In response to your April 18, 2000 memo please find the attached
thoughts. I have not had a chance to discuss these with Dennis Ramsey, Coleen
Sullins, or Tommy Stevens and will not be able to do so before your deadline.
Therefore these thoughts are what I believe to be DWQ's position on the 401
Certification for this project - however be aware that the aforementioned individuals may
see something that should be changed. Therefore this is a preliminary review by DWQ
for the points raised in your memo. Please call me at 919-733-9646 if you have any
questions.
1. Items from your memo which I believe to be appropriate conditions of the
401 Certification. This assumes that there is technical just'fication for any quantitative measure
associated with the issue:
Flow increases in bypassed reach.
Monthly minimum releases based on instream flow study
Drought index to trigger minimum releases.
Restrictions on hydropeaking operation.
Flexibility to allow "pass through" of increased Kerr Reservoir flows.
"Reopener" clause to allow modifications to the 401 Certification if
conditions/facts change.
Time limit for 401 Certification which may be more restrictive than FERC
license.
II. Items from your memo which are not clear enough to know whether they can be
put into the 401 Certification.
"Cooperative management approach".
Shoreline Management Plan.
III. Items from your memo which I believe should not be placed in the 401
Certification.
Fish passage around the dams.
Restoration plan for American shad.
Reservoir fishery management.
Recreation improvement plan.
Statewide stream restoration fund as mitigation for the dam's presence.
