On December 26, 2019, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification and Riparian Buffer Authorization from the Division for your project. The Division has determined
that your application is incomplete and cannot be processed. The application is on -hold until the following information is
received:
1. Please provide the Division a copy of your response from the U.S. Army Corps of Engineers requesting additional

Good Afternoon, Wyatt:
Thanks for your time on the phone this afternoon. Per our discussion the Pre -construction Notification (PCN) for the
proposed Barnes Landing Subdivision (SAW-2019-00920), dated December 26, 2019 is incomplete.
To facilitate our documentation of the proposed project's compliance with requirements and conditions for use of
Nationwide Permit 29, please provide the following information:
1) The application states that lots will be provided with sanitary sewer connections to the Johnston County collection
system. Please provide details about, and if necessary delineations within, corridors proposed to make this connection.
Based on our conversation, I understand that community or individual septic systems may be proposed instead. If this is
the case, please provide information (grading and crossing locations/widths) necessary to demonstrate the impacts
associated with these facilities fit within the limits of NWP 29. If additional connections/corridors will be required to
provide water/electric connections to the project, please indicate these on the maps as well.
2) Please include an explanation of how cumulative impacts to aquatic resources will be avoided on this project in the
future (e.g. methods to avoid impacts may include deed restrictions, conservation easements, etc).
3) The PCN application states that no federally listed species occur on the project, and that there is no potential for
aquatic species to be impacted due to the intermittent status of onsite streams. The USFWS IPaC website also identifies
Michaux's sumac as a concern on this property. Please provide a brief summary of the potential for this project to
impact this species for our use in coordinating USFWS concurrence.
4) The application states that this subdivision is an NCDOT project within Divisions 1-8. This selection omitted several
questions under the Endangered Species Act section of the PCN application. Please note, tree clearing relates to the
potential to affect Northern Long-eared Bat. If trees will be cleared as part of access to, or construction of, crossings of
stream and/or wetland areas, please indicate this in the application.
5) Please provide a profile (i.e. 'along the culvert') view of the culvert crossing for our records to demonstrate
compliance with NWP Regional Condition 3.6.1, and include measures to protect downstream areas from sedimentation
(e.g. a temporary stream bypass pumping, construction during no -flow conditions, etc). If rip -rap dissipation is proposed
at crossings, a post -construction survey may be requested to demonstrate compliance with NWP Regional Condition
4.1.6.
6) Please provide a map depicting the location of stormwater management facilities proposed on the project to
document compliance with NWP Regional Condition 4.1.1
7) Please advise whether a Preliminary Jurisdictional Determination is required for this project, or if the applicant
would prefer to secure permitting with a delineation concurrence email.
Please provide the requested information within 30 days, or your application will be withdrawn. Feel free to contact me
