PO Box 3299 Wilson, NC 27893 Dear Sirs: You have our approval, in accordance with the attached conditions, to excavate 0.2 acres of wetlands in Wilson Count} for the purpose of sanitary sewer line improvements as you described in your application received by the Division of Water Quality on April 10, 2000. After reviewing your application, we have determined that this action is covered by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12 when issued by the U.S. Army Corps of Engineers. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed below and in the attached certification. 1. Riparian buffer impacts associated with this project must be constructed as perpendicular crossings that disturb equal to or less than 40 linear feet of riparian buffer with a maintenance corridor equal to or less than 10 feet in width. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. NORTH SANITARY SEWER EXTENSION PN-00-019 April 6, 2000 The purpose of this narrative is to define the scope of the project and to define any stream and buffer crossings that will occur during this project. The proposed sanitary sewer improvements will serve the proposed Heritage Place Subdivision located north of the intersection of U. S. Highway 264 and Airport Boulevard in Wilson, NC. The proposed sanitary sewer extension will serve numerous future phases of this subdivision to be built over the next 10 years. Work performed for the installation of this sewer extension will include approximately 1,990 LF of 8" diameter sanitary sewer line and the associated structures. Due to the location of the existing sewer line that this extension will tie in to, the proposed sewer line must cross the Neuse Riparian Buffer that surrounds Hominy Swamp approximately 300' from Airport Blvd. north ofU.S. Highway 264. This crossing is described below. Buffer Crossing # 1 Heritage Place - Airport Blvd North Sewer Extension - Construction Plan # 1 This buffer crossing consists of a 90° stream crossing of Hominy Swamp with an 8" diameter gravity sewer line installed beneath the stream channel with adequate cover. This buffer encroachment is located on property owned by the developer. In order to minimize the impact on the buffer with this stream crossing, the construction limits for the sewer line have been kept to 30' feet wide through the buffer.
