APPROVAL of 401 Water Quality Certification
To Whom It May Concern:
You have our approval, in accordance with the attached conditions, to place fill in 0.10 acre of wetlands for the purpose of
developing Phase VI of the Wilmington Marine Center in New Hanover County, as you described in your application received
by the Division of Water Quality on May 8, 2000 and follow-up correspondence received on July 6, 2000. After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification Number 3106. This
Certification allows you to use Nationwide Permit 18 when the Corps of Engineers issues it. In addition, you should get any
other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project.
you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions.
If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h). Earlier phases of construction for this project resulted in 0.01E Vic} 4 fill, bringing the
cumulative total to 0.11 acre. For this approval to be valid, you must follow the conditions listelr the a
6cwi certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudigitopphefiin You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B
of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447.
This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

The subject propem has been rep ie?ted for the occurrence of wetlands
in accordance to the Corns
L)f Engineers Wetland Delineation Manual (1987).
This propert} contains one fresh?\ater wetland and an open water marina. Upland soils on this site
are mapped as the excessively drained hureb sand. The Nvetlands are a small inclusion of Doravan
muck: which forms a fresh« ater «etland frin-ge. Wetland vegetation is typical of a freshwater marsh
and transition area.

The week of June 19, I received a written request from your office for additional information
concerning the location of the proposed wetland fill. In reviewing the project file, I became
aware that we had previously provided you with copies of the permit drawings that indicated the
location of the proposed fill (copy attached).
The limits of fill shown on the attached drawings indicate the proposed toe of the slope. Standard
BMPs such as silt fence, 3:1 slopes, and vegetated stabilization will be employed on the site.
Please provide us with a detailed description of any additional information you may require.
Please review this package and contact me with any questions, or if additional information is

of Wilmington Marine Center site in New Hanover County. Approval from DWQ is required to
disturb these wetlands. Upon review of the site plan it is not clear where the wetland fill is
requested. For instance are all wetland fills associated with all file slopes shown? Please provide
a map with the wetlands which are proposed to be filled clearly shown by shading.

On April 12, 2000, the NC Division of Water Quality received your application on behalf of Port Cape
Fear Associates for a 401 Water Quality Certification to impact 0.10 acre of wetlands for the purpose of
creating a commercial development in New Hanover County. Your application is incomplete since you have
not included a detailed site plan clearly showing the proposed impact areas in relation to development plans
for the entire parcel. Also, you should discuss how you intend to treat stormwater associated with this
commercial development. Furthermore, the form included with your application package is appropriate for an
Individual Permit but not for a Nationwide Permit as you requested. A copy of the Pre-Construction
Notification form, to be used for Nationwide, Regional and General Permits, is attached. This form can also
be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . Please bookmark this page, as it is
frequently updated to reflect policy changes and revised application materials.
Until this information is received, I will request (by copy of this letter) that the Corps of Engineers place
this project on hold. Also, this project will be placed on hold for our processing due to incomplete

On behalf of our client. Port Cape Fear Associates (d.b.a. Wilmington Marine Center). we are
requesting a jurisdictional verification for their site located at 3410 River Road. Wilmington. North
Carolina.
Attached please find a cope of the jurisdictional wetland plan as completed by Jon Guerre Taylor.
P.E.. Inc. This plan was produced in accordance with the Corps of Engineers Wetland Delineation
manual (1987) and as depicted on the survey of delineated and flagged wetlands by Stuart Benson
& Associates. dated .lanuarv 20. 1997 (Revised February 14, 2000).
The plan also shows the revised wetland line as delineated and flagged in the field by our office. This
revised wetland line is as we discussed in the field January 12, 2000. The revised lines include 1_35-
1_38. which include the relocated lines L15 and L16 in the field and adding X-4 in the field. It also
includes 1-45-1-53. which includes relocating lines WL2. WL3. and WL4 in the field and adding X-1.
X-2. and X-3 in the field. These line revisions are the only revisions on this jurisdictional
determination. the oriuinal submittal information such as data sheets. location plans. etc.. remain
valid for this determination.
We have also included a permit application and supporting plans for a Minor Filling of wetlands on
the same project. The requested fill will cover 4.356 square feet (1/10 of an acre). The filling is
required to allow support infrastructure for a planned commercial development on the property. This
commercial development has been planned for this property for some time.

Due to the severe grade of the property and existing road access to the propertN. the wetland line as
delineated will cause difficult property development configurations. The difficulties ,\-ill be removed
by tilling the area shown on sheet 3 of 3. When permitted the area we are requesting to till will allow
a safer and more economical development plan due to site plan considerations of access.
