PA 18848 Dear Ms. Wooster: You have our approval, in accordance with the attached conditions, to place fill material in 1,320 square feet of waters for the purpose of constructing a bulkhead, as you described in your application dated May 22, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3274. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant proposes to construct a 140 ft. long bulkhead along her shoreline. Viola M. Wooster Field Investigation Report Page Two Site Description The applicant's property consists of two lots, with a total area of 16,842 sq. ft. located at #297 and #298 King's Point Drive (SR 1402), Brigand's Bay Subdivision, Frisco Village, in Dare County and adjacent to a manmade water body known as Brooks Creek off the Pamlico Sound. The property is mostly level, has an elevation of approximately 4 ft. above normal water level (NWL) and has sandy soils. A small vacation house is located on #298. The property is vegetated with indigenous yard grasses and is maintained by the owner. Adjacent property consists of lots of similar size, both with a single family dwelling and a bulkhead for shoreline protection. The property has a shoreline of approximately 140 ft. along the water body. The shoreline has a wetland fringe vegetated with Spanina aftent fora rooted in a peat type substrate at the NWL as well as patches of Juncos rwwnanus. The shoreline wetland fringe width averages 5 ft. The shoreline of both adjacent lots also has Spanina alterniflora beds, located waterward of their existing bulkheads. Landward of the Spanina alterniflora beds, the shoreline area rises to the existing lot elevation where a storm tide erosion escarpment exists. The area is approximately 8 ft. wide and has sandy soils with patchy vegetation consisting of distichlis spicata, marsh elder, and wax myrtle. The waters of the Pamlico Sound are classified as SA by the Division of Environmental Management and the area is closed to shellfish taking. Development Proposal In order to protect her property from erosion and flooding, the applicant proposes to construct a 140 ft. long treated wooden bulkhead to connect at the corners of the adjacent existing bulkhead structures. The applicant proposes to backfill the bulkhead with fill material from an upland site. The proposed bulkhead will have a straight alignment and will average approximately 3 ft. landward of NWL. The proposed alignment will range from approximately 10 ft. landward of NWL to approximately 8 ft. waterward of NWL. Anticii.- Led Impacts The proposed bulkhead alignment will result in approximately 200 sq. ft. of Public Trust Area and Estuarine Waters Areas of Environmental Concern (AFC's) being filled, approximately 420 sq. ft. of Coastal Wetlands AEC being filled and approximately 700 sq. ft. of possible 404 wetlands located in the Estuarine Shoreline being filled. It is estimated that 10 cubic yards of fill material will be placed below NWL behind the proposed bulkhead. It is anticipated that approximately 1,480 sq. ft. of the Estuarine Shoreline AEC will be disturbed during the construction and grading of the property after construction.
