Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in civil and/or administrative penalties. Please be advised that the following is a condition of this DA permit: The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3112. This Certification allows to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification, If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant is proposing to re-construct a facsimile of the marine railway used at the Cassidey Shipyard during the 1800'x. John Wightman Page 2 9. PROJECT DESCRIPTION The project site is located adjacent to the Cape Fear River, approximately 200 yards north of the Cape Fear Memorial Bridge, at 1 Church Street, in downtown Wilmington, in New Hanover County. The one acre property is the applicant's private residence. Historically, the property was the site of Cassidey Shipyard, which was known for building wooden ships during the Civil War. The applicant has included in his application, information chronicling the history of the historic shipyard. The applicant has completed restoration of the house, which is listed on the historical register as the Cassidey-Harper House. The property includes approximately 208 feet of river frontage. The house site has an elevation of +30 feet above mean sea level, with the lawn sloping to the normal water level embankment at the river's edge. Waterward of the river bank there is a grid of old pilings, remnants of the wharf and marine railway from the historical shipyard. There is a single patch of wetland vegetation (Snartina alte iflora), approximately 10 feet long and 6 feet wide, that has colonized at the edge of the old piling stubs. The Cape Fear River is approximately 1000 feet wide at the project site. It's waters are classified as'SC by the NC Division of Water Quality. There are no shellfish resources in the project area. At the.project site,. the Cape Fear River is a designated Primary Nursery Area (PNA), by the NC Division :of Marine Fisheries. The highground portion of the project is classified as "Developed" by the Wilmington-New :Hanover Land Use Plan. The CAMA Areas of Environmental Concern and any area located in the 100wyear flood plain are considered to be classified as "Conservation". The applicant proposes to stabilize his shoreline with the construction of a wooden bulkhead at approximately the normal water level and landward of the small patch of marsh grass. The wall would be 208 feet in length and it would tie into existing walls on adjacent properties. Stone rip rap would be installed to armor the toe of the new wall, five (5) feet waterward of the new bulkhead. The applicant would reconstruct the dock to the approximate dimensions of the original wharf and marine railway used at the Cassidey Shipyard. The proposed structure would consist of a U-shaped wharf. The outer platform would be 144 feet long and 20 feet wide, accessed from the new bulkhead by a pier, 70 feet long and 14 feet wide. The inner platform would be triangular and would be located along the southern half of the bulkhead. It would be 86 feet long and 46 feet wide tapering to zero as it returned to the bulkhead. The structure would be located within the harbor line of the adjacent federal channel. ANTICIPATED TM CIS The proposed reconstruction of the historical Cassidey Shipyard wharf and marine railway would incorporate approximately 6558 square feet of estuarine waters and public trust area. River bottom disturbance and temporary turbidity increases would be associated with the reconstruction of the wharf. Wightman for Department of the Army authorization and a State Water Quality Certification to reconstruct a marine railway with docks, and construct a bulkhead with rip rap armor on Cape Fear River in Wilmington, New Hanover County, North Carolina. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. According to our administrative regulations, 60 days is reasonable for State action. Therefore, if you have not acted on the request, or asked for an extension of time, by June 17, 2000, the District Engineer will deem that waiver has occurred.
