Dear Sirs,
You have our approval, in accordance with the attached conditions, to impact
approximately 7,500 ft2 of protected riparian buffers for the purpose of constructing the Sedgefield
Farms Subdivision Sanitary Sewer Outfall, Wake Forest, NC, as described within your application
and proposed construction plans revised 4/18/00. In addition, you should get any other required
federal, state or local permits before you go ahead with your project including (but not limited to)
404 Permit Sediment and Erosion Control and Non-Discharge.
This approval is only valid for the purpose and design that you described in your
application and proposed construction plans revised 4/18/00. If you change your project, you must
notify us and you may be required to send us a new application. If the property is sold, the new
owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask
for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.

Dear Mr. Zarzecki:
As discussed in our conversation last week, Appian Consulting Engineers, P.A. (Appian), on behalf of CLM
Associates, LLC, would like to modify the proposed design for the sanitary sewer outfall for the proposed
subdivision. As discussed during our telephone conversation, we are seeking to minimize the impact to
the riparian buffer during the construction of the Sedgefield Farms Subdivision, which is to be constructed
in a northern portion of the Town of Wake Forest. As stated in previous correspondence with your office,
the subdivision is to be constructed west of Dunn Creek, a tributary of the Neuse River. Additionally, a
portion of the outfall crosses over drainage which discharges into Dunn Creek, and therefore through
areas defined as Neuse River buffers. During our conversation, you indicated your reticence with our
proposed approach to the aforementioned area. You indicated that you would not approve our design for
this area, which called for the installation of the sewer with a minimum cover of three feet and pipes to
drain any water retained behind the bermed area, because covering the pipe would be "filling" of the full
width of the buffer area. Therefore, you requested we install an aerial crossing over a portion of this
buffer. As indicated in the enclosed plan sheet, we have altered the design to reflect this change.
With this alteration, Appian is requesting approval of the design alignment and permission from your office
to proceed with construction. Should you have any questions or need anything clarified, please to not
hesitate to contact us. We look forward to working with you and your staff on this project.

On February 22, 2000, Appian Consulting Engineers, P.A. (Appian), on behalf of CLM
Associates, LLC, presented to your office a letter outlining our approach for minimizing
our impact to the riparian buffer during the construction of the Sedgefield Farms
Subdivision in a northern portion of the Town of Wake Forest. As stated in that letter,
the subdivision is to be constructed west of Dunn Creek, a tributary of the Neuse River.
After not receiving a response to our letter, we contacted your office and Mr. Bob
Zarzecki informed us that we needed to re-submit the information along with seven
copies of the approved PCN form in order to obtain the necessary approval. In
accordance with your directives, we are submitting the required documentation for your
approval.
With respect to the construction activities which will take place as part of developing the
Sedgefield Farms subdivision, according to Paragraph (4) of the North Carolina
Administrative Code (NCAC), Title 15A, Section 213, Subsection .0233 "Neuse River
Basin: Nutrient Sensitive Water Management Strategy: Protection and Maintenance of
Riparian Buffers", the riparian buffer extends outward from the creek, perpendicular to
the water course for a distance of fifty feet from the top of the stream bank. While no
part of the planned subdivision encroaches into the riparian buffer, a portion of the
sanitary sewer outfall, which must be constructed to service the subdivision, does
encroach into the riparian buffer and actually crosses an intermittent tributary of Dunn
Creek. Since the Town of Wake Forest requires that all subdivisions of this size, that are
contained within the Town limits or it's Extra-Territorial Jurisdiction, be connected to the
public sewerage system, Appian explored alternative layouts for servicing the property.
However, no suitable option could be determined that would provide gravity drainage of
the subdivision. Therefore, Appian designed the sanitary sewer outfall to be as

protective of the buffer as possible and only encroaches into the riparian zone to cross
an intermittent tributary of Dunn Creek.
To remain in compliance with 15A NCAC 2B.0233, Paragraph (8), Appian is requesting
that the North Carolina Department of Environment and Natural Resources, Division of
Water Quality (NCDENR-DWQ) make a finding of fact that there is "No Practical
Alternative" to installing this sanitary sewer line as shown on the enclosed plans. To
assist in reaching this conclusion, Appian has included a completed PCN form in
accordance with Subparagraph (b) of Paragraph (8).
Since the sanitary sewer is considered a "non-electric utility line", it is our understanding
that what is proposed in these drawings is "allowable" since it would fall under the
category of a "perpendicular crossing that disturbs greater than 40 linear feet but equal
to or less than 150 linear feet of riparian buffer."
Therefore, Appian is requesting a determination of "No Practical Alternatives" for this
sewer line installation and permission from your office to proceed with construction.

You have our approval, in accordance with the attached conditions, to impact stream buffers for the purpose of
constructing a sewer line at Sedge Field Farms subdivision as you described irr your application dated February 22. 2000. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3101. This
certification allows you to use Nationwide Permit Number 12 when the Corps of Engineers issues it. This approval is also valid
for the Neuse River Buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but no limited to) Sediment and Erosion Control, Coastal Stormwater, Non
Discharge and Water Supply Watershed regulations.
This approval is only valid for the purpose and design that you described in your application. If the property is sold,
the new owner must be given a copy of this approval letter and is thereby responsible for complying with all conditions. This
approval is only valid for the purpose and design that you described in your application. If you change your project, you must
notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. This approval shall expire
when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H
.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.

Appian Consulting Engineers, P.A. (Appian), on behalf of CLM Associates, LLC, is
in the process of preparing construction plans to be used in developing the
Sedgefield Farms Subdivision in a northern portion of the Town of Wake Forest.
The subdivision is to be constructed west of Dunn Creek, a tributary of the Neuse
River. According to Paragraph (4) of the North Carolina Administrative Code
(NCAC), Title 15A, Section 2B, Subsection .0233 "Neuse River Basin: Nutrient
Sensitive Water Management Strategy: Protection and Maintenance of Riparian
Buffers", the riparian buffer extends outward from the creek, perpendicular to the
water course for a distance of fifty feet from the top of the stream bank. While no
part of the planned subdivision encroaches into the riparian buffer, a portion of the
sanitary sewer outfall, which must be constructed to service the subdivision, does
encroach into the riparian buffer and actually crosses an intermittent tributary of
Dunn Creek. Since the Town of Wake Forest requires that all subdivisions of this
size, that are contained within the Town limits or it's Extra-Territorial Jurisdiction,
be connected to the public sewerage system, Appian explored alternative layouts
for servicing the property. However, no suitable option could be determined that
would provide gravity drainage of the subdivision. Therefore, Appian designed the
sanitary sewer outfall to be as protective of the buffer as possible and only
encroaches into the riparian zone to cross an intermittent tributary of Dunn Creek.

To remain in compliance with 15A NCAC 213 .0233, Paragraph (8), Appian is
requesting that the North Carolina Department of Environment and Natural
Resources, Division of Water Quality (NCDENR-DWQ) make a finding of fact that
there is "No Practical Alternative" to installing this sanitary sewer line as shown on
the enclosed plans. To assist in reaching this conclusion, Appian has included as
part of this letter the following in accordance with Subparagraph (b) of Paragraph
(8):
(i) The name, address, and phone number of the applicant;

As specified above, the nature of the activity is the installation of a
sanitary sewer line to service the Sedgefield Farms Subdivision.
(iii) The location of the activity, including the jurisdiction;
The location of the Sedgefield Farms Subdivision is displayed on the
enclosed plans. The property falls under the jurisdiction of the Town
of Wake Forest.
(iv) A map of sufficient detail to accurately delineate the boundaries of the
land to be utilized in carrying out the activity, the location and dimensions
of any disturbance in riparian buffers associated with the activity, and the
extent of riparian buffers on the land;
The enclosed plans and attached excerpt of the Rolesville quadrangle,
U.S.G.S. 7.5 minute topographic map demonstrate the requested
information.
(v) An explanation of why this plan for the activity cannot be practically
accomplished, reduced or reconfigured to better minimize disturbance to
the riparian buffer, preserve aquatic life and habitat and protect water
quality; and
As discussed above, no other alternative is possible which achieves
the goals of this requirement.
(vi) Plans for any best management practices proposed to be used to control
the impact associated with the activity.

The enclosed plans indicate the BMP's to be employed to minimize the
impacts to the buffer.
Since the sanitary sewer is considered a "non-electric utility line", it is our
understanding that what is proposed in these drawings is "allowable" since it
would fall under the category of a "perpendicular crossing that disturbs greater
than 40 linear feet but equal to or less than 150 linear feet of riparian buffer."
Therefore, Appian is requesting a determination of "No Practical Alternatives" for
this sewer line installation. Should you have any questions or need anything
