After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3112. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless. otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification: If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. NARRATIVE DESCRIPTION: The project site is a .5 acre single family residential property averaging ±5' msl, located within the Spooner's Creek development of Morehead City. The property address is 143 South Spooner's Street, and is serviced with a private well and septic system. This development surrounds Spooner's Creek off of Highway 24, approximately .8 mile west of the intersection with US 70. The property is vegetated with typical lawn grasses to the bulkhead, with 18' to 20' of marsh fringe. This site lies on the south side of the creek, near the entrance and west of the marina. The tract has approximately 101' of water frontage, stabilized with a traditional timber wall. Currently, there is a docking facility comprised of a pier, dock, and two boat lifts adjacent to the property. Spooner's Creek is an artificially enhanced creek system connecting to Bogue Sound which undergoes regular maintenance excavation. The waters of Spooner's Creek are classified SA by the Division of Water Quality, are closed to the taking of shellfish by the Division of Health Services, and the creek is not a designated Primary Nursery Area. The Morehead City Land Use Plan classifies Spooner's Creek as "Developed" with all areas within CAMA Areas of Environmental Concern classified as "Conservation." The applicant currently has mooring for two vessels through the use of the two boatlifts. He proposes to add 6 mooring pilings to the south of the existing dock, creating a third slip. These pilings would extend approximately 110' into the body of water, 75' apart in length and 25' apart in width. The applicant's contractor has stated that the body of water is in excess of 500' across at the project site; the aerial photography indicates that it is approximately 440' across. The water depth at the project terminus is approximately 4 nlw. The location of the proposed docking system is 20' inside of the southern property line, but appears to be closer than 15' to this riparian corridor. There is a waiver on file for encroachment into this corridor. 10. ANTICIPATED IMPACTS: The proposed mooring system would result in a Public Trust Area incorporation of 1875 square feet. A third slip would be available for mooring. The project barely does comply with the 1/4 rule, and poses no hazard to navigation. NARRATIVE DESCRIPTION: Project Setting The applicant owns a 1.83 acre landscaped, residential lot adjacent to Trent River at 4905 Trent Woods Drive in the Town of Trent Woods, Craven County. The lot is approximately 15 ft. above mean sea level has 200 ft. of shoreline. The Trent River is approximately 1500 ft. wide at the project site and is classified SB SW NSW by the NC Division of Water Quality. The site is approximately 1000 ft. upstream of the mouth of Wilson Creek which is the delineation between estuarine and inland waters. The entire shoreline along this portion of the Trent is dominated by individual residential lots. A private marina is located approximately 0.5 miles downstream of this location. Primary uses of the Trent River in this area include recreational boating and fishing. The federally maintained channel for this portion of the river follows the opposite shoreline at the project site. Currently, the dock layout is as follows: a 6 ft. X 13 ft. pier leads to a 20 ft. X 20 ft. covered platform; from this platform a 6 ft. X 38 ft. finger pier parallels the shoreline upstream to two existing boat lifts; the first lift is surrounded by a 3 ft. X 33 ft. catwalk and covered by a 12 ft. X 25 ft. roof and second story deck; the second lift is accessed from the end of this catwalk. The applicant currently uses the first lift for a small skiff and the second lift for 38 ft. powerboat. Existing water depths around the dock and lifts range between -3.0 to -5.0 NWL. Project Description The applicant proposes to remove the second story deck from the existing boat house and repair/replace the existing roof to the original dimensions (12 ft. X 25 ft.). Two catwalks totaling 3 ft. X 47 ft. will be installed around the east and southern sides of the second lift. A 12 ft. X 40 ft. roof would then be constructed over the second lift. Construction methods used during the project will include a barge and crane for the installation of the pilings. land based activities will include access for workers and the delivery/removal of construction materials. There will be no upland development or land disturbing activities during the proposed construction. There will be no walls or siding for the boat houses during the proposed construction. Anticipated Impacts The proposed development would result in the shading of an additional 621 ft.2 of public trust waters. Some temporary, construction related increases in turbidity can be expected during the installation of new pilings and related construction activities. While the entire project area involves 921 ft.2, the existing structural footprint will increase by 141 ft.2. The removal of the second story deck will contribute to a 198 ft.' reduction in the amount of overall deck space. Total deck space after the project will be 791 ft.2. The project includes the construction of a 12'x 40' boat house with 47 linear feet of 3' wide finger piers surrounding an existing permitted boat lift (see Attachment for CAMA General Permit No. 22277-C).. The 12'x 40' boathouse is needed to accommodate the 38' boat.(See Attachment for photograph of boat in lift). The existing square footage of the docks, platforms, & finger piers is approximately 989 sq. ft. The proposed plan is to remove the access stairway and railing from the 2nd story platform which is now located above the existing boathouse. This will eliminate approximately 306 sq. ft. The proposed finger piers will add 141 sq. ft. to the overall area. After the construction and removal is complete there will be a net loss of approximately 198 sq. ft. of dock area. Taking into account the shoreline is approximately 200 linear feet and the new total area of the docks being 791 sq. ft., the project meets the Use Standards Rule 15A:07H.0208. Construction methods used during the project will include a barge and crane for the installation of the pilings. Land based activities will include access for workers and the delivery and removal of construction material (i.e. lumber). There will be no upland development or land disturbing activities during the proposed construction. NARRATIVE DESCRIPTION: The project site is a .5 acre single family residential property averaging ±5' msl, located within the Spooner's Creek development of Morehead City. The property address is 143 South Spooner's Street, and is serviced with a private well and septic system. This development surrounds Spooner's Creek off of Highway 24, approximately .8 mile west of the intersection with US 70. The property is vegetated with typical lawn grasses to the bulkhead, with 18' to 20' s of marsh fringe. This site lies on the south side of the creek, near the entrance and west of the marina. The tract has approximately 101' of water frontage, stabilized with a traditional timber wall. Currently, there is a docking facility comprised of a pier, dock, and two boat lifts adjacent to the-property. Spooner's Creek is an artificially enhanced creek system connecting to Bogue Sound which undergoes regular maintenance excavation. The waters of Spooner's Creek are classified SA by the Division of Water Quality, are closed to the taking of shellfish by the Division of Health Services, and the creek is not a designated Primary Nursery Area. The Morehead City Land Use Plan classifies Spooner's Creek as "Developed" with all areas within CAMA Areas of Environmental Concern classified as "Conservation." The applicant currently has mooring for two vessels through the use of the two boatlifts. He proposes to add 6 mooring pilings to the south of the existing dock, creating a third slip. These pilings would extend approximately 110' into the body of water, 75' apart in length and 25' apart in width. The applicant's contractor has stated that the body of water is in excess of 500' across at the. project site; the aerial photography indicates that it is approximately 440' across. The water depth at the project terminus is approximately 4 nlw. The location of the proposed docking system is 20' inside of the southern property line, but appears to be closer than 15' to this riparian corridor. There is a waiver on file for encroachment into this corridor. 10. ANTICIPATED IMPACTS: The proposed mooring system would result in a Public Trust Area incorporation of 1875 square feet. A third slip would be available for mooring. The project barely does comply with the 1/4 rule, and poses no hazard to navigation.
