Stevens, Director A 00% 001M NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES May 23, 2000 Union County DWQ Project # 000517 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Steve Puckett 2324 Kings Mill Terrace Charlotte, NC 28226 Dear Mr. Puckett: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.19 acres of wetlands and 400 linear feet of streams for the -purpose of constructing the Champion Forest Subdivision at S R I 321 near Twelve Mile Creek as described in your application dated April 12, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions' listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). If you do not accept any' of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office c,f Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. North Carolina- Nationwide Permit 916 Dear Sirs: On behalf of my client, Mr. Stephen Puckett, I am requesting confirmation of eligibility to fill x-0.19 acres of Jurisdictional Waters of the U.S. (±0.17 acres of wetlands and unimportant streams and 150 If of important stream (+ 0:02 acres)) utilizing Nationwide Permit #26. Based on my site visit, Waters of the U.S. on the above described property which are subject to the permit requirements of Section 404 of the Clean Water Act (33 USC 1344), consist of headwater wetlands and intermittent to perennial tributaries of the East Fork Twelve Mile Creek; in the Catawba Basin.. The project is planned to avoid and minimize impacts to the important intermittent and perennial streams. All fill material will be unpolluted. Project construction will strictly adhere to an approved Sedimentation and Erosion Control Plan. ication and-Descrintion The wetlands on this site can be describe as Palustrine Forested Broad. Leaved and Scrub-Shrub Temporarily Flooded. The site is within a drainage area of East Fork Twelve Mile Creek (Water Classification - C). The majority of the site is a moderately to steeply sloping former agricultural land and recently timbered woodland. Mature woodland areas were identified along riparian areas. Vegctatiori X-dri Soil yrdroloav The forested headwater wetland areas are dominated by Facultative Wet and Facultative species. Trees include sweetgum, tulip-poplar, red maple, willow oak, black willow, and American elm. Understory and herbaceous strata includes smilax, sedges, soft rush, poison ivy, etc, Where the soils are more saturated Obligate and Facultative Wet species such as black willow, tag alder, and silky dogwood are dominant. The site includes Chewacla (ChA) soils. These soils are map units which may have inclusions of hydric soils according to the Natural Resource Conservation Service, Technical Guide-Section 11-A-2, June 1991. Champion Forest, Page 2 April 1, 2000 SUAffff"YOF WAITERS OF 7HE U.S. Me dalax Preliminary identification and delineation of the Jurisdictional Waters on the site were determined according to the Corps of Engineers Wetland Delineation Manual, Technical Report Y-87-1, 1987, with Appendices. Preliminary data gathering included review and interpretation of topographic maps; USDA Soil Conservation Survey; aerial photographs, and preliminary site visits to selected areas. Then the Routine On-Site Determination Method was utilized to determine the upper boundary of the wetlands. In order to make a positive wetland determination indicators of hydrophytic vegetation, hydric soil, and wetland hydrology were be identified as described in the manual. RETd,NIDS PER VVGAND MITIGATION The subdivision layout minimizes impacts to the important and unimportant streams. .A.yoidanee. Minimization. and Mifigadan The following avoidance and minimization efforts and measures will also be taken: Best Management Practices will also be employed to minimize impacts to Jurisdictional Waters. These will include: a) Siltation Barriers; Sediment Traps and Diversion Ditches b) Barricades to define construction limits to sensitive sites and to protect trees to be preserved c) Preconstruction meetings d) Vehicular access will be restricted to specific areas to avoid disturbance to adjacent wetlands and natural areas to be preserved, e) Methods to prevent short term impacts will be inspected regularly and maintained during construction of the project. Champion Forest, Page 3 April 1, 2000 f) Wedands/streams to be preserved will be clearly marked prior to construction to prevent accidental damage. The contractors-Mll be held responsible for unauthorized wetland and stream damage not permitted according to plans and specifications. g) Project construction will strictly adhere to an approved Sedimentation and Erosion Control Plan. Best Management Practices will include utilizing siltation trapping ponds and other erosion control structures where appropriate. PROTECTION FROAf FUTURE DEVELOPMENT The preserved wetlands and streams will be protected from future impacts by the applicant or by a group designated by the applicant for this purpose. As required, development of these areas will be deed restricted in accordance with restrictive covenants, or similar mechanisms which will be developed for approval by the USACE and/or NCDWQ. AQUATIC HABITAT The aquatic systems in the project area consist of wetlands and intermittent tributaries. A variety of wildlife is supported by these systems including mammals, birds, reptiles, amphibians, fish, insects, mollusks, and crustaceans. Therefore strict adherence to an approved erosion and sedimentation control plan will be maintained during the construction period in order to control degradation of water quality downstream and protect the areas to be preserved. Short term construction impacts, primarily stream sedimentation will affect aquatic habitat, however this will be minimized to the extent practicable to promote rapid recovery. Aquatic resources are expected to be enhanced through the development of the stormwater detention ponds and littoral zones. THREATENED AND ENDANGERED SPECIES Federally listed plant and animal species with endangered or threatened status are protected under the Endangered Species Act of 1973. The US Fish and Wildlife Service has identified two endangered species - Schweinitz's sunflower (Helianthus schweinitzii), and the Carolina heelsplitter . (Lasmigona decorata). Schweinit es sunflower thrives in full sun characteristic of succession fields, margins, and forested openings. Portions of the site are currently in. old field succession and secondary succession. A survey is currently being conducted to determine the presence of Schweinitz's sunflower. The Carolina heelsplitter is a freshwater mussel which prefers shaded areas either in a ponded portion of a small stream or in runs along steep banks with moderate current. Primary habitat are waters less than three feet deep with a soft mud, muddy sand, or shady gravelly substrate. It is normally restricted to protected silted areas or under banks especially associated with obstructions such as stumps or fallen trees. Its current distribution according to the US Fish and Wildlife Service is limited to portions of two streams -- Goose Creek and Waxhaw Creek -- and a small river originating from rural areas in Union County. Therefore it is not expected to occur on this site. Champion Forest, Page 4 April 1, 2000 The Carolina Darter (Etheostoma collis) is a fish that inhabits small streams such as those found in the project area. This species has a federal status of Proposed Special Concern and a state status of Special Concern. The species prefers small clear streams of less than IS' width with moderate to swift current and a sand/gravel benthic composition. It apparently tolerates a wide range of water quality conditions and vegetation types adjacent to the streams and appears resistant to pollution. (E. Menhinick). Therefore, strict adherence to an approved erosion and sedimentation control plan will be maintained during the construction period in order to control degradation of water quality. CULTURAL MOURCES The State Historic Preservation Office (SBPO) has requested a archaeological survey based on a review of information submitted and due to the presence of an existing cemetery. The site will he evaluated by a qualified archaeologist and submitted to the SE PO for concurrence. CONCLUSION Based on the value of the jurisdictional waters on this site, the developer through sensitive planning has chosen to balance the site's economic viability with its environmental value and permitability. The goal of the Site Plan is to help balance the environmental consequences of this development by minimizing impacts to the important aquatic resources, and providing best management practices to minimize degradation of waters of the U.S. downstream of the project. NC 28126 (704) 547-4061 (704) 547-4055 fax: (704) 547-3128 cell: (704) 904-2255' cell: (704) 904-9499 We examined the 146 + acres south of Cuthbertson Rd., 0.9 mi. southwest of the junction of Cuthbertson and New Town Roads. The objective was to examine the site for the possible presence of species of plants on the NC Natural Heritage Program's list for Union County, particularly the federally endangered Schweinitz's Sunflower (Helianthus schweinitzii).. The field work was performed on March 31, 2000. Site plans showing contours and clearings were used to examine critical areas. The site has been timbered some time ago, with selective cutting. Some large trees have been left, scattered individuals reaching 18 inches diameter breast height. Around an old home site at the backs of the lots on Colson Place and Dobson Drive are several, large White oaks reaching 42 inches diameter breast height. These do not appear to be in the path of construction and could possibly be preserved. Most of the vegetation is in an early successional stage with average sizes of trees less than, 10 inches diameter breast height. The primary soils on the site are Cid channery silt loam, Badin channery silt loam and Goldston-Badin Complex. All three soil types are dry during periods of the year and plant succession is slow. The dominant trees are White oak (Quercus alba), Southern red oak (Q. falcata), Blackjack oak (Q. marilandica), Post oak (Q. stellata), Scarlet oak (Q. coccinea), Pignut hickory (Carya glabra, Red maple (Acer rubrum) and Shortleaf pine (Pgus echinata). However, the overall quality of the forest is poor due to the timbering. All forest edges, roadside edges and the sewer line opening along Twelve Mile Creek were searched for-possible presence of Schweinitz's sunflower. In addition, the presence of the other current eight species of plants was also considered. The swamp at the base of the hill, in the floodplain of the tributaries to Twelve Mile Creek was also searched for the Habitat Analysis, Endangered Plant Studies, Restoration of Habitats, Wetland Mitigation, Monitoring W. Pitts, 3 April 2000 p• 2 presence of the Virginia Quillwort, Isoetes virginica, a historical record for the county. None of the species of concern were found. The Heritage Program lists three Natural Communities as being of concern in Union County. These are: Basic Oak-Hickory Forest, Dry Oak-Hickory Forest and Xeric Hardpan Forest. This site does support a Dry Oak-Hickory Forest, but the integrity of the forest is unacceptable. There are no recommendations regarding plant species of concern. qAR 06 '00 11: 48AM ODELL Y.T.S.
