APPROVAL of 401 Water Quality Certification
Dear Mr. Gibson:
You have ?o> ai ova, in accordance with the attached conditions, to place fill in 0.26 acre of
wetlands in orderyt&e&*ete the the Hanes Mill Landfill Expansion Project in Forsyth County, as you
described in your application received by the Division of Water Quality on June 5, 2000. After reviewing
your application, we have determined that this fill is covered by General Water Quality Certification
Number 3108. This Certification allows you to use Nationwide Permit Number 26 when it is issued by
the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application for a new
certification. If the property is sold, the new owner must be given a copy of the Certification and approval
letter and is thereby responsible for complying with all conditions. If total wetland fills for this project
(now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification and the conditions listed below.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.

Dear Mr. Dorney
HDR Engineering, Inc. of the Carolinas (HDR), on behalf of the City of Winston-Salem (City), is hereby
submitting a Pre-Construction Notification Application (PCN) for the Hanes Mill Landfill Expansion
Project (Project). Though wetland impacts from the Project will be less than 1/3 acre, HDR is submitting
this PCN under the NWP 26 in order to establish documentary evidence of regulatory compliance.
Construction of the proposed landfill access road and resulting wetland impacts (0.26 acres or less) will
occur within one year after the expiration of NWP 26 on June 7, 2000. Since proposed wetland impacts
are under the 1/3 acre minimum threshold, a wetland mitigation plan has not been created. Appropriate
regulatory agencies were contacted and surveys were conducted in regard to cultural resources and
protected species. Included with the PCN are copies of the wetland delineation forms completed during
our survey of the site. Subsequently, a Stormwater Management Plan will be prepared in accordance with
North Carolina Solid Waste Management and Land Quality regulations and will be submitted as part of
the Construction Permit Application (Solid Waste Management) and Erosion Control (Land Quality).
Enclosed is the PCN, supporting maps, and documents. Regarding our conversation on May 18, 2000, I
have enclosed a check for $200.00 made out to North Carolina Division of Water Quality for the required
PCN fee.

Quality's request for additional information letter dated June 23, 2000, regarding the discharge of
fill material into approximately 0.26 acres of wetland for. the Hanes Mill Road Landfill
Expansion located in Forsyth County, North Carolina. As per our telephone conversation
yesterday, enclosed is a revised Figure 1 depicting the proposed area for construction. It has
been revised to clarify that the proposed grades for fill construction are outside the limits of
Grassy Creek. Please replace the previous Figure 1 as part of the Pre-Construction Notification
Application submitted by HDR June 2, 2000, on behalf of the City of Winston-Salem.

The Division of Water Quality has reviewed your plans for the discharge of fill material into
approximately 0.26 acres of wetland in Forsyth County for the purpose of constructing a landfill berm
and access road. Insufficient evidence is present in our files to conclude that your project must be built
as planned in waters and/or wetlands in accordance with, 15A NCAC 2H .0506. Therefore, unless
modifications of the proposal are made as descc," . W „i have to move toward denial of your
401 Certification as required by I5A NCAC 2H.0507(e) and will place this project on hold as
incomplete until we receive this additional information. We are requesting (by copy of this letter) that
the U. S. Army Corps of Engineers place your project on administrative hold.
In review of your application and attached site plans, we are unable to discern the extent of
grading, back-fill and road placement. It appears that stream impact to Grassy Creek will occur due to
the fill slope. If stream impacts are proposed, please include the linear footage of those impacts- Please
supply a more detailed site plan, with existing and proposed contours clearly labeled.
Please respond within three weeks of the date of this letter by sending one copy of this
information to me and one copy to John R. Dorney, 4401 Reedy Creek Road, Raleigh, NC 27607.
If we do not hear from you in three weeks, we will assume that you no longer want to pursue this
project and we will consider the project as withdrawn. If you have any questions regarding this matter,
please contact Mrs. Jennifer Frye or myself at (336) 7714600.
