Box 8 Harkers Island, NC, 28531 APPROVAL of 401 Water Quality Certification Dear Ms. Hall and Mr. Davis: You have our approval, in accordance with the attached conditions, to place fill in 0.004 acre of shallow bottom in order to construct a boat ramp, pier and four boat slips on your property in Carteret County, as you described in your application dated 2 June 2000. After reviewing your application, we have determined that this work is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment;and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: Applicants wish to use their two lots jointly to provide. a boat ramp and four slip pier for family use. FIELD INVESTIGATION REPORT: .-Leona Willis Hall and H. Clark Davis Page 2 9. NARRATIVE DESCRIPTION: The applicant's own Lots 6 and 7, Island Road, in Harker's Island. These vacant lots are each 23.5' wide and 50' deep, ranging from +3' to +8' msl. The 47' of water frontage is on Back Sound, a high energy system, with a resultant sandy estuarine beach. There are beds of submerged aquatic vegetation in the vicinity, but little evidenced directly within the path of the proposed development. Approximately one half of the shoreline has rock rip rap above the normal high water line. A deck exists on the property, also above the normal high water contour. Back Sound is not designated a Primary Nursery Area; the waters are classified SA-ORW, and are open to the taking of shellfish for consumption. The Carteret County Land Use Plan classifies this area of Harker's Island as Limited Transition, with all AEC's classified as Conservation. Back Sound is almost 2.5 miles wide at the project site. The applicants have jointly applied to construct a small boating facility for family use on the two lots. On the western lot the proposal is for a 34' x 10' concrete boat ramp, extending 16' above and 18' below the normal high water contour, and continuing landward with a marl driveway. The ramp would terminate in ±6" nlw. To the east of the ramp a pier is proposed, with mooring for four vessels. The proposed pier is 240' in length, and 6' wide, extending ±222' from the nhw contour. At the end of the structure, and around the proposed slips, the water depth is approximately -2' nlw. At the end of the pier there is a 10' x 20' T-head proposed, with three temporary tie pilings approximately 30' waterward of the dock. This represents a total extension into the body of water of ±262'. About midway along the pier, the applicant proposes 4 permanent slips. The landward 2 (on either side of the pier) are defined by two mooring pilings each, forming 10' x 20' slips. The next 2 are 10' x 25' uncovered boat lifts. There are waivers on file from the property owners on either side of the proposed pier, with regard to the riparian corridor setback. The project is intended to serve the boating needs of two families. 10. ANTICIPATED IMPACTS: As proposed, the facility will cause the filling of 160 square feet of high ground for the ramp, and another 590 square feet within the estuarine shoreline for the driveway. The pier will be elevated over approximately 108 square feet of high ground. . The pier and T-head will shade approximately 1532 square feet of shallow bottom area, with the mooring facilities incorporating another 1788 square feet of public trust area. The ramp will cause approximately 180 square feet of sandy bottom area to be filled. While the applicants are aware of the limited tidal use of the ramp, there can be some expected use at marginal tides, and resultant kicking.
