 401 Certification as required in 15A NCAC 2H.0507(e).
Until all the requested modifications are.made on the redevelopment plan, I will request (by copy of this letter) that
the Corps of Engineers place this project on hold. Also, this project will be placed on hold for our processing due to
incomplete information (15A NCAC 2H.0507(h)).
