After reviewing your application, we have determined that this work is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. PROJECT SUMMARY: The applicant proposes residential construction, parking areas, basin excavation and marina expansion. Pirates Cove Major Modification Field Investigation Report Page Two The development site is a 31h acre area located within Pirates Cove subdivision which is located adjacent to the Manteo Causeway (US 64/264) and on the north west side of the Washington Baum Bridge, Roanoke Island, Dare County and adjacent to the existing marina entrance channel and located along the north side of the shoreline. The eastern portion of the property lies adjacent to the Roanoke Sound. The site is mostly flat, with an elevation of approximately 4 ft. above normal water level (NWL). The soils are sandy with a mixture of shell and the site is vegetated with yard grasses and wax myrtle. The shoreline along the canal has a broken Coastal Wetland fringe that varies in width from 0 ft. to 15 ft. and is vegetated with Juncos roemerianur, Spanina aftento7ora and Dimichlis spicata. The area of the Coastal Wetlands is approximately 900 sq. ft. and a majority of this area is covered by an existing 8 ft. wide and 440 ft. long dock that parallels the entrance channel. Landward of the Coastal Wetlands and at higher elevation is an area of Section 404 wetlands that is approximately 1700 sq. ft. in size. Approximately 240 ft. of the channel shoreline is stabilized by stone riprap. The total length of the channel shoreline is approximately 800 ft. The waters of Roanoke Sound are classified a'; 91kby;Ehe Division of Environmental Management and are closed to shellfishing in this area. Development Pro?sal The applicant proposes to excavate a 650 ft. long, 50 ft. wide and -9 ft. below NWL boat basin along the north side of the marina channel. The applicant estimates that approximately 15,000 cu yds. of fine sand and shell material will be excavated and placed in two spoil handling areas to be constructed at the site. After the spoil material has de-watered, the applicant proposes to use the material as fill for the project. The existing grade at the development site will be elevated approximately 3 ft. The applicant proposes to construct 760 ft. of bulkhead along the shoreline of the new basin to confine the fill material and to construct a 10 ft. wide ground dock adjacent to the proposed bulkhead. Thirteen 4 ft. wide and 12 ft. long finger piers extending from the dock and 66 slip pilings are proposed for the new basin to create 25 slips 55 ft. x 23 ft. and two slips 55 ft. x 25 ft. At the east end of the proposed basin, the applicant proposes to construct a 30 ft. by 20 ft. riprap section to prevent erosion from boat wake in that area. During the excavation of the basin the old shoreline riprap will be removed. The applicant proposes upland development that includes one 12 unit condominium building with parking areas, two townhouse structures with four single family units, two townhouse structures with three single family units and five single family detached units. The proposed condominium structure will be located along the existing marina basin side of the development site and will have two walkways to the existing marina dock. The townhouse units will be located along the proposed basin shoreline of the development site and each will have a deck with a walkway to the proposed dock. The five single family detached houses will be constructed along the eastern side of the development site, adjacent to the Roanoke Sound. The applicant indicates that a 40 room Inn and 84 garden condominium units were previously permitted for this area. The proposed boat basin will result in the excavation of approximately 32,500 sq. ft. of high ground area and approximately 1700 sq. ft. of Section 404 wetlands located in the Estuarine Shoreline Area of Environmental Concern (AEC). The shoreline fringe of Coastal Wetlands AEC, approximately 900 sq. ft. in size, as well as an area of the existing marina channel located adjacent to the shore, approximately 6500 sq. ft. in size of Public Trust Area and Estuarine Waters will be excavated to achieve the desired water depth of -9 ft. MLW. Approximately 15,000 cu yds. of material will be excavated and removed to the two spoil handling sites for dewatering. Approximately 90% of the proposed excavation will occur below the normal water level. Approximately 425 ft. of the existing 8 ft. wide dock along the shoreline will be removed causing the loss of 16 permitted boat slips. The proposed construction of the 27 slip marina expansion including the bulkhead, ground dock, finger piers and pilings will result in an increase of 11 slips for a total marina capacity of 199 slips. The proposed riprap structure will result in approximately 100 cu yds. of riprap material being placed below NWL. All of the proposed townhouse structures will have decks fronting the proposed basin that will be within 30 ft. of the proposed bulkhead and NWL. Four of the proposed single family structures located along the Roanoke Sound will have decks within 30 ft.. of NWL. The proposed percentage of impervious coverage within the Estuarine Shoreline AEC is 29.47% or 27.737 sq. ft. It is anticipated that the entire 144,921 sq. ft. site will be disturbed by either site fill, construction or basin excavation.
