PROJECT SUMAIARY: The applicant is requesting to replace existing shoreline stabilization around an existing marina basin, fill the upper end of the basin, and develop the surrounding high ground. Marsh Harbour Resort Page 2 9. PROJECT DESCRIPTION The Marsh Harbour Resort property is located on Beach Drive off of Highway 179 in the town of Calabash in Brunswick County. The property abuts the Calabash River and lies adjacent to the North Carolina/South Carolina state line. Existing development consists of a golf course, clubhouse, paved road, dirt road, 3 townhouse buildings, swimming pool, tennis courts, management office, an upland marina basin, dock master's office, associated parking lots and a bath house. The shoreline along the basin is stabilized with rip-rap and bulkhead walls. There are existing piers and docks within the marina basin providing boating access. This 212 acre tract of land is currently vegetated with scrub pine trees, woody shrubs, grasses and weeds. The existing elevations on the tract range from 10' to 50'. Much earth work will be required during the development of the property. The Resort is being developed through an existing CAMA Major Permit, #11-97. This project or property has a long history with various owners and varied development plans. A Major Permit, #74-82, was issued on June 23, 1982 to Marsh Harbour Yacht and Golf Links, Inc. This permit was for coquina mining and marina development. The permit was renewed and modified through 1988. The property was sold and the permit transferred to Charles Kronenwetter, expiring on December 31, 1990. In 1996, the property was owned by Odell Williamson. Mr. Williamson applied for a permit for development of the upland property and maintenance dredging of the existing marina basin. Major Permit #11-97 was issued on June 13, 1997, expiring on December 31, 2000. The existing permit was transferred to the present property owner,'Marsh Harbour Resort, L.L.C., on October 5, 1999. The existing permit is set to expire on December 31, 2000. . Current owner(s) are now requesting further modification and renewal of the existing permit. The applicant is requesting permit authorization for the construction of a seven-story, 1200-room, hotel and convention center with swimming pools and associated 73' tall parking deck, four 75' tall, mid-rise condominiums (66 units), 80 townhomes (35' tall), 200 marina condominiums (45' tall buildings), a clubhouse, a shop, and a restaurant. Also, .68 acres of the upper end of the existing upland basin is to be filled and bulkheaded providing room for development of four of the condominium buildings. Maintenance or replacement of the existing rip-rap and bulkhead is also being requested. Paved access roads and parking lots are also proposed. Nine storm water infiltration ponds will be constructed to collect the first 1 '/z" of run off. A 10'-wide wooden boardwalk is proposed all the way around the existing marina basin. The boardwalk and some of the proposed buildings do not meet the proposed 30' buffer rules slated to go into effect in August, 2000. The engineer for the project has calculated an impervious surface area of 27.5 % within the 75' estuarine shoreline area of environmental concern. Also noted is that 100 % of the runoff from the impervious area will be captured in an infiltration basin or proposed storm water pond. The supporting calculation is submitted as part of the application package. The existing shoreline around the marina basin is stabilized by bulkheads and rip-rap. Some of the structures need to be repaired or replaced. The applicant is proposing to replace them as necessary in the same alignment as the existing structures. The application indicates 1415 linear feet of existing bulkhead to be repaired or replaced and 4350 linear feet of rip-rap rock to be replaced with a bulkhead wall. Marsh Harbour Resort Page 3 The current permit allows for maintenance dredging within the marina basin and entrance channel. Also, the current permit authorizes a total of 257 boat slips; approximately 120 slips are existing. The applicant wishes to keep these prior permit authorizations active as a part of this submittal. More information pertaining to potential spoil disposal area(s) will be required prior to the dredging work commencing. At the time of the last permit request, 1997, the Town of Calabash had a 35-foot height limitation on proposed structures. However, that height restriction has since been repealed. That is to be verified by supporting data that will be reviewed prior to issuance of any modification of the permit. The waters of Calabash Creek are classified as SA by the Division of Water Quality. The waters are closed to the taking of shellfish as determined by Shellfish Sanitation. The area is not a primary nursery area (PNA) as could be designated by the Division of Marine Fisheries. ANTICIPATED EMPACTS: If this project is authorized, it would result in the filling of .68 acres of public trust, estuarine waters within an upland marina basin. Temporary turbidity would likely result from bull-head replacement, shoreline stabilization work and maintenance dredging. Approximately 66 acres of land would be disturbed for the project. Sediment controls during development would be necessary to prevent sediment from the upland grading/land disturbance from reaching the open waters. Proposed development would result in massive increase of impervious surfaces over the tract with 27.5 % impervious with the 75' area of environmental concern. If the buildings and associated development are allowed within close proximity to the bulkhead, it will prevent future maintenance and replacement of the bulkhead from the landward side of the wall. The existing Marsh Harbour Marina and Townhouse Complex is located at 10155 Beach Drive SW, adjacent to Calabash Creek, North Carolina, in Brunswick County. The facility was originally permitted in 1982, State Permit #74-82, for a combination of coquina mining and marina development project. The property was sold and the permit was transferred to Charles Kronenwetter in 1988 and allowed to expire in 1991. The property reverted back to the original owner and a new permit was obtained June 13, 1997. The property was transferred to the current applicant in July 1999 and the existing permit was transferred to the current applicant on October 5, 1999. The majority of the 212-acre project site is relatively undeveloped. The site is vegetated by scrub pine, pampas grass, coastal bermuda grass, landscaped areas and a maintained golf course. Townhouses are located near the entrance to the development, off of Highway 179, in the northwest corner of the property as well as a management/office complex, swimming pool, tennis courts, and associated parking lots. A dirt/marl road provides access to the dock master's building, fuel pumps, sewage pump out and existing 16.9 acre marina which are located in the northeast portion of the property. An eighteen- hole golf course, Marsh Harbour, associated clubhouse and paved access road from Highway 179 exist on the southern/central portions of the property. The applicant is requesting permit authorization for the construction of a seven story, 1200 room hotel and convention center with swimming pools and associated parking deck, four Mid-rise condominiums, twenty condominiums, a clubhouse, a shop, and restaurant. Additionally, 0.68-acres of the existing marina (which was created by excavation of upland) will be filled (coastal waters with no associated wetland/marsh) for development of four of the condominium units. Maintenance/repair and/or replacement of the existing marina bulkhead and riprap area is also being requested. Paved access roads and associated parking areas will also be constructed.
