Dear Mr. and Mrs. Johnson:
You have our approval, in accordance with the attached conditions and those listed below, to fill 0.08 acres of
wetlands in Carteret County for the purpose of residential construction as you described in your application received
by the Division of Water Quality on May 2, 2000. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3106. This certification allows you to use Nationwide
Permit Number 18 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you
must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings. P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

SUBJECT: Preliminary land & soils evaluation of Lot#42 Bogue Sound Yacht Club Subdivision
(145 Yacht Club Drive) for potential 404 Wetland areas. Lot located on the east
side of Yacht Club Drive off NC Hwy 24, Broad Creek area, Carteret County, NC.

A preliminary land & soils evaluation was completed of Lot #42 Bogue Sound Yacht Club
Subdivision (145 Yacht Club Drive; -0.46 acre) to determine potential jurisdictional 404 Wetland
areas. The currently used U.S. Army Corps/EPA "1987 Federal Wetlands Delineation Manual"
was used as guidelines to determine potential 404 Wetland areas. The enclosed preliminary land
& soils map shows the various classifications and their locations. The following is a brief
description the these land & soil classifications and their potential for usage:
The Yellow Areas (see map) are uplands that should not come under U.S. Army Corps/EPA
404 Wetland jurisdiction. These areas have non-hydric soil and vegetative indicators to classify
these lands as "uplands". These areas should not come under U.S. Army Corps or NCDEH&NR-
DWQ wetland regulations.
The "Gray Marsh-Symbol Areas (see map) have hydric soil and vegetative indicators that
should classify these sites as jurisdictional 404 Wetlands. The upper limits of the 404 Wetland
areas were delineated in the field with "pink/black-striped" flagging. The U.S. Army Corps of
Engineers/EPA and/or NCDEH&NR-DEM-DWQ are the regulatory agencies over the freshwater
wetlands. These 404 Wetland areas cannot be filled, developed, or massively disturbed without
the proper Federal/State permits. Permitted fill will likely be limited to minor road, utility crossings,
and <1.0 acre fill amounts. Larger amounts of fill within 404 Wetlands would require an Individual
404 Permit, which is costly in both time and monies, and difficult to obtain unless major mitigation
is offered.
This is a preliminary evaluation of this tract for 404 Wetlands, which needs to be approved by a
USACOE representative. This report and map should be used for planning purposes only, as
specific on-site evaluations, delineations, approvals, and permits are required by respective
regulatory agencies. The final wetlands delineation will need to be surveyed before final approval
by the USACOE.

Dear Mr. Dorney:
Reference the application of Southern Lifestyles, LLC for Department of the Army
authorization and a State Water Quality Certification to construct a community pier and install a
sanitary sewer line extension with fill material to be placed in wetlands adjacent to Intracoastal
Waterway near Wilmington, New Hanover County, North Carolina. Your receipt of this letter
verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii)
of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be granted
until the certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for State action.
Therefore, if you have not acted on the request, or asked for an extension of time, by July 5, 2000,
