PROJECT SUMMARY: The applicants propose to extend the existing private pier and dock 24' waterward of the present location. Also proposed are two boat lifts adjacent to the existing floating dock. Clyde and Mary Owen Page Two 9. PROJECT DESCRIPTION The project site is located at #4 Seapath Shores (Lot 18A), within the Town of Topsail Beach. This property is adjacent to Banks Channel (Topsail Sound) and can be found by traveling south past the Topsail Beach Town Hall to approximately 1 ih blocks past the water tower, then turning right into the Seapath Shores Development. Seapath Shores is a residential development with four waterfront lots and four interior lots. The property owner's of the development share three docks which extend from access easements between the four waterfront lots. Each property owner is assigned a deeded slip at one of the three docks. These three community docks were originally permitted under CAMA Major Permit No. 178-87, which was issued to Philip J. Stevens, on September 3, 1987. The applicants currently own Lot 18A and have a deeded boat slip at the dock which extends between Lot 18A and Lot 17A. This dock is also shared by the lot owners of Lots 17B and 18B. The structure consists of a fixed pier, 6' X 30' and a 20' X 20' floating dock. The structure extends approximately 64' waterward of the existing bulkhead (normal high water). The waters of Topsail Sound are classified "SA" by the Division of Water Quality. The area is not designated a Primary Nursery Area by the Division of Marine Fisheries and is open to the taking of shellfish. In an effort to provide deeper water at the end of the docking facility, the applicants are proposing to extend the existing structure approximately 24' waterward of its present location. This would be accomplished by adding a 6' X 24-floating dock section between the existing pier and the existing floating dock. Currently water depths at the waterward end of the structure are approximately 48 inches at MLW. Moving the structure 24' waterward would provide approximately 72 inches of water at MLW. Also proposed are two boat lifts, each measuring approximately 11' X 17'. The boat lifts would be positioned on each side of the existing 20' X 20' floating dock. In feu of a boat lift on the south side of the floating dock, the applicants would also like the option of installing two (2) mooring pilings approximately 14' off the existing float. 10. ANTICIPATED EMIPACTS The project as proposed would result in the incorporation of an additional 144 sq. ft. of Public Trust Area. The project would not extend more than 1/4 the width of the water body and would not exceed the established pier length along the same shoreline. The applicant has a letter of permission from the adjacent property owner to the north to allow the encroachment into their area of riparian access. The structure would terminate approximately 600 feet from the edge of the federally maintained channel (Banks Channel).:, The proposed new 6' X 24' floating dock could potentially provide docking space for two additional vessels.
