This Office has reviewed the site map and plan for the restoration of a portion of Rocky Branch and the
relocation of the sewer main along Sullivan Drive. I met with you and several others regarding the approval
of this project relevant to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection
= and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC .0233).

Stream restoration projects are listed as exempted uses under this Rule and should be designed, constructed
and maintained to minimize soil disturbance and to provide the maximum water quality protection
practicable. The Raleigh Regional Office of the Division of Water Quality supports the relocation of the
. "? _.. r sewer utility from the stream channel to the street. This placement will aid in lessening any possible impacts
to water quality associated with overflows or spills. This relocation along the existing road should be
{. considered as exempt from the Riparian Rule since the roadway and the shoulder are present within the
buffer as existing uses.
