On behalf of Solis Brightleaf Apartments LLC, Mid-Atlantic Associates, Inc. submits this letter in
response to a Notice of Violation (NOV-2020-1-M-0031) dated January 17, 2020. in the NOV two
conditions were identified by DEQ during review of the September 2019 Discharge Monitoring
Report(DMR). The conditions and our response to address these conditions are as follows:
Conditions: Lead was detected on the sole sampling event for which lead was tested in
September 2019 at a concentration of 14.5 ugll. This concentration exceeds the maximum daily
(13.88 ugly)and monthly average(0.4 ugly)allowed in the permit.
Response: Mid-Atlantic notified NCDEQ personnel by email following receipt of laboratory
analytical data. A response from NCDEQ was not received, and subsequent evaluation of the
treatment system has not identified obvious reasons for the exceedance. Lead has not been
detected in samples from the seven monthly sampling events conducted priorto September 2019,
and the three sampling events after the September sampling event. These data suggest the
exceedance observed in September is an anomaly.We will continue to monitor lead concentration
in the effluent from the treatment system as well as continue to maintain the treatment equipment.
At this point remedial action does not appear warranted.
