APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Adcock:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.33 acres of
wetlands and 115 feet of streams in order to construct the Jonesboro Industrial Park in Lee County, as described in your application
dated May 19, 2000 (revised November 2, 2001). After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3287. This certification allows you to use Nationwide Permit Number 39 when the Corps of
Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including
(but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This
approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified In the General
Certification. This certification replaces one issued to you on July 17, 2000 with stormwater plan comments on April 12, 2001.
This approval is only valid for the purpose and design that you described in your application except as modified below. If you
change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner
must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.
1. This modify approval is for total impact for the Industrial Park of 0.33 acres of wetlands and 115 feet of stream. If any additional
wetland impact is applied for or found via a site visit, then written DWQ approval is needed including on-site permanent stormwater
management for the entire Industrial Park
Upon completion of the project, the applicant shall complete and return the enclosed "Certification of Completion Form" to notify
DWQ that all work included in the 401 Certification had been completed. The responsible party shall complete the attached form
and return it to the 401 wetlands Unit of the Division of Water Quality.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

Dear Mr. Bright:
The Wetlands Unit staff reviewed the stormwater management plans for the subject project and determined that additional
information is necessary to complete the technical review process. I have based my comments on the assumption that
you are prosing BMPs that combine the use of dry ponds, grassed swales, and level spreaders that provide diffuse flow
through forested wetlands (other than the wet pond). The required additional information is as follows:
1. Inlet/Outlet Structure Location
The inlet and outlet structures must be placed to minimize short circuiting and turbulence. The submitted design for
dry pond no. 4 will be subject to short circuiting, assuming that most of the runoff would enter by the Swale #4. This
issue may be addressed through outlet structure relocation, inlet relocation, forebays, etc.
2. Vegetated Side Slopes
The swale side slopes must be stabilized with dense hardy grass and side slopes no steeper than 3:1 (horizontal to
vertical). Landscape information must be clearly stated on engineering plans. Also, if the slope of the Swale exceeds
4%, check dams must be employed to reduce the effective slopes to 4% or less. Reference the NCDENR
Stormwater Best Management Practices Manual, April 1999, p. 68.
3. Drainage Area
Wet detention basins must be designed to treat all of the runoff draining to the basin. Please delineate the
drainage area including offsite drainage to the basin.
4. Operation and Maintenance Agreement
An operation and maintenance agreement is also required for the dry ponds, grassed swales and level spreaders.
Typical requirements for an operation and maintenance plan include the following:
• Vegetation management/mowing schedule
• Semi-annual inspections
• Debris check after every storm event
• Benchmark for sediment removal (specific elevations listed)
• Repair/maintain level spreader to ensure diffuse flow through wetlands
• Repair eroded areas
• Clear draw down orifice after every storm event
• Designation of a responsible party
The operation and maintenance agreement must also be signed by the responsible party and notarized.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built-upon area for each lot must be provided as an attachment.
1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted

When using the Division SA/DA tables, the correct SA/DA ratio for permanent pool sizing should be computed based upon the
actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-
standard table entries.
In the 20 coastal counties, the requirement for a vegetative filter may be waived if the wet detention basin is designed to provide
90% TSS removal. The NCDENR BMP manual provides design tables for both 85% TSS removal and 90% TSS removal.

III. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
1. After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re-seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads feet in the forebay, the sediment shall be removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through
the emergency drain shall be minimized to the maximum extent practical.

7. All components of the wet detention basin system shall be maintained in good working order.

LEE COUNTY DECLARATION OF RESTRICTIVE COVENANTS
KNOW ALL MEN BY THESE PRESENTS that ACA/PJA, LLC. a Limited Liability Company incorporated
under the laws of the State of North Carolina, with its principal place of business located at 1107 South Horner
Boulevard, Lee County, North Carolina, hereinafter referred to as the Declarant, does hereby covenant and
agree to and with all the persons or other entities who may become the owners of the following lots or parcels
of land, or any of them, lying and being in Jonesboro Township, Lee County, North Carolina, and more
particularly described as follows:
BEING ALL of Lots 1-16 of the Jonesboro Industrial Park as shown by map thereof recorded in Plat
Cabinet , Slide , Lee County Registry. Reference to said map is hereby made for a more
particular description.
The said lots or parcels or land are hereby impressed and subjected to the following covenants and
restrictions which are hereby made covenants and restrictions running with the land shown upon the above-
referenced map, by whomsoever owned or hereafter acquired, to-wit:
1. These covenants are intended to ensure ongoing compliance with stormwater management
permit number as issued by the Division of Water Quality. These covenants may not
be changed or deleted without the consent of the State.
2. No more than 75% of the square footage of any lot shall be covered by structures or
impervious materials. Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar
material, but do not include wood decking or the water surface of swimmimg pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway
crossings.
4. Built upon area in excess of the permitted amount requires a state stormwater management
permit modification prior to construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted
stormwater control system. These connections to the stormwater control system shall be performed in a
manner that maintains the integrity and performance of the system as permitted.
6. A ten (10) foot easement running along the side and rear property lines of any lot is reserved
for access to and maintenance of any retention ponds or stormwater management system and for utility
installation, including but not limited to telephone, electrical, water, and sewer installation, maintenance and
drainage.
7. Containers for garbage or other refuse shall be kept in sanitary enclosures so as not to be
accessible to animals or visible when any such enclosure is closed; and any such garbage receptacles and
enclosures shall be maintained under sanitary conditions.
8. The covenants, restrictions and limitations herein contained may be altered, cancelled or
revoked by unanimous assent in writing of all property owners of lots shown on the above referenced plat
provided the instrument making such change shall be duly executed, acknowledged and recorded in the
Registry of Lee County, and with regard to covenants relating to stormwater management that the State of
North Carolina has consented to any such alteration, amendment or revocation.
9. These covenants are to run with the land and shall be binding on all parties and all persons
claiming under them until the 31st day of December, 2031, unless altered, cancelled of revoked by unanimous
consent of all property owners and with regard to stormwater magament, the State, as aforesaid.
10. If there is a violation or attempt to violate any of the covenants herein, it shall be lawful for any
other person or persons owning any real property subject to these covenants to prosecute any proceedings at
law or in equity against the person or persons violating or attempting to violate any such covenant and either
to prevent her, him or them from so doing or to recover damages for such violation and with regard to
stormwater management for the State of North Carolina to enforce said covenants.

A wetland delineation certification package was review--'
and signed off by Mr. Todd Tugwell of the Army Corps of
Engineers (COE) for this property on December 20, 1999. The
site is a parcel of land formerly used for agricultural purposes
and is located in a highly industrialized area of Sanford. The
wetlands at the site appear to be of low to moderate quality due
to degradation from past agricultural activities. A small pond
was constructed within the wetland area at some point in the
past and some old ditching was also observed. It is our
understanding that future impacts to wetlands, at this site,
other than described on these documents, are not planned or
intended.
The attached plans demonstrate a proposed industrial
subdivision format. Wetland impacts have been avoided when
possible and minimized to those areas considered necessary for
the effective development of this property. A total of 21,639
square feet (0.497 acres) of wetland impacts are proposed for
this entire industrial park complex. It is our belief that this
wetland area is located above the headwaters and that the
proposed wetland impacts fall under the umbrella of existing
nationwide permits. Of the proposed wetland impacts, 5800
square feet will be caused by construction of Cameron Drive.
These impacts appear to meet the requirements for NWP 14. The
remaining proposed impacts, 15,839 square feet, are needed for
discharges for the construction of building foundations and/or
attendant features such as parking lots and ?6%hicle traffic
areas. It is our belief that these impacts are authorized under
NWP 39.

APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Adcock:
You have our approval, in•accordance with the attached conditions and the condition listed below, to
place fill in 0.497 acre of wetlands in order to construct the Jonesboro Industrial Park in Lee County, as
you described in your application received by the Division of Water Quality on May 19, 2000. After
reviewing your application, we have determined that this fill is covered by General Water Quality
Certification Numbers 3289 and 3287. This Certification allows you to use Nationwide Permit Numbers
14 and 39 when issued by the U.S. Army" Corps of Engineers. In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this
approval will expire when the accompanying 404 permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be 'requir'ed t6 send us a new application for a new
certification. If the property is sold, the new owner must be given a copy of the Certification and approval
letter and is thereby responsible for complying with all conditions. If total wetland fills for this project
(now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification and the additional condition listed below.
1. Stormwater controls shall be constructed in order to protect surface waters and wetlands downstream
from the property. A final, written stormwater management plan shall be approved by this Office
before the impacts specified in this Certification occur. The stormwater management plan must include
plans and specifications for stormwater management facilities designed to remove 85% TSS according
to the most recent version of the NC DENR Stormwater Best Management Practices Manual. Also,
before any permanent building is occupied at the subject site, the facilities, as approved by this Office,
shall be constructed and operational, and the stormwater management plan, as approved by this Office,
shall be implemented.

were delineated at the site and the project was designed to place the wetlands along property boundaries where
impacts would not likelv be necessary. Also, Cameron Drive has been designed to cross at a narrow point in the
wetlands, but is also in accordance with local development requirements and DOT requirements. Some minor
impacts will be necessary under footprints of proposed buildings and required parking areas Wetland impacts not
deemed to be necessary were avoided. This exceptionally well located industrial property is extremely valuable and
development at lesser densities was not determined to be cost effective. Other scenarios such as a new road
accessing Wilson Road or alternative lot designs were considered, but additional wetland impacts would be
necessary. In other words we have not pursued the absolute maximum development potential of the site in
consideration of minimizing wetland impacts.

Size and Location of Pro er waterbod Highway name/number, town etc.: The property is
approximately 20 acres in size and is located on the north side of Wilson Road (SR 1146), approximately
500 feet east of Lee Avenue (SR 1133), in Sanford, Lee County, North Carolina. The site is adjacent to
an unnamed tributary of Little River, above headwaters, in the Cape Fear River Basin.

There are waters of the U.S., to include wetlands, on the above described property which we strongly suggest
should be delineated and surveyed. The surveyed wetland lines must be verified by our staff before the Corps will
make a final jurisdictional determination on your property.
Because of the size of your property and our present workload, our identification and delineation of your wetlands
cannot be accomplished in a timely manner. You may wish to obtain a consultant to obtain a more timely
delineation of the wetlands. Once the consultant has flagged a wetland line on the property, Corps staff will
review it, and, if it is accurate, we strongly recommend that you have the line surveyed for final approval by the
Corps. The Corps will not make a final jurisdictional determination on your property without an approved survey.

This project is located in the Neuse River or Tar-Pamlico River basin. You should contact the North Carolina
Division of Water Quality at (919) 733-1786 to determine additional requirements specific to this river basin.
Placement of dredged or fill material in wetlands on this property without a Department of the
Army Permit is in most cases a violation of Section 301 of the Clean Water Act (33 USC 1311). A
permit is not required for work on the property restricted entirely to existing high ground. If you
