Box 909 Nags Head, NC, 27959 APPROVAL of 401 Water Quality Certification Dear Mr. and Ms. Johnson: You have our approval, in accordance with the attached conditions, to dredge and fill 0.08 acre of wetlands and shallow water habitat in order to construct a dwelling, shed, two retaining walls, concrete driveway, nprap breakwater and a planter on your property in Dare County as described in your application dated 24 April 2000. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3112. This Certification allows to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do -not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. PROJECT SUMMARY: The applicant proposes to construct a 119' riprap breakwater (with a nine-foot base) a maximum of 31', and an average of 25.5', waterward of normal water level (NWL). In addition the project will include the construction of a dwelling, two landward retaining walls, a 15' x 25' shed and a 105' wooden planter. Lot preparation will include grading and fill activities landward of normal water level. PROJECT SETTING The applicant's property is a vacant 35,624 square foot lot located off Prince Charles Court in Colington Heights. Colington Heights is a small residential subdivision located within Colington Harbour Subdivision, on Colington Island, Dare County. A narrow paved drive accesses the lot, and is located on the west side of Prince Charles Court less than a tenth of a mile from the intersections of Prince Charles and Rhodoms Court. The lot is situated at the end of the paved drive along the Albemarle Sound. Located to the north and south of the applicant's property are developed residential lots with bulkheads. Along the southwest end of the property, along the water, is an existing bulkhead approximately 90' in length. The bulkhead is at the base of a 15' embankment and is backfilled with broken concrete. Approximately 330 square feet of concrete riprap is located around the northern end of the bulkhead return wall to prevent erosion on the back side of the structure. The lot has a 209' shoreline, of which 104' has no shoreline protection. The exposed section of shoreline shows signs of moderate erosion. Erosion has been estimated at a rate of three feet per year by the applicant. The ember along the southwest corner extends along the south property line, sloping down toward the bulkhead, and to the north. On the northeast corner of the lot (outside the Estuarine Shoreline Area of Environmental Concern) there is 2,643 square feet of delineated 404 wetlands that the applicant has received a Nationwide Permit to fill (#199810696). The wetlands extends beyond the applicant's property to the east for several hundred feet. An on site :;inspection of the property indicates that the wetland site may have contained coastal wetlands.at one time. However, over wash resulting from a numbers of heavy storm eventsover :the years have created a. sandy berm cutting off any hydrological connection to the sound. Vegetation in the wetland area on the applicant's property .includes, but is not Iimited to, cattail (lypha Wfolia) and salt meadow grass (Sparrina patens). Soil on the property is primarily a sandy loam with 'sparse vegetation, with the: exception of the wetland area and along _the embankment adjacent to the bulkhead. Vegetation along the embankment is typical of an emerging;mixed hardwood stand. Mike Johnson April 18, 2000 Page 2 PROJECT DESCRIPTION According to the application, Mr. Johnson proposes to install a rock riprap breakwater along 119' of shoreline in the Albemarle Sound. However, on site review indicates that approximately 15' of the alignment is existing. Riprap will be placed a maximum of 31' and an average of 25.5' waterward of normal water level (NWL) and tie into the existing riprap alignment on the north end of the bulkhead. Shallow water bottom/ Estuarine Water filled by the proposed breakwater will be 936 sf (104' x 9'). Riprap will extend from the waterward side of the bulkhead and terminate along the northern riparian property line. An eight-foot opening is proposed to maintain water exchange behind (landward of) the riprap alignment. The riprap structure will have a nine foot wide base and extend approximately two feet above NWL. Water depths along the proposed alignment average one foot below NWL. No fill is being requested in association with the riprap. Additional development on the property includes leveling a 155' x 30' (4,650 sf) section of the embankment, while maintainin the section of embankment along the bulkhead. A 133' x 145' (19,271 sf) area will be filled to accommodate a dwelling, driveway and shed. Approximately 975 sf of the excavated area and 8,990 sf of the area to filled will be located within the Estuarine Shoreline AEC. A 3,224 sf dwelling will also be constructed on the property, and approximately 837 sf of that structure will be located within the Estuarine Shoreline AEC. The applicant proposes to install a silt fence around.the fill area. A 375 sf shed, a 2,600 sf concrete drive, a 105' planter and a 30' retaining wall will be constructed on the applicant's property outside of the 75' AEC line. ANTICIPATED IMPACTS • . Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, in most cases, 60 days after receipt of a request for certification is a reasonable time for State action. Therefore, if you have not acted on the request, or asked for an extension of time, by July 9, 2000, the District Engineer will deem that waiver has occurred.
