APPROVAL of 401 Water Quality Certification and Neuse Buffer Rules

Dear Sirs:
You have our approval, in accordance with the attached conditions, to impact 80 feet of stream channel and
associated riparian buffer in Wake County for the purpose of road crossing construction as you described in your
application received by the Division of Water Quality on May 26, 2000. After reviewing, your application, we have
determined that this action is covered by General Water Quality Certification Number 3103. This Certification allows you
to use Nationwide Permit Number 14 when issued by the U.S. Army Corps of Engineers. This approval is also valid for the
Neuse River Buffer Rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before
you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water
Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and yoµ may be required to send us a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed
in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Dear Mr. Cawthorne:
On March 17, 2000, I met with you at the subject property to conduct an evaluation of the stream features
present to determine whether the site would require compliance with the Neuse Buffer Rule. This specific
project is referenced by the Raleigh Regional Office as NBRRO 99-077.
The features represented on the Wake, Franklin, Granville County Soils and the USGS maps were
evaluated to determine their subjectivity to the Neuse Buffer Rule. It was determined from the site visit
that the there are several features present on this property that are subject to the Neuse River Basin: Nutrient
Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas,
Administrative Code T15A:02B.0233 (NCAC 0233). The required buffer protection is delineated around
the pond and the other features on the map received by this Office on March 19, 2000.
Thank you for your attention to this matter and if this Office can be of any assistance or if you have
additional questions, please do not hesitate to contact us. This letter only addresses the applicability of the
Neuse Riparian Buffer.

Please review the preconstruction notification application for a new public road
crossing of the Neuse Riparian Buffer in Kimmon Place Subdivision. This road crossing
will be the only location where the Neuse Riparian Buffer or any wetlands will be
disturbed. We have selected this location because we believe this location will have the
least impact on the stream. The pond just below this crossing will also act as a filter to
help protect downstream waters. All wetlands within this project will be protected within
the open space that will be deeded to a homeowner's association. The homeowner's
association will be required to preserve these areas in their natural state.
