The North Carolina Division of Water Resources conducted an inspection of the Village Oaks Mobile Home Park
WWTF on January 24, 2020. This inspection was conducted to verify that the facility is operating in compliance
with the conditions and limitations specified in Non -discharge Permit No. WQ0002571. A summary of the findings
and comments noted during the inspection are provided in the enclosed copy of the inspection report.
The Compliance Evaluation inspection was conducted by Division of Water Resources staff from the Wilmington
Regional Office. The following violation(s) were noted during the inspection:

A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General
Statute (G.S.) 143-215.1 and the facility's Non -discharge Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.
If you wish to provide additional information regarding the noted violation, request technical assistance, or discuss
overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A review of
your response will be considered along with any additional information provided. You will then be notified of any
civil penalties that may be assessed regarding the violations. If no response is received in this Office
within the 10-day period, a civil penalty assessment may be prepared.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems, and
you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by
Consent.

Inspection Summary
A routine compliance inspection of the Village Oaks Mobile Home Park WWTF was conducted on January 24, 2020. The
purpose of the evaluation was to verify that the facility is operating in compliance with the conditions and limitations specified
in Permit WQ0002571. Allen Rhue, ORC, was present during the inspection.
This facultative lagoon system was originally issued in 1985 and is still covered under rules which contained no setback
requirements. It is permitted for 13,200 gpd but only averages a little less than half that flow. Influent flow is calculated by
water meter readings for the mobile home park.
The BORC is still listed as David Antinon for this facility. The ORC indicated that the BORC is Brandon Williams. An
Operator Designation Form will need to be submitted to the Raleigh address indicated on the form as well as a copy to the
Wilmington Regional Office as soon as possible.
Recently, the disposal site was cleared of trees that were damaged by hurricanes. This removal activity has caused uneven,
bare spots throughout the field. A vegetative cover will need to be maintained on the irrigation site to allow even effluent
distribution (Permit section 111.4)
Acreage of the disposal site is not fully utilized because of insufficient pressure to the spray heads. This issue has caused
ponding in some areas and was noted in a Notice of Deficiency issued for the last inspection on 7-25-2018. Please note that
the permit requires the irrigation equipment be tested and calibrated once per permit cycle (Permit section 111.7).
Runoff was observed from spray heads to a drainage ditch, cut over time, on the north side of the disposal site and
continues on a downward slope off the property. Irrigation pipes are exposed in the ditch. There is a drainage ditch between
the west edge of the disposal site and the lagoons, that also has pipe exposure and possible runoff. Samples were taken by
the inspectors during the inspection at each ditch for fecal coliform and nutrients. The north back three rows and the west
outer row of spray heads were shut off during the inspection so no more runoff would occur until the issue can be addressed.
Freeboard in the lagoons was at approximately 2 feet which is a concern since the above mentioned spray heads have been
shut off. There was no documentation found for maintenance of the irrigation equipment or disposal site.
A Notice of Violation and Intent to Issue Civil Penalty will be issued for the following non-compliance of Permit W00002571:
1. Failure to perform inspections and maintenance of the Irrigation facility to ensure proper operations. (section V.1-2)
2. Failure to document maintenance activities. (section IV.9)
3. Failure to take measures to prevent effluent ponding in or runoff from the irrigation site. (section 111.5)
