The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. The riprap material will contour the natural shoreline and will not extend waterward more than 5 feet from the erosion escarpment at any point. 4. The height of the riprap material waterward of tidal wetlands shall not exceed six inches above the adjacent marsh substrate at any point. 5. No vegetated wetlands will be excavated or filled. 6. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 7. The riprap material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 8. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. IV Post Office Box 2716 Kill Devil Hills, NC 27948 Dear Mr. Webster: You have our approval, in accordance with the attached conditions, to place fill material in 246 square feet of waters for the purpose of stabilizing a shoreline, as you described in your application dated May 25, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3274. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control. Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may askfor an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. PROJECT SUMMARY: The applicant proposes to: 1) place riprap along 338 linear feet of shoreline. Approximately 215' will be landward of normal water level and 123' will be placed a maximum of two feet waterward of normal water level, 2) construct a 6' x 10' walkway to a 6' x 200' pier, and a 426 square foot platform with a 120 square foot screened gazebo, and, 3) construct a 182 square foot "walkover" deck over the riprap, landward of normal water level. PROJECT SETTING The applicant's property is in Swan View Shores Subdivision at the end of Swan View Drive (SR1219), Colington Island in Dare County, adjacent to the Roanoke Sound. The property consists of four lots totaling approximately 5.2 acres with an elevation three and five feet above normal water level (NWL). Structures on the properties inchide a dwelling, a trailer, an access drive with parking, and septic systems. All developed areas are landward of the Estuarine Shoreline Area of Environmental Concern (AEC). Located to west of Mr. Webster's property are two vacant, wooded lots, owned by George and Merry Mendelson. To the east of the applicant's property is a large wooded lot with a dwelling. All of the adjacent properties have natural unprotected shorelines. The Mendelson's have also submitted an application to place riprap along their shoreline for erosion control. On site inspection of the properties in question have revealed evidence of erosion. Along the west side of the Webster properties, and extending into the Mendelson properties, are approximately 19.350 square feet of delineated Coastal Wetlands and a large section of 404 wetiands. The dominant vegetation found in the wetland areas includes, but is not limited to, big cordgrass (Sparrina cynosuroides) and common reed (Phragmires ausrralis). The Coastal Wetland area has evidence of damage to the vegetation from the severe storm events during the previous year, but is also showing sighs of recovery. However, a sandy berm has formed along the shoreline at the waterward edge of the Coastal Wetlands, diminishing the hydrological connection between the wetland area and the Roanoke Sound, resulting in a marginal connection. A second area of Coastal Wetlands, approximately 1,278 square feet in size, exists along the southeast corner of the applicant's property adjacent to the sound. Vegetation in this area includes big cord grass (Sparrina cynosuroides), salt meadow grass (Spanina patens), black needle-rush (Juncus roemerianus), and smooth cordgrass (Spartina altern#Zora). Upland vegetation includes, but is not limited to, bald cypress (Tircodium dutichum), flowering dogwood (Cornus Honda), live oak (Quercus virginica), loblolly pine (Pines raeda), and wax myrtle OMy ca cerifera). The applicant's shoreline forms a gently sloping sandy beach littered with fallen trees and stumps. Water depths adjacent to the project site are shallow reaching a depth of only two feet below normal water level at a distance of 200' offshore. While no submerged aquatic vegetation was found in the adjacent waters, they are historically found in this area of the Sound. Roanoke Sound and its tributaries (in this area) are classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Currituck Sound is SB (swimming). Review of available information indicates that there are no known archeological sites or significant geological formations associated with the applicant's property. Sterling Webster 1V May 19, 2000 Page 2 PROJECT DESCRIPTION The applicant, Sterling Webster, proposes to undertake the following development: 1) Riprap 338' of shoreline, placing 130' along the shoreline 3' to 10' landward of NWL (extending it from the western corner in a southeasterly direction). The riprap alignment will have a five-foot base and have a maximum height of one foot. From the point where the 130' section of riprap ends, the alignment will run along the waterward edge of NWL and extend along 123' of shoreline. Riprap in this area will have a two-foot base with a height of one foot. Water depths along this alignment are approximately six inches on the waterward side of the riprap. The alignment in this section will extend along the waterward edge of a 19,350 square foot Coastal Wetland, and will extend approximately six inches above NWL. The remaining 85' of the alignment will be placed landward of NWL and a small 1.278 square foot Coastal Wetland. 2) The applicant also proposes to construct a walkway, pier, and a platform with gazebo. Ten feet will be over land and 200' will be waterward of NWL. The pier will be six feet wide and terminate at a platform and screened gazebo. The platform and gazebo will he 426 square feet and the pier will be 1.044 square feet for a total of 1.470 square feet (including two sets of stairs going into the water). No boat slips or mooring pilings are proposed in conjunction with the pier. According to the application narrative the pier will maintain a setback of 50' from the adjacent riparian properties. However, field measurements indicate that the pier will be within 25' of the eastern most riparian line. 3) The final activity being proposed is a 182 square foot deck/ walkover, across the landward riprap alignment, on the eastern end of the property. The walkover will be completely landward of NWL. ANTICIPATED LNIPACTS • The proposed riprap alignment will result in the placement of approximately 24 cubic yards of rock concrete. and fill 820 square feet of high ground. • The deck crossing the riprap will shade 132 square feet of high ground (Not including the 50 square feet already covered by the riprap). • The 6' x 10' walkway accessing the pier will shade 60 square feet of high ground. • Placement of riprap wateivred of normal water level will result in the placement of approximately 9 cubic yards of rock/concrete, and fill 246 square feet of shallow water bottom and Estuarine Water. • The pier, deck and gazebo will shade 1,470 square feet of Estuarine Water and Public Trust Water. • Temporary turbidity will occur during installation and construction of the pier and the riprap pilings. • placement of the riprap structure should slow the rate of erosion along the applicant's property. • Placement of the riprap waterward of the Coastal Wetland has the potential of cutting off the hydrological connection to a section of marginal Coastal Wetlands. Subject property known as Parcels 1, 2, D and E. The project entails construction of a rock rip rap structure along the shoreline, not exceeding two feet waterward of the NWL, a 6'x 200' wooden pier with a 20'x 20' platform including a screened gazebo on the end, a 6'x 10' deck on the east side of the gazebo with a pair of steps leading into the water on both sides of the deck (see attached plat), a 6'x 12' wooden walkover with a 6'x 10' platform constructed over a section of rock rip rap, to access the beach. Rock rip rap will be trucked in and hand placed along the edge of the shoreline of Parcel 1, 2 and the south end of Parcel D, totaling 208 linear feet. The width of the rock rip rap for 208 linear feet will be at a maximum of two feet waterward of the NWL. For the remaining (130') portion of Parcel D. rock rip rap is proposed to be constructed landward of the NWL (approx. 3 to 10 feet landward of the NWL) and at a width of (5) five feet for 130 linear feet. A wooden walkover is proposed to be constructed over a portion of the rock np rap to allow the owner access over the rip rap and onto the beach. The wooden walk over is proposed landward of the NWL. Total linear feet of rock rip rap proposed is 338 feet. Filter cloth will be placed at the base of the rock rip rap. Total square footage of disturbance within the estuarine shoreline proposed is 1.25 8 square feet (includes rock rip rap 208 x 2 = 416 sq ft, 130 x 5 = 650 sq ft, walkover 132 sq f ; boardwalk = 60 sq ft.: Totaling 1.258 square feet of disturbance with in the estuarine shoreline). The water depth at the end of the pier is -2.0 feet. The purpose of the proposed construction is to prevent further storm erosion to the property owner's shoreline and allow him to obtain access to the beach and Albemarle Sound. PROJECT SUMMARY: The applicant proposes to: 1) place riprap along 338 linear feet of shoreline. Approximately 215' will be landward of normal water level and 123' will be placed a maximum of two feet waterward of normal water level, 2) construct a 6' x 10' walkway to a 6' x 200' pier, and a 426 square foot platform with a 120 square foot screened gazebo, and, 3) construct a 182 square foot "walkover" deck over the riprap, landward of normal water level. PROJECT SETTING The applicant's property is in Swan View Shores Subdivision at the end of Swan View Drive (SR1219), Colington Island in Dare County. adjacent to the Roanoke Sound. The property consists of four lots totaling approximately 5.2 acres with an elevation three and five feet above normal water level 0NWL). Structures on the properties include a dwelling. a trailer, an access drive with parking, and septic systems. All developed areas are landward of the Estuarine Shoreline Area of Environmental Concrrn (AEC). Located to west of ?Mr. Webster's propem• are two vacant. wooded lots, owned by George and Merry Mendelson. To the east of the applicant's properT is a large wooded lot with a dwelling. All of the adjacent properties have natural unprotected shorelines. The Mendelson's have also subminrd an application to place riprap along their shoreline for erosion control. On site inspection of the proper u--s in question have revealed evidence of erosion. :Tong the west side of the Webster properties. and extending into the Mendelson properties. are approximately 19.350 square feet of delineated Coastal Wetlands and a large section of 404 wetlands. The dominant vegetation found in the wetland areas includes. but is not limit ed to, big cord---ass (Span'= cynosuroiaes) and common reed (Phravrues ausrraiis). The Coastal Wetland area has evidence of damage to the vegetation from the severe storm events during the previous year. but is aiso showing signs of recovery. However, a sandy berm has formed along the shoreline at the %;mterward edge of the Coastal Wetlands, diminishing the hydrological connection between the wetland area and the Roanoke Sound. resulting in a marginal connection. A second area of Coastal Wetlands. approximately 1.278 square feet in size, exists along the southeast corner of the applicant's property adjacent to the sound. Vegetation in this area includes big cord grass (Sparrina cynosuroides), salt meadow grass (Sparrina parens), black: needle-rush (Iuncus roemerianus), and smooth cordgrass (Sparrina alrerniflora). Upland vegetation includes, but is not limited to, bald cypress (Taxodium &srichum), flowering dogwood (Corner florida), live oak (Quercus virginica), loblolly pine (Pinus raeda), and «ac myrtle afm*ca cerirera). The applicant's shoreline forms a gently sloping sandy beach littered with fallen trees and stumps. Water depths adjacent to the project site are shallow reaching a depth of only two feet below normal water level at a distance of 200' offshore. While no submerged aquatic vegetation was found in the adjacent waters, they are historically found in this area of the Sound. Roanoke Sound and its tributaries (in this area) are classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Currituck Sound is SB (swimming). Review of available information indicates that there are no known archeological sites or significant geological formations associated with the applicant's property. Sterling Webster IV May 19, 2000 Page 2 PROJECT DESCRIPTION The applicant. Sterling Webster, proposes to undertake the following development: 1) Riprap 338' of shoreline, placing 130' along the shoreline 3' to 10' landward of NWL (extending it from the western corner in a southeasterly direction). The riprap alignment will have a five-foot base and have a maximum height of one foot. From the point where the 130' section of riprap ends, the alignment will run along the waterward edge of NWL and extend along 123' of shoreline. Riprap in this area will have a two-foot base with a height of one foot. Water depths along this alignment are approximately six inches on the waterward side of the riprap. The alignment, in this section will extend along the waterward edge of a 19,350 square foot Coastal Wetland, and will extend approximately six inches above NWL. The remaining 85' of the alignment will be placed landward of INTWL and a small 1.278 square foot Coastal Wetland. 2) The applicant also proposes to construct a walkway. pier, and a platform with gazebo. Ten feet will be (wer land and 200' will be waterward of NWL. The pier will be six feet wide and terminate at a platform and screened gazebo. The platform and gazebo will be 426 square feet and the pier will br 1.044 square feet for a total of 1.470 square feet unciuding tw•o sets of stairs going into the water No boat slips or mooring pilings are proposed in conjunction with the pier. according to the appiication narrative the pier will maintain a setback of 50' from the adiacent riparian properties. However, field measurements indicate that the pier will be within 25' of the eastern most riparian line. 3) The final activity being proposed is a 182 square foot de; k:" walkover, across the landward riprap aiignment. on the eastern end of the property. The walkover will be completely landward of NvWL. Temporary turbidity will occur during installation and construction of the pier and the riprap pilings. • placement of the riprap structure should slow the rate of erosion along the applicant's property. • Placement of the riprap waterward of the Coastal Wetland has the potential of cutting off the hydrological connection to a section of marginal Coastal Wetlands.
