I have reviewed the information that you have submitted to determine if this timber operation is subject t
the requirements of the 15A NCAC 2B .0233 Neuse River Basin: Nutrient Sensitive Waters Managemer.
Strategy: Protection and Maintenance of Existing Riparian Buffers) on the above referenced property. Th
property and date of timber sale are as follows:
Approximately 5 acres of the 12.3 acres recorded in the Wake County Registry was sold
sealed bid on October 5 , 2000 and closed on October 12, 2000.

The information that was received by the Raleigh Regional Office on April 18, 2000 has been reviewed. Th
plat map and other information was provided to allow a determination to be made as to whether or not th
site would require compliance with the Neuse Buffer Rule. This specific project is referenced by the Raleig
Regional Office as NBRRO 00-099.
The features represented on the Wake County Soils and the Middlesex USGS Quad maps were evaluate
to determine their subjectivity to the Neuse Buffer Rule. It was determined that there are no feature
depicted on either of the maps. Therefore, according the Rule, this property is not subject to the Neus
River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existin
Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233).
Based on the materials provided, the Raleigh Regional Office of the Division of Water Quality believes the
the proposed logging activities are not required to comply with the requirements of the temporary riparia
rule as long as the timber deed listed above remains valid and Forest Practice Guidelines are followed i
conjunction with Best Management Practices.
