Ed Sconfienza 1111 Oberlin Road Raleigh, NC 27605 RE: Lenox Place at Garners Station / • • NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES April 10, 2000 DWQ # 00-0466 Wake County Page 1 of 2 APPROVAL of Neuse River Riparian Buffer Protection Rules MINOR VARIANCE [15A NCAC 2B.0233(9)(b)] with ADDITIONAL CONDITIONS Dear Mr. Politis, You have our approval, in accordance with the conditions listed below, to impact 840 ft2 (140 ft2 of permanent impacts and 700 ft2 of temporary impacts) of Zone 2 of the protected riparian buffers for the purpose of constructing the proposed stormwater retention out-fall structure within the proposed Lenox Place at Garner's Station residential community in Garner, Wake County, NC. This letter shall act as.your Minor Variance approval as described within 15A NCAC 26.0233(9)(b). In. addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and Water Supply Watershed regulations. This approval is only valid for the purpose and design that you described in your Minor Variance Request dated 3/31/00 and Grading and Storm Drainage Plan (Site 201 and 202) revised 3/30/00 except as modified below. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. 1. No impacts shall occur to Zone 1 of the protected riparian buffers. 2. The 700 ft2 of temporary impacts as described within your request shall be re- vegetated with herbaceous vegetation immediately after construction and with at least 2 native hardwood tree species (3 to 5 gallon potted plants) planted at a density of 320 trees per acre within one growing season after completion of construction. 3. Stormwater discharge from the rip-rap dissipater shall be at non-erosive velocities prior to entering Zone 1 and the retained portions of Zone 2 of the protected buffers. 4. Any additional stormwater located on the remainder of the property shall be directed to sheet-flow at non-erosive velocities through the protected riparian buffers. 5. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). If you do not accept any of the conditions of this certification, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, PO Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer Protection Rules [15A NCAC 2B .0233(9)(b)]. N V w U a N s Per our meeting yesterday, we have relocated the discharge point for Retention Pond "B" to a location within Zone 2 of the Neuse River Buffer. We have also oversized the riprap dissipater at the discharge point to compensate for any washout that may occur in the large stream channel due to heavy periods of precipitation. This dissipater is also located in zone 2. N I have forwarded these same plan revisions to Mr. Jake Taylor of Wake County Soil and a Erosion Control (856-7548) and informed him that we had met and found a solution that complies with the Riparian Buffer rules. He informed me that if the minor variance was accepted, a copy of the approval letter could be faxed to him at 856-5855.
