Box 484 Beaufort, NC, 28516 APPROVAL of 401 Water Quality Certification Dear Mr, Barnes: I You have our approval, in accordance with the attached conditions, to dredge 0.59 acre of non-vegetated wetlands in order to construct a marina on your property in Carteret County as described in your application dated 10 April 2000. After reviewing your application, w,° have determined that this fill is covered by General Water Quality Certification Number 3112. This Certification allows to use your LAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including. (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. • If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property. is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. FIELD INVESTIGATION REPORT: - HUBQUARTER PARTNERSHIP, LLC/CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The project described below is subject to the SEPA requirements and the Environmental Assessment is currently being reviewed. The applicant has chosen to go forward with the application at this time. Harkers Village, owned by Hubquarter Partnership, LLC, is located on Harkers Island in Carteret County. The 41.6-acre site is located on the northwestern comer of Harkers Island. The tract is bounded to the east by SR 1335, to the north by the entrance channel of the Harkers Island Harbor' ofRefuge on Brooks Creek, and to the west by Back Sound. Elevations range from approximately 3' MSL to 10' MSL. Brooks Creek, along the northern property boundary, contains an existing channel which is maintained by the COE. The 60'-wide channel provides access to a 250' X 120' county operated harbor at the head of the creek. Project depths within the channel were permitted to -6' below MLW but according to the applicant's survey, existing water depths are -4' below MLW. At the project site, Brooks Creek is approximately 150' in width. The waters of are SA and are closed to the harvest of shellfish and it is not a designated Primary Nursery Area. There is a tidal salt marsh fringe along both Back Sound and Brooks Creek. Much of the marsh is vegetated with a in alterniflora, Juncus roemerianus, a ina paten and Distichlis icat . At the access site*, .the..marsh is approximately 30' in width. Freshwater wetlands also exist on the tract above'thef marsh fringe and have been delineated, surveyed and verified the USACOE. The tract has been subdivided into' 62 lots`, with 32 of the lots in Phase I of development and the remaining 30 lots in phase IL The average lot size is roughly 12,000 fie. Private subdivision roads already in place and will provide access to the individual lots. A Sedimentation and Erosion Control Plan and "Low Density Stormwater permit have already been issued for the development. Water supply =for the subdivision will be provided by an on- site well system. A central sewer system consisting of an on-site septic field and package system has been approved for waste treatment. An upland basin marina with 24 slips and a boat ramp. already exists on the southern most end of Harkers village and provides water access for phase I. - }: Project Description The applicant is proposing an open :water, 25-slip marina along Brooks Creek to provide service for boats 22' to 25' in length.*' A X'66' walkway would be constructed on the access easement located between lots 50 and 51 ` and would be constructed 6' above the marsh substrate. This dock would run approximately 300' waterward of the marsh fringe along Brooks Creek. The dock would then have a "main" jog that would allow for the dock to run another 212' up the creek. Nineteen slips would be 25' in length while six would be 20' in length. The 212' section of dock would provide additional side-to dockage. Twelve 4'-wide finger piers would provide access to the individual slips. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 10 of the Rivers and Harbors Act. However, we have determined that a water quality certification is required under the provisions of Section 401 of the Clean Water Act. A Department of the Army permit will not be granted until the certification has been obtained or waived. According to our administrative regulations, 60 days is reasonable for State action. Therefore, if you have not acted on the request, or asked for an extension of time, by June 17, 2000, the District Engineer will deem that waiver has occurred.
