Dear Mr. Miller:
Reference your application for a Department of the Army permit to modify an existing
boathouse and complete maintenance dredging of the boathouse basin and access channel adjacent
to Motts Channel in Wrightsville Beach, New Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of general permit No. 198000291. Therefore, you may commence construction activity
in strict accordance with applicable State authorization and the enclosed plan. Failure to comply
with the State authorization or conditions of the general permit could result in civil and/or
administrative penalties.
Please be advised that the following is a condition of your DA permit:
The applicant will comply with the attached list of United States Coast Guard regulations.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified.

On August 5, 1996, we renewed general permit No. 198000291 (copy enclosed), which
provides Federal authorization for construction activities that receive authorization from the State of
North Carolina.
A review of your application received May 30, 2000, for Department of the Army
authorization to modify an existing boathouse and complete maintenance dredging of the boathouse
basin and access channel adjacent to Motts Channel in Wrightsville Beach, New Hanover County,
North Carolina, indicates it to be a candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application will be accomplished by the North
Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished
to the State.
If your application must be withdrawn from this general permit process for any reason, you will
be informed regarding its further management. If there are no unresolved differences in State-Federal
positions or policies, the final action taken on your application by the State will result in your receiving
written notice from us that your application is consistent with the general permit and you may
commence your activity. Only after receiving such confirmation should you begin work.

APPROVAL of 401 Water Quality Certification
Dear Mr. Miller:
You have our approval, in accordance with the attached conditions, to dredge 0.04 acre of non-vegetated
wetlands in order to conduct maintenance dredging and modify the boathouse on your property in New Hanover
County, as you described in your application dated 2 June 2000. After reviewing your application, we have
determined that this work is covered by General Water Quality Certification Number 3274. This Certification
allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not limited
to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application for a new certification. If
the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby
responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed
one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). For this approval to
be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask
for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.

8. PROJECT SUMMARY: The applicant proposes to renovate and modify his existing boathouse,
and complete maintenance dredging within the boathouse basin and access channel.

9. PROJECT DESCRIPTION:
The project site is located at 20 Shore Drive, adjacent to Motts Channel, in Wrightsville Beach,
in New Hanover County. The lot is 98 feet wide and approximately 94 feet in depth from the
Shore Drive right-of-way. The lot is now vacant, as the applicant had the existing house
demolished and removed. He is currently in the process of building a new residence on the lot.
The property averages approximately 6.5 feet above mean sea level. There is an existing bulkhead
along the property's shoreline, and an existing boathouse. The boathouse is 57 feet long and 31
feet wide, with half walls, from the deck up, around the majority of its perimeter. It is accessed
by an elevated walkway (34' X 5') and has two open deck areas, one (12' X 8') on its landward
side , the other (4.5' X 8') on its waterward side. The interior of the boathouse consists of a U-
shaped deck and an access ramp to a single floating dock (16' X 10') located outside of the
boathouse footprint, in open water on the structure's northwest side. There is an existing
breakwater approximately three (3) feet waterward of the boathouse on its channel side
(southeast). There are also old timber and asbestos sheathing bulkheads protecting the opposite
side and south end of the existing boathouse. They are in a state of significant disrepair, however,
over the years, they have trapped and retained sufficient sediments to support a dense stand of
Smooth Cordgrass (Spartina altemiflora) between the boathouse and the highground.
The Wrightsville Beach Land Use Plan classifies Motts Channel as Conservation, and the adjacent
highground in the project area as Developed. The waters of Motts Channel, which are included
in the Wrightsville Recreational Area, are classified SB# by the Division of Water Quality. They
are not designated as a Primary Nursery Area by the N. C. Division of Marine Fisheries and they
are CLOSED to the harvest of shellfish.
The applicant is proposing to renovate and modify the existing boathouse. The existing floating
dock and walkway would be removed, as well as, a portion of the decking within the boathouse.
The applicant would install a new floating dock, 40 feet long by 6 feet wide, in the center of the
boathouse's slip. The new dock would extend 20 feet into open water on the northwest side of the
boathouse. A new access walkway (42' X 6') would be constructed from the highground to the
southeast corner of the existing structure and interior decking would be installed to the redesigned
dimensions. A new open deck, 38 feet long and 10 feet wide is proposed on the waterward side
(southwest). The applicant also proposes to rebuild the existing breakwater and boathouse
perimeter bulkheads. The new sheathing on the breakwater would be spaced with a one (1) inch
gap between each board. Pilings and whalers would be replaced as needed. The perimeter
bulkheads would be replaced just waterward of the existing deteriorated walls. Once the proposed
renovations are complete, the applicant wishes to complete maintenance excavation within the
boathouse and access channel to deep water. The dimensions of the dredging would include a 30
ft. X 30 ft. X -5 ft. area inside the boathouse and a 30 ft. X 30 ft. X -6 ft. corridor to reach the
-6 ft. water depth at low tide. The material would be dredged by barge mounted excavator, placed
onto the barge and transported to the highground to be hauled away after drying.
10. ANTICIPATED EMPACTS:
The proposed pr ject would result its the incorporation of an additional 380 square feet of
estuarine waters and public trust area, over the current footprint of the existing boathouse. The
proposed maintenance excavation would result in the disturbance of 1,800 square feet of shallow
bottom. The project would create approximately 366 cubic yards of spoils materials to be trucked

offsite. There would be increased turbidity levels during project activity, however, if timed to avoid
periods of peak biological activity, no long-term adverse impacts are anticipated. The project would
promote continued safe use of the existing boathouse facility by its new owner.

Miller Boathouse Renovation
The scope of construction of this project will consist of the removal and
replacement of the frn inriation piling using treated CCA timber piling. The pilings
will be jetted to an acceptable bearing depth and will be capable of supporting
the boathouse deck, walkways, and existing roof structure. The old piling will be
discarded off site. The existing floating dock will be removed and a portion of
the inboard decking surrounding the boat lift area will be removed. A new down
ramp with seperate platform and two floating dock assemblies will be installed.
A boat lift will be installed in the outboard floating dock area. The existing
outboard timber bulkhead will be renovat--d by replacing old unsatisfactory piles
and bulkhead boards. The outboard bulkhead will be braced as needed to
become functional. A. sundeck will be reconstructed over the existing outboard
timber bulkhead.
