On August 5, 1996, we renewed general permit No. 198000291 (copy enclosed), which
provides Federal authorization for construction activities that receive authorization from the State of
North Carolina.
A review of your application received, for Department of the Army authorization to
reconstruct a breakwater system at Brandywine Marina entrance channel adjacent to Bogue Sound
west of Morehead City, Carteret County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the administrative processing of your application
will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal
review agencies will be furnished to the State.
If your application must be withdrawn from this general permit process for any reason, you will
be informed regarding its further management. If there are no unresolved differences in State-Federal
positions or policies, the final action taken on your application by the State will result in your receiving
written notice from us that your application is consistent with the general permit and you may
commence your activity. Only after receiving such confirmation should you begin work.

APPROVAL of 401 Water Quality Certification
Dear Mr. Craft:
You have our approval, in accordance with the attached conditions, to place fill in 0.02 acre of shallow bottom
in order to construct a breakwater extension on your property in Carteret County, as you described in your
application dated 24 May 2000. After reviewing your application, we have determined that this fill is covered by
General Water Quality Certification Number 3112. This Certification allows you to use your CAMA Permit when
the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application for a new certification. If
the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby
responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed
one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to
be valid, you must follow the conditions listed in the attached certification:
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter: To ask for a hearing, send a written petition which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask
for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.

9.. NARRATIVE DESCRIPTION:
The project site is a ±37 acre residential development on Highway 24, approximately 2.5 miles
west of Morehead City in Carteret County. The lots average in excess of 1/2 acre each, and
amenities include a swimming pool, tennis courts, a clubhouse, and a marina. This application
regards the marina, which is operated by the Brandywine Marina Association. This facility is
located just north of AIWW Channel Marker 13. The tract owned by the Association is
approximately 1/4 acre in size, approximately +6' msl, and has a pump out facility that is
serviced by municipal sewer services.
The development is mostly built out with single and multi-family housing. The marina is
stabilized with a traditional bulkhead wall, and has an access channel extending into Bogue
Sound, with a breakwater along the west side. There is no coastal marsh along the shoreline at
the marina location, nor is there a viable SAV habitat. The SAV beds are more prolific east and
west of the project site.
Bogue Sound at the project site carries a water quality classification of SA. The marina and
entrance channel are closed to the taking of shellfish for consumption, although the connecting
sound is open. Bogue Sound in this area is not designated a Primary Nursery Area. The Carteret
County Land Use Plan classifies the existing land use in the area as Developed, with all Areas of
Environmental Concern classified as Conservation. This proposal lies within the Conservation
classification in its entirety.
The marina within the high ground basin was originally constructed in 1979. At that time, 823'
of breakwater was constructed to prevent the filling of the channel. During the March storm of
1993 (the applicant erroneously cited hurricanes Fran and Bertha of 1996 in the application), the
breakwater was destroyed. The applicants applied for and received a CAMA Major Permit, #57-
94, to reconstruct a 905' breakwater. For financial reasons, the Association only built 605' of this
approved structure. The relic pilings from the original structure destroyed in `93 still exist
beyond the rebuilt structure. The permit expired in 1997. Since then, the channel in the area of
±200' from the end of the breakwater has been regularly silting in from the west, requiring
frequent maintenance excavation. A General Permit was issued for maintenance excavation in
this area on May 04, 2000, and the excavation has been done.
The applicants are proposing to reconstruct 204' of the original structure, beyond the 605' already
rebuilt, for a total length of 809'. This is 104' less than was authorized in 1994. The structure
will be located within the alignment of the pre-existing structure. All relic pilings are scheduled
to be removed. The new structure will be supported with batter piles, creating a 4' bottom
incorporation. The applicant has designed the breakwater to comply to the maximum extent
practicable with the General Permit requirements for breakwaters. As such, there will be gaps
totaling 1' foot between boards. The structure will extend no more than F above the normal high
water contour. The first 110' structure will begin with a 5' gap from the existing structure,
overlapping the existing by 5'. The next 40' is offset and overlaps the first by 5'. The next two
sections are 30' in length each, and turn westward. The applicants have proposed to "wrap" this
section of wall to prevent the movement of sand around the end of the structure, as the

photography indicates is happening currently. The finished structure will terminate >700'
landward of the AIWW, some 630' waterward of the high water contour along the shoreline. The
pilings and boards will penetrate the surface by 7'.
The breakwater in its existing position extends across the riparian corridors of other property
owners within the development. This proposed extension should not extend any further into any
corridor.
10. ANTICIPATED IMPACTS:
As proposed, the breakwater will incorporate approximately 816 square feet of sandy bottom area
with the pilings, boards, and batter boards. There will be an intrusion of 204 additional linear
feet into the public trust area of Bogue Sound, in an area that currently has relic pilings. There
should be some change to the free movement of sand along the shoreline in this area, as is the
intent. Given the design of the structure, and the fetch and tidal flux in the area, I would expect
no impacts to water quality or circulation. Navigation should not be impacted, as the structure
ends where the deeper water begins. Boating ingress and egress is an existing use in this
channel, and should cause no additional impacts. If the structure serves its intended purpose, the
schedule for maintenance excavation in the area should decrease.

9.. NARRATIVE DESCRIPTION:'
The project site is a ±37 acre residential development on Highway 24, approximately 2.5 miles
west of Morehead City in Carteret County. The lots average in excess of 1/z acre each, and
amenities include a swimming pool, tennis courts, a clubhouse, and a marina. This application
regards the marina, which is operated by the Brandywine Marina Association. This facility is
located just north of AIWW Channel Marker 13. The tract owned by the Association is
approximately 1/4 acre in size, approximately +6' msl, and has a pump out facility that is
serviced by municipal sewer services.
The development is mostly built out with single and multi-family housing. The marina is
stabilized with a traditional bulkhead wall, and has an access channel extending into Bogue
Sound, with a breakwater along the west side. There is no coastal marsh along the shoreline at
the marina location, nor is there a viable SAV habitat. The SAV beds are more prolific east and
west of the project site.
Bogue Sound at the project site carries a water quality classification of SA. The marina and
entrance channel are closed to the taking of shellfish for consumption, although the connecting
sound is open. Bogue Sound in this area is not designated a Primary Nursery Area. The Carteret
County Land Use Plan classifies the existing land use in the area as Developed, with all Areas of
Environmental Concern classified as Conservation. This proposal lies within the Conservation
classification in its entirety.
The marina within the high ground basin was originally constructed in 1979. At that time, 823'
of breakwater was constructed to prevent the filling of the channel. During the March storm of
1993 (the applicant erroneously cited hurricanes Fran and Bertha of 1996 in the application), the
breakwater was destroyed. The applicants applied for and received a CAMA Major Permit, #57-
94, to reconstruct a 905' breakwater. For financial reasons, the Association only built 605' of this
approved structure. The relic pilings from the original structure destroyed in `93 still exist
beyond the rebuilt structure. The permit expired in 1997. Since then, the channel in the area of
±200' from the end of the breakwater has been regularly silting in from the west, requiring
frequent maintenance excavation. A General Permit was issued for maintenance excavation in
this area on May 04, 2000, and the excavation has been done.
The applicants are proposing to reconstruct 204' of the original structure, beyond the 605' already
rebuilt, for a total length of 809'. This is 104' less than was authorized in 1994. The structure
will be located within the alignment of the pre-existing structure. All relic pilings are scheduled
to be removed. The new structure will be supported with batter piles, creating a 4' bottom
incorporation. The applicant has designed the breakwater to comply to the maximum extent
practicable with the General Permit requirements for breakwaters. As such, there will be gaps
totaling 1' foot between boards. The structure will extend no more than 1' above the normal high
water contour. The first 110' structure will begin with a 5' gap from the existing structure,
overlapping the existing by 5'. The next 40' is offset and overlaps the first by 5'. The next two
sections are 30' in length each, and turn westward. The applicants have proposed to "wrap" this
section of wall to prevent the movement of sand around the end of the structure, as the

photography indicates is happening currently. The finished structure will terminate >700'
landward of the AIWW, some 630' waterward of the high water contour along the shoreline. The
pilings and boards will penetrate the surface by 7'.
The breakwater in its existing position extends across the riparian corridors of other property
owners within the development. This proposed extension should not extend any further into any
corridor.
10. ANTICIPATED IMPACTS:
As proposed, the breakwater will incorporate approximately 816 square feet of sandy bottom area
with the pilings, boards, and batter boards. There will be an intrusion of 204 additional linear
feet into the public trust area of Bogue Sound, in an area that currently has relic pilings. There
should be some change to the free movement of sand along the shoreline in this area, as is the
intent. Given the design of the structure, and the fetch and tidal flux in the area, I would expect
no impacts to water quality or circulation. Navigation should not be impacted, as the structure
ends where the deeper water begins. Boating ingress and egress is an existing use in this
channel, and should cause no additional impacts. If the structure serves its intended purpose, the
schedule for maintenance excavation in the area should decrease.

overlapping the existing by 5'. The next 40' is offset and overlaps the first by 5'. The next two
sections are 30' in length each, and turn westward. The applicants have proposed to "wrap" this
section of wall to prevent the movement of sand around the end of the structure, as the

photography indicates is happening currently. The finished structure will terminate >700'
landward of the AIWW, some 630' waterward of the high water contour along the shoreline. The
pilings and boards will penetrate the surface by 7'.
The breakwater in its existing position extends across the riparian corridors of other property
owners within the development. This proposed extension should not extend any further into any
corridor.
10. ANTICIPATED IMPACTS:
As proposed, the breakwater will incorporate approximately 816 square feet of sandy bottom area
with the pilings, boards, and batter boards. There will be an intrusion of 204 additional linear
feet into the public trust area of Bogue Sound, in an 'area that currently has relic pilings. There
should be some change to the free movement of sand along the shoreline in this area, as is the
intent. Given the design of the structure, and the fetch and tidal flux in the area, I would expect
no impacts to water quality or circulation. Navigation should not be impacted, as the structure
ends where the deeper water begins. Boating ingress and egress is an existing use in this
channel, and should cause no additional impacts. If the structure serves its intended purpose, the
schedule for maintenance excavation in the area should decrease.

claiming to be the owner of said property, then

• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 12" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
