DAVIS Director SUBJECT: Modification of CAMA Permit No. 115-18 issued to T.J.'s Land Development LLC on October 51" 2018 CAMA Major Permit No. 115-18 was issued to T.J.'s Land Development LLC to redevelop a former commercial fish and crab processing plant into a marina in Baker Canal at the head of Battalina Creek a tributary to the. Pungo River in Belhaven North Carolina. The permitted development consisting of 13 defined boat slips, a boat ramp with jetty, a 21' x 84' travel lift slip and pile supported railway, 32' x 195' gravel road for the travel lift leading to an existing concrete pad, upland excavation to widen Baker Canal to a final dimension of 80' x 520' to a depth of -6' at NWL, maintenance dredging within Battalina Creek 38' x 390' to a depth of -6', 520' of bulkhead to stabilize the shoreline of Baker Canal, 6' x 372' wooden dock on the landward side of the bulkhead, as well as a fuel and pump -out services. The permit was modified on April 2, 2019 authorizing an additional 900 square feet of upland excavation along the travel lift rail ways reducing a sharp angle on that part of the property and the length of bulkhead by approximately 100 feet. On April 15 2019 the permit was modified to allow the replacement of approximately 200' of existing bulkhead at the head of Baker Canal near East Pantego Street. On November 1, 2019 the Washington District received a request to modify Major Permit #115-18 to change the construction material of the 6' x 372' walkway landward of the bulkhead from open slat wood construction to concrete hog -slat and to add a 3' access pier to the top of the 56' jetty parallel to the permitted boat ramp. To date the in -water portion of the project are complete and only upland development remains. The proposed modifications fit the specific use standards set out in 15A NCAC07.0208 (b)(6)(A)(B)(G). A check for $100.00 for the modification has been deposited in the Division's account. This office recommends that CAMA Major Permit No. 115-18 be modified to allow the change in material for walkway landward of the bulkhead and the addition of the 3' pier atop the boat ramp jetty.
